  • Eligibility criteria for Permanent Residency after 2 years through the 186 Temporary Resident Transition Stream.
    Starting from the end of 2023, short-term 482 visa holders will have a pathway to Permanent Residency (PR) through the Temporary Residence Transition (TRT) stream of the Employer Nomination (subclass 186) visa. This PR opportunity will no longer be limited to 482 visa holders with occupations on the Medium and Long-term Skilled Occupation List (MLTSSL). Instead, it will be open to all Temporary Skill Shortage (TSS) visa holders whose employers wish to sponsor them.
    Additionally, the requirement for the length of time that an applicant must hold a 482 visa before being eligible for PR will be reduced. Currently, applicants need to work for their sponsoring employer for a total of 3 years in the same occupation while holding a 482 visa. However, from the end of 2023, this duration will be shortened to just 2 years.

    Hi. Thanks for your great content! Just to clear it up, please. I need to be under 45 to apply for the 482. I am 44 atm but would be at least age 46 until I'm able to apply for the 186 visa after going through the 482. Am I still eligible? Thank you!

      Hi! Thanks for getting in touch! There is no age limit to apply for the 482 visa but the age limit to apply for the 186 is 45. Therefore you will need to be under the age of 45 when you apply for the 186 visa.       Hi Amey, thanks for getting in touch and apologies for the delayed reply this one must have slipped through. The answer is YES, you need to continue to work in your nominated occupation with the same employer once the 482 visa has been granted.

    how you can say 2 years requirement start from 1 jan 2024, i have not seen anywhere.

      Hi, thanks for getting in touch. As per Claire O'Neil's statement earlier in the year "by the end of 2023, all temporary skilled workers will have a pathway to permanent residency". We are expecting these changes to be fully implemented by 1 January 2024. This is what we know right now and as soon as we receive any updates we will be sure to post them

    Hello! What about the requirements for my partner who is a dependant to my 482? Can we apply together to the 186? What level of English does he need? Are there any other requirements for him? Thanks

      Hi Natalia, your partner can apply as a dependent for the 186 - similar to the 482 application with slightly different eligibility criteria. Your partner will need to have 'Functional English'.     My 482 TSS completes 2 year in Nov 23, Will I be able to apply directly for 186 TRT? or what will be the next step please guide.

      Hi, Thanks for reaching out! From what we know, the new changes will be implemented 'by the end of the year (2023)'. As soon as these changes are officially introduced 482 visa holders will be eligible to apply for PR in accordance with the new two year requirement. As your 482 visa expires in November, you might need to apply for an additional 482 visa depending on when the new changes are made official.     Hi,
    That's awesome news!
    Fingers crossed that it will happen by the end of 2023.
    I'm wondering theoretically how to transition from a 482 to a 186 TRT?
    I have to complete the two years, so it means I'll be eligible to apply on the last day, right?
    I can't apply earlier than the expiry date, but cannot apply later neither.
    There is waiting period for nomination for example.

      Hi, it is great news! In theory if the new changes happen as per expected, once they come into effect you will be eligible to apply for the 186 TRT the day after you hit two years on your 482.     Hi Tech visa,
    Friend of mine applied for 482 visa and its going almost 2 years, which mean he can apply for his 186 visa potentially next year, but unfortunately the business will be sold to another employer. So does it mean that he needs to start over to work with his new employer or he can just continue like normal and apply 186 soon with new employer? thankyou

    Iam Under 482 visa for 3 years after 3 years if the employer not ready to support for 186 . What gonna do?

      Hi Priya, it is the employers discretion as to whether or not they decide to support your permanent residency applications. If they are not willing to proceed with the 186 visa, you could possibly explore independent options i.e. 189/190. Alternatively they could sponsor you for an additional 482 if they would like to retain you as an employee but are uncertain about PR right now.

    So people who are currently in 482 earning less than 70k ie hospitality and care sector are in trouble? I am doubtful the small businesses would pay an extra 15000 dollars to pay for the employees transition to 186 TRT. I hope this will not be the case because they will end up once again, “permanently temporary”. Hospitality and care industry employers are already struggling to find workers.

      Hi Andrew, completely understand your concerns here. The increased TSMIT is a threshold that will need to be met for all future nomination applications lodged in association with a 482 and 186 visa. The goal here is to avoid exploitation of foreign workers and we expect that these changes will contribute accordingly

      @@techvisa_ Oh for sure I agree its going to deter exploitation. I just dont think its fair current 482 holders are on a very awkward position now. It feels a lot of people will be punished for something they had no control of (salary) despite their contribution to the country. Anyways, thank you so much for responding very promptly.

      @andrew1470 this is exactly 💯 correct. We studied, paid high fees, worked for years to be elegible for sponsorship and now we will get punished because our paid awards are below the new tsmit. I think is not fair on us.

      Hi Heny, we are expecting these changes to be implemented by the end of 2023 (according to Minister O'Neills announcements). If that is the case, then you will be eligible to apply for PR once you have held your 482 visa for a total of 2 years working for the same employer.       Hi Sofia, thanks for getting in touch! As you lodged your 482 nomination & visa application before 1 July 2023, you won' need to meet the new increased TSMIT of $70,000. The new TSMIT only applies to nomination applications lodged after 1 July 2023.

      @@sofiaforzano2103 For the 186 application you will need to meet the new minimum salary threshold of $70,000 as this nomination application will be lodged after 1 July 2023.

    Hi! Do we know if this new pathway ( 482 tss to 186 ) has an expiry date? If i start my 482tss visa now, will i be able to apply for the 186 in two years time? I read somewhere that it will not be accessible after july 2024..?

As we can not predict how the legislation could change in the future, it is safe to assume the reduced time period (from 3 years to 2 years) will not expire in two years as it is only coming into effect from the end of this year.       @@user-qv5gc5dt1l That was a temporary measure in response to the COVD pandemic that the department enforced for 482 visa holders that were in Australia during COVID. The new changes will be similar but permanently enforced moving forward.

    Hello, I have got an opportunity to work for an employer for 2 years under 482 visa. They said, they will support for 186 visa after 2 years. So i am confused that, if my visa expired after 2 years, how can they nominate me for 186 visa? Will I be able to stay in Australia?

      Hi, great question. The department allow you to apply for the 186 TRT visa 3 days before the 482 expires. This essentially gives you a 'grace period' to avoid having to apply for an additional 482 visa in order to meet the 2 year mark. There are a number of boxes you need to tick to ensure you meet the relevant eligibility criteria with these time frames.
