    We are often asked how to move to the USA so decided to do a dedicated video on this topic.
    We cover the difference between a non-immigrant and immigrant visa's. And then, within that the different types of work visa's. We are not immigration lawyers or experts, so are just sharing some basic understanding and guidance on how you make the move possible to the USA. We give tips on how a company may sponsor you depending on your skillset.
    2 main categories of Visa - Non immigrant and Immigrant
    • Non Immigrant = Temporary visa. Anything from tourism to temporary work, which can be up to several years.
    • Immigrant = permanent resident Visas or Green Card. With Immigrant visas, these are either family sponsored (relative or spouse), employment based, through diversity lottery or Specialist e.g work for US government

    I've had my heart on moving to the US pretty much since I was in high school. Now 28 and really doing all I can to find a job or employer who can sponsor me. My background is in Sales and Communication (speaking, presenting etc). This video was very helpful and you both seem really down to earth. :)

    Thank you guys for yet another great video. Just found your channel the other day and I must say I’m hooked. Definitely subscribed! 😊 If it would interest anyone out there would like to just add that you can actually self petition for the employment based visa (not sure if all types but certainly EB1 and EB2) by petitioning for a “National interest waiver”. That basically waives the requirement for a sponsor and then once approved you can go ahead and apply for the green card. Long winding process with lots of paper work but definitely possible.

      That is very true and I think I wrote about that on our website. I don't often mention the self petition as I believe it is really hard as in you need to be at the top of your field, sports star, actor actress etc. Out of curiosity, do you know anyone that has self petitioned? Or have you? Would love to know how easy it was and what the circumstances were.

    Very interesting video, thank you both for the insight. I started the process 2 months ago for an EB visa (Green Card) and the process takes about 2 years and this time I am taking it quite patiently instead of rushing to the US like I did twice in my early 20s on J-1 non-immigrant visa. All of the info you gave is top and it's so detailed. At the moment, I have an opportunity to both go with an EB visa or through employer as a transfer (I think that's the L visa too).

      Thanks! We have so many questions on this and while we are no experts, thought we would share what we can.
      We are also in the process of starting our EB1C visa process. The paper work for the filing alone has taken a while to prepare. I hope to complete the paperwork this week. We expect it to take about 2 years too.
      You say you can go for the intra-company transfer too but have already started the EB visa process. That is interesting. How does that work? Can you apply for both at the same time?
      Most companies will get employees over on the L visa first, if they can, as that is a lot quicker, then once the employee is in the USA, start the green card process. So this is one is a new one for me. Always interesting to hear of new ways.

    Hey ! great video .My husband and I moved to the USA 3 years ago on L!/L2 visas we have just received our green card status but the process was long thankfully we were company sponsored. Good insight into the process for anyone wanting to move here, its not easy !! Good luck with your application !!

    Great video, Selina would love to follow the green card journey. It already seems like a serious level up in terms of what they need to process it - from the L1! Videos on it would be awesome..

      Thank Fifi! And absolutely! It is definitely more complex. It took me about a day just to fill in the attorney's questionnaire for the filing. I still have soooo much paperwork to prepare. Just when I thought I was done with form filling! We have a website going live soon, so plan to share details on there too.

      Thanks! As long as there is not a travel ban between NZ and the USA you will be fine. In our case, the travel ban with the UK is still in place. So whilst we can fly back home, we won't be able to re-enter without being granted an exception.

      @@ANTSEL just found out the same applies to NZ so our planned trip to NZ is on hold until further notice. It was supposed to get us under the 6month 1 day tax threshold so we wouldn’t have to pay double tax. Now we may be going to Mexico instead unless they have restrictions as well. 😂

      Ah I see! We were wondering why. Mexico sounds great! Lots of great places to visit and things to do there. It is one of our favourite holiday destinations.
      Fortunately as the UK has a tax treaty with the US, we did not have to worry about double tax. Did you check with an tax attorney/ accountant how the 183 day rule works? As in, it does not matter when you entered the USA, you can leave and they will only count the literal days in the country? We are curious to know, I am sure others will be in a similar situation so this is good to know.

      All the best for starting uni in September. That is a great field, with so many options. For the last 6 years, pretty much all my roles have involved working with lawyers who work in my company. In terms of skills needed in today's world - skilled legal counsel for corporate law, contracting and in particular for subscription business is much needed at the moment.

      @@ANTSEL thank you so much. I wish you all the best too. Do you know if there’s any jobs in particular that I could get with my UK law degree that could help me emigrate to the USA. I wanted to be a lawyer but the UK law degree isn’t recognised in the USA and I’d have to go through the degree again in the US if I wanted to be a lawyer there. It would be at least 100k in debt for me so I was wondering if there are any more viable routes.

      Law is not a field I know well, the only route I am aware of is working for the legal department in an international corporation. I presume you will need to specialise in corporate law. I know people in my company that cover a wide geography, and global roles too in this capacity and have been seconded/transferred to work in other countries. There may well be other avenues you can take. I would definitely research more in to it.
      Have you looked in to whether there is a conversion you can do in the US, that is perhaps not as expensive? I ask, as a colleague of mine came to the USA to do just that for their law degree (they had a Swiss law degree). This may not help, as it is probably still very expensive!

