Rory I feel for this guy I wasn't born in uk but immigrated there when I was 6 k ew no other life, in 1996 was forced to apply for birth passport, in 1999 went on holiday nearly deported to a country I didn't know on way back to UK. Was forced to apply for ilr after flipping 25 years, that only got awarded in,, 2000. I contested that in 2002 went on hols but now stopped from entering the UK told to stay in Sa, tried everything lawyers wouldn't help no money was forced into destitution, UK mps refused to get involved, wrote to every org I could think of, now 2020 I am being forced to go expensive legal. I have only managed to get money for consultation, thanks to friends, haven't seen my family for 18 years now.. So I know how he feels. I applied through Windrush as well was denied didn't fit the criteria I'm still stuck here

It would disturb your soul more if you had to pay taxes to take care of people who are not rightfully citizens, or if you lost jobs to those people. Here in America, the black community is suffering terribly because they are the ones most affected by having to share economic resources with illegal immigrants. They lose jobs, low income housing, and welfare benefits to the illegals more then any other community. We want to take care of Americans first, and we can not take care of everyone, and how people feel about it is just too bad. Foreigners are not a part of our system.

Basically, he was born after 1983 and is subject to immigration laws, including deportation. Very upsetting.
Here is the full explanation of these types of situations according to Wikipedia.
Even if a child born in the UK on or after 1 January 1983 but does not acquire British citizenship at birth, the child is considered a lawful resident in the UK and is not required to apply for leave to remain.[11][12] The child, however, is subject to immigration control and the child's parent(s) can choose to apply for regularisation of the child's immigration status by the grant of leave to remain (for the same period as that held by the parent(s)). If the child leaves the UK, he/she must hold leave to enter or remain in order to return to the UK.[13]
    Before 1983 Edit
Between 1949 and 1982, birth in the UK or a Crown Colony was sufficient in itself to confer the status of Citizen of United Kingdom and Colonies (CUKC) irrespective of the status of parents, although only CUKCs with a connection to the UK (i.e., birth in the UK or has a UK-born parent or grandparent) would have right of abode in the UK after 1971 and would eventually become British citizens in 1983. CUKCs without a connection to the UK would become either British Overseas Territories citizens or British Overseas citizens in 1983 depending on whether they have a connection with another BOT.
The only exception to this rule were children of diplomats and enemy aliens. This exception did not apply to most visiting forces, so, in general, children born in the UK before 1983 to visiting military personnel (e.g. US forces stationed in the UK) were CUKCs connected with UK and would become British citizens in 1983, albeit as a second nationality.

Firstly, I have Sympathy for the plight of any person such as this young man, Children are
born innocent, under Current U.K Law, Children born to foreigners in the U.K, are not
british, the Law was updated to Stop those who Could afford to, from Coming in Just to
give birth, and Claim Citizenship, a Child born in the U.K Can only be Regarded has british
if one of the parent has british Citizenship, if both parents has no Citizenship in the U.K,
then the Child Automatically inherit the Citizenship of the parents Country,
it isn't clear how many people belongs to ''the windrush Generation'' because many of
those who arrived in the U.K as Children travelled on their parents passports, and many
did not apply for travel documents, in 1971 the U.K Government introduced ''the Immigration
Act'', when Commonwealth Citizen already living in the U.K, were given ''Indefinite Leave
to Remain'', After this the U.K home office said, that it had not kept any Records of those
Granted ''Indefinite Leave to Remain'', neither did the home office issue any paperwork
    Confirming this abnormality,
That means it became almost Impossible for windrush migrants to prove that they were
Living in the U.K Legally, on top of that, Landing Cards belongs to windrush migrants were
destroyed, by the home office in 2010, then again, Changes to the U.K's Immigration Law
in 2012 Required people to have documentation to work, Rent a property or access benefits,
Including healthcare, this has Cause those Affected, great Suffering and Injustice, I believe
there is a Racist undertone to all of this,

If this young man's birth certificate indicated that his mother was born in the UK before 1st January 1973, he would already have a British passport. If he was born after 1983 according to the law his nationality is whatever his mothers is unless she was married to his father and his father was British or both were naturalised citizens.

The one thing i don’t understand is why the windrush generation didnt get their passports sorted. Baffling.

    • @PhysicsEnemy
      @PhysicsEnemy 3 роки тому

Many will have tried to get passports and been refused. They lost British Nationality when their countries became independent. Also cost & beurocracy factors.

@@PhysicsEnemy I think it demonstrates unfortunately the level of naivety and understanding of the need for official documentation amongst the windrush generation. Its almost a given to have a passport, driving licence and medical card in the UK. To think so many of the generation never even once thought of paying a visit to their ancestral home and hence need a passport is mind boggling.

Why don't you go on GMB with Piers Morgan? He's helping a few Windrush Generation people with their descendants. He and his lady co-host (sorry Luv, I just can't recall your good name right now) are doing a heck of a good job at delivering justice!

The people they actually deport are criminals. If you have an indefinite stay passport, then usually, as long as you break no laws, you will be allowed to stay. But the point is, a citizenship should NEVER simply be handed out because someone wants one, or because they were born in the country. Its something that should be earned, and awarded. Its not something people can feel as if they are entitled to it.
