    When lawyers are arguing about what the word is means the country is in serious trouble

      Welcome to supreme court cases lol. The scarier part is originalists spending pages of their decision theorizing what a single word (like "is") meant in their decisions... But the lawyers, it makes sense: if that's who's deciding the case, you have to play to your audience

      Originalist don't believe that the Constitution is a living document and subject to the arbitrary whims of our modern linguistic manipulations.
      Words matter and I'm thankful there are people on the bench who keep that standard.

    At the end of the WHOLE DAY, trial courts have broad discretion to do most anything they want. The Constitution isn't worth the paper it's written on these days, unfortunately. In fact, those two words - broad discretion - rips the Constitution to shreds. Courts use the freebie of discretion to make or break freedom.
