8 months ago I signed up for the course studied with prep agent failed the exam once passed on the 2nd attempt and can officially say I just listed my 1st house and also helping another client look for a property!! Hey Joe, The deed is usually signed in front of a notary, but does it legally have to be? Thanks for ALL your help, the premium prep agent course is 100% worth every penny!!
Hey Nicole, check your state law but the answer is generally yes. States usually require an "official witness" which a notary can be. The point is that a third party is attesting to the execution of the document. This might be brought up when a court is deciding whether or not a deed is patently defective. If a deed is defective then the original owner may recover because it is considered void. Hope that helps...
With a general warranty deed what are some things to look out for? We're looking into one right now and it's Owner Financed acreage but there's no home on the property. If we put down the down payment and start paying on the land (leaving a paper trail, of course) could the previous owner stop us from building any permanent structures on the land? In this situation, is the deed (and taxes) transferred immediately into the buyers name or after they are done paying on the property? We don't need this much acreage so we wanted to parcel off some of it to help with the cost of the property. Would we have to wait until after the 20 year contract? Help?

Hi i have one question here , so me and my ex own a house ( we have both name on the property) and we have hard money loan for the house ( both name on hard money loan) so as my ex has bad credit he not able to refinance to standard loan and want me to do it instead, but I don’t want to any debt in me so I refused. Then we breakup , now he going to find another private lender to pay off the current hard money loan ( so I can be remove from the hard money), and also remove my name on the property, may I know should I sign for grant deed or quit claim??

"The deed is the buyer's guarantee that the seller actually owns the property...". Not necessarily. A *quitclaim* deed simply guarantees that the seller is transferring whatever ownership he/she has... but the seller might have *no* ownership claim whatsoever.

Actually, you CAN sell a house without the buying knowing about the liens! The buyer is liable for knowing about the liens on your house, and there's no legal repercussion for not disclosing it as the seller. Funny how that works, isn't it?

Getting loans through Identity theft, and using a really nice house as collateral, and then dumping the real home owner for the full payback of the loan. As defined by " Real or Real Estate definitions" by law, not private property. A store receipt is better than our deeds here in Michigan. Check with the county recorders office to see if they infact own the property.