    Hello! Do you mind me asking if Ant initially went over on a spousal visa? Did he work in the US? Loving the videos, finding them very helpful as we decide whether to make the move with my job.

      Ant came on an L2 dependent visa, to my L1A. He was not allowed to work initially but now L2's can work right away, as they change the rules.

    Hi, my wife’s Dad was born in the UK but is now a US citizen. He lived in California for 20+ years and has now retired to Hawaii. His wife is American born (not my wife’s biological mother). My wife and I (+ 2 kids) are exploring the possibilities of relocating to the states and I wondered how easy/hard it might be and what sort of visa we may obtain through her dads situation

      Hi! We would recommend speaking to an Immigration attorney. You should be able to get a family based green card but it can take many years.
      If you were under 21 years old it would be much quicker.

    Great video! I Am French, I have to apply for Esta and I get denied I don't know what is the problem!
    Can u help me with the answers on how to get an ESTA? as a French which visa is better to apply to enter the United States

      Thanks! Welcome to our channel. Firstly, it is good to know that even if they had approved your ESTA, you can not currently travel to the USA due to the travel ban. When it is lifted you will be able to travel. We can not speak to why your ESTA was not approved but if you want to travel to the USA will need to apply for one of the non-immigrant visa's. B-2 is the visa they give for tourism, B-1 for business. The fact you are French, will not change the visa you should go for.
      This is from the official ESTA website: "If a traveler is denied ESTA authorization and his or her circumstances have not changed, a new application will also be denied. A traveler who is not eligible for ESTA is not eligible for travel under the Visa Waiver Program and should apply for a nonimmigrant visa at a U.S. Embassy or Consulate"
      Based on the above, I would contact the US embassy to apply for the B1 or B2 visa. Please note, because of the travel ban they are not currently issuing visa unless you qualify for a national interest exception. I hope this helps?

      No problem at all. As for the B1 or B2, it is not a case of which is easier, it depends which visa you require. B1 is for tourism only. B2 for business. So do make sure to apply for the right visa depending on what you intend to do in the USA.

    Hey, I’m currently a global assistant manager digital publishing (social media) for adidas HQ in Germany.
    I’m originally from London and got relocated to Germany with the hopes from management to move me to US ( their words were they would when I accepted the offer.)
    It’s been 2 years and this is now not the case. I’m looking to apply for the O-1 visa. Do you think I would be successful?

      Hi, thank you watching and sharing a bit about your situation. That is unfortunate that things havent moved forward for you through your company. Have they said why?
      I do not have much experience with people getting the O1 visa working for a corporation. Living in Vegas we have met people who are skilled performers with this type of visa. If you want to move in a more professional setting the you need a pretty outstanding business experience (as I understand). The downside to the O1 is that is a temp visa so you would still need to get a permanent working visa somehow.
      I would push your current employer to sponsor your move on the right visa. At the very least find out why they have not, what you need to do to make it possible etc.

    Hi can you talk about the E3 visa?im an Australian citizen wondering if that visa can lead to green card?

      Hi Michelle. I would love to help but the visa's I typically speak of, are ones I have had personal experience with. I have heard of the E3 visa and my understanding is that like many 'non immigrant' visa aka temp working visa's they are issued on the basis that there is no intent to permanently reside in the USA. The H1B and L1 are exceptions to this.
      I would consult with an Immigration attorney as I am sure that, whilst there might not be a path to go from an E3 to green card directly, that there are still ways to get a green card whilst on an E3 visa.

      There are not many employment based visa where you can self petition. Most require an employer to sponsor you. There is an EB2 NIW that you may be able to self petition for. I would seek the advice of an immigration attorney to see if you can build a case for that visa.

      Hey! Thanks for watching.
      Just in case there is a misunderstanding - I will start by saying that the green card does not make you a US citizen. The green card is a type of visa.
      Therefore it is not affected by your nationality as it is effectively a long term visa that allows you to become a lawful permanent resident.
      When you apply you will need to supply all information regarding your current dual nationality. Hope this helps.

      Hi! I would consult with an immigration attorney to establish which visa would be correct for you. There is an EB2 NIW that entrepreneurs can apply for or an EB5 for investors but that requires a lot of capital.

      Yes generally if you are married you will have a visa that allows you to apply for a work permit or permanent residency.
      Best thing to do is speak to a US immigration attorney and they will be able to advise on your particular cirmcumstance

    As a newly qualified Psychiatric Nurse can I apply for HB1 VISA? do you know anyone who has been able to do this without experience?

      The H1B is an employer sponsored visa, so the main thing will be to get someone to want to hire you, and cover your visa costs. With the H1B, like the L visa's the employer has to prove there are lack of qualified US workers that could take that position.
      I cannot speak to the US needs for Psychiatric Nurses, but it worthwhile see if there are staffing shortages in various states. I come from the field of Radiotherapy and I do know countries that often have staffing shortages, and hire from other countries. With the US, you might want to check if your qualification meets their requirements too.
      As for being newly qualified, realistically if you find a hospital or clinic that was looking to hire from other countries, the issue will be competing with others who are more experienced. Typically they will want some one with experience.
      If you are looking to move to the USA, whilst you do your research, I would concentrate on getting your experience here in the UK and building a network. I have worked in US clinicians before and that can make for a useful resource or contact in the future.
