Yes. IFR on a "diverse departure", 400ft AGL. When VFR, no rule, other than the baseline altitude separation from obstacles and people when not deemed necessary for take off or landing. ATC if departing from positively controlled airport (towered fields essentially) could place a takeoff instruction to delay turn out even while VFR, for some traffic deconfliction or the like, and you are required to comply even if under VFR rules.
