I was unable to find the trademark Pear-Man in the Trademark Electronic Search System of the US Patent and Trademark Office. Have you, or your lawyer, or patent agent filed the application in the past few months?
No surprise, the TM symbol has little legal weight. Anyone may use it on their mark. It awares people that you claim common law trademark rights. The ® is what you can't use without registration. Don't get me wrong, I think it's silly to put a TM on some generous name and doodle, but he might be able to do it as a whole.
@@toblerowner8819 He can use the TM mark when he’s filed application documents for the registration mark, granted by the USPTO. this is still his character and he has proof of this if he posts it frequently and it the first/only person to have ever drawn and posted it.. so that being said.. if someone were to “steal” the exact design, they could be in trouble. although maybe not commercially trademarked as a specific character under his specific brand, i’m pretty sure artwork is copyrighted from the moment it has been created. meaning if someone were to steal it for their own patent or whatever (like someone in this thread said), he would be able to fight that and would have proof that this is his creation. I THINK! that’s what i remember learning ab in class lol
This feels like an ad. "More visual space"? The pen is taking up the same amount of space. It's not magically invisible. The entire end of the pen still blocks the same amount of view of what you're drawing. Unless you're trying to say you need to see behind your knuckles in order to draw, in which case you're less talented than a toddler. Plus this design forces your fingers further away from the end of the pen, making the strokes less precise. You can see even in this video a dozen mistakes where lines don't match up. I don't know how much you were paid to show off this pen, but it's basically the MyPillow of art. Artists don't need more useless gadgets. They need a reliable pen with a solid tip that flows smoothly without scratching. Good, high quality craftsmanship. Though, honestly, most artists just use pencil.
Actually, if you practised enough you don’t even need to see every grain of carbon/ink you’re scratching on the paper. You don’t need to see it, you can just feel it.
Theres a few, one thats out of his control, unless he paid for his videos to be pushed, it the fact youtube keeps recommending this to people who all hate his voice and are above the age of 10

Him drawing Jon from Garfield and dr doofenshmirtz and just giving them different outfits. Reminds me of my DA days where people would recolour sonic/MLP charecters and be like "tHiS iS mY oC SuNsEt SpRiNkLe Do NoT sTeAl oR i'Ll sUe YoU"
Yeah the whole TM thing on screen made me think of this.

You don't need no special pen to draw haha, it may give more view for those who held thier pens in a way that the hand block your view, but I'm sure that cases is very rare.
me, being left-handed:
I hold my pen like this anyways, this thing would do nothing for me. I'll just stick with the Pigma Microns I got at a hobby lobby for like, $6 lmao
lol I hold my pen like that
Feels like characters you would make up as a toddler: The Pear Man, he likes to eat pears, they make him strong. The villain is called Sand Timer, he controlls time with his hour glass filled with time sand. Last but not least, the Cat Raper, guess what he does.
He's Shane Dawson?
I don't think the sandtimer controls time, he just likes hourglasses
Underrated comment. Lol
He raps songs about cats obviously

I was wondering if anyone else noticed lol
Yeah man. They're called oblique pens. They've been around since the late 1800s.
why does he sound like he’s on the verge of tears
Ok his name sounded like Perry like in "Perry the Platypus" and the second character looks a lot like "Dr. Doofenshmirtz" am I the only one noticing this ??
A lot of people noticed this actually, myself included and I hate it. Plagiarism..
I think it’s a bit useless to use the TM as a way to claim ownership of a doodle or character without actually filing. Patent and trademark rules changed during the Obama administration, giving preference to ‘first to file’. If this guy wants to protect his drawing, then he better file his application now.
@@probablynot1368 yeah straight up I could just file that this is my artwork and then it’d be mine forever lmao
this is still his character and he has proof of this if he posts it frequently and it the first/only person to have ever drawn and posted it.. so that being said.. if someone were to “steal” the exact design, they could be in trouble. although maybe not commercially trademarked as a specific character under his specific brand, i’m pretty sure artwork is copyrighted from the moment it has been created. meaning if someone were to steal it for their own patent or whatever (like someone in this thread said), he would be able to fight that and would have proof that this is his creation. I THINK! that’s what i remember learning ab in class lol
@@probablynot1368 what happened here
This feels like an ad.
Though, honestly, most artists just use pencil.
idc about your bs rant but pen is objectively taking less space because fingers aren't infront of your pencil little cringe
Actually, if you practised enough you don’t even need to see every grain of carbon/ink you’re scratching on the paper. You don’t need to see it, you can just feel it.
I'm glad you started being more real with these videos instead of sounding super excited when you clearly weren't
