No, I'm sorry but entering a restricted area, hopping two fences, and putting yourself in a known path of a coaster doing 70 miles an hour, is not "expected human behavior". It's ignorant, selfish, stupid behavior. I don't agree with the expert on this one. Regardless of how many safety measures you put in place, you just can't stop stupid. This man was going to go retrieve his keys regardless of the obstacles he needed to get past.

@@Wildcattttt What he's saying is that there's historical precedent that those measures were not adequate to protect the area, so the park had the ability to know better. It's not that the guy isn't at fault for being a self-entitled idiot, but it is about the park having actual, tangible evidence that the measures they had taken are not adequate to prevent what they were trying to prevent. It doesn't mean the park is going to lose in court, but it does mean that there is at least some actual evidence supporting a lawsuit.

He's explaining the way the law works. But, multiple fences that close to a roller coaster ought to be enough for most people to reconsider if what they're doing was a good idea. And, most signs are of a color that is recognizable as being a warning sign and typically with images that convey that there's a risk without needing to know English.

I've seen a few people suggesting that the park is to blame for not stopping the ride to get the man his keys. @@johncase1353 people lose things on rides all the time. If you had to shut down everytime someone lost something you'd never open. And a lot of people lose things in the park but aren't sure where or what ride. That's a lot of down time for one person to be happy. When a lot more people will be happy if the ride stays open until close. Like seriously why would they ever close down early to retrieve something you lost. You are responsible for your items at the park you lost it it's on you. They'll give it back if they can find it when it's convenient for them and the rest of the guests. They won't inconvenience the whole park for one person.

This is why the main rule is dont have any lose objects in your pocket when getting onto a roller coaster. Anything can come loose from your pockets/body on any coaster. All loose articles should be placed in designated areas before boarding any ride. The fact that this man ignored those initial park safety protocols, and followed by completely disregarding the posted warnings and protective fences, makes him 100% at fault.

Adding sensors to the part of the track where the ride reaches 68 mph wouldn’t do anything as the ride is traveling on momentum from the first drop and it can’t just come a complete stop during the ride and it’s kinda stupid how this dude got hit by a rollercoaster traveling fast and it’s also very loud. As a rollercoaster enthusiast I have ridden raptor at Cedar Point and heard it from off ride and it is extremely loud and from what I’ve heard banshee has no noise dampening and the ride cycles around every 1 1/2 minute so that should be at least enough time to dodge a moving coaster train (this doesn’t mean grab your stuff from that area if you happen to lose it as this has almost always happened when someone tries to retrieve a loose article they lost on these B&M inverted coasters (the ride type that banshee and raptor are)

Banshee has been operating for 10 years, and I seriously doubt this man was the first to lose his keys on the ride in that time. The fact that this is the first time it's happened at this ride speaks to how well-protected the area is. If anything, it's further proof that if someone wants to do something bad enough, like trespass into a deadly restricted area, they will find a way. If "expert" wants to prove his case in court, he'll have an uphill battle.

This is one of those things where reading the signs shouldn't be necessary. He clearly knew that what he was doing was unsafe and did it anyways.
If you invent better safe guards, you just get improved idiots. At some point, you just have to acknowledge that stupid people can be surprisingly innovative in the ways that they're stupid. This is one death of one person that did something that no reasonable person would do, I'm sure that day alone there were hundreds of people that rode the ride safely and probably thousands that were able to figure out how to not get hit.

While I have sympathy for Mr Nelson’s friends and family, I find it very hard to have sympathy for Mr Nelson himself. It should be common sense that you don’t go into ride areas while the ride is running, and you especially don’t in without permission from the park owners. Mr Nelson’s own stupidity got him killed, and I find it hard to have sympathy those who die by their own stupid actions. Not only has he left his friends and family grief stricken, but his selfishness has also shut down this coaster for god knows how long, denying park goers one of their favourite rides.
Take this as a lesson people: If you sod around, you find out.

So let me get this straight putting up DO NOT ENTER and DANGER SIGNS which shouldn't just be in English (how many languages would have to be done 30-40 were in America speak English) Fences saying Danger do not enter a park employee telling him they would get his keys after they closed because they couldn't stop the ride and it's still the parks fault REALLY. The only person that's responsible is the moron that climbed over 2 fences in a restricted area to get a set of keys. This is what's wrong with this country nobody is ever responsible for their own actions it's always someone elses fault.

That's an excuse, most parking lots offer lockout service, if anything in his car was that urgent, he could have gotten it. And many amusement parks are close enough to town that you can get a cab or bus back into town if you need to. It's highly unlikely that this was his only set of keys.
And at the end of the day, this is a bit like when I locked my keys in the office at work years ago. They were master keys and I was very lucky that they were locked in a room that nobody had access to the keys without a key. His keys were safe, but it could have taken a long time to find them, especially if they bounced in a weird way or got under something.

    • @ryancampbell955

What in the world? You can't just shut down the coaster randomly. They told him they'd help him get his keys at the end of the night. He only needed to wait two hours. So what? Go get a drink, and ice cream, or whatever, go have a seat and relax. His decision to ignore park policy and take it upon himself to enter a dangerous area and put himself in the path of an active coaster was his own fault. I swear, people have zero patience anymore and are arrogant enough to think they're above the rules. This guy was 100% at fault. Plain and simple.

We live in a litigious society and paying heavily for it. I'm pretty sure coasters, like Banshee and Raptor, won't be swooping low to the ground anymore. It's hard to secure every square foot of ride space. If coasters didn't go below 10 or 12 feet... this type if incident simply could not happen. Sad to say because it's thrilling to ride so close to the ground. I love Banshee.
