- The plaintiff hired the defendant to provide a bouncy castle for her 7-year-old child’s birthday party. The defendant reportedly failed to get the necessary permits, and the birthday party was ruined, so the plaintiff is suing for a refund. The defendant insists he was only hired to provide the bouncy castle and believed the plaintiff would obtain the permits needed.

This lady had the nerve to throw a huge party in a PUBLIC PARK with all these things that needed to be plugged in and didn't once think to check in with the officialls to see if it was allowed?!?!?!?! And it's his fault?!?!
Of course not! It’s a PUBLIC park! Her tax dollars paid for that! She basically OWNs the park. Duh! And those cops should never have given her a ticket, SHE PAY THEIR SALARY!… sorry that was my first time trying to be a Karen Lol. I hope you know im joking 😂

I agree 100% with the Judge. You can't do anything you want in a public park without a permit, if you could, you'd have people throwing concerts and nudist parties everyday.🥳

Yep. Parks are for everyone's QUIET and PEACEFUL enjoyment. You can't be loud and obnoxious at a park. And generators are LOUD.
You can tell how unprepared she is...she's running around last minute. Most of the parks I've had parties at, you have to call them to reserve an area and they will tell you what you can and cannot have at the park. She thought she could just show up and throw a party. Lol smh she needs to pay her own ticket! Accept responsibility!

I hate when people make their problems other people’s problems… There is a high probability that you can BOOK park space through the park’s site and they tell you what is and what isn’t allowed, as with all other city spaces.
Lady it was your responsibility to get permits he wasn’t a planner he just provided the entertainment. She need to take accountability for her failed party 🙄

I was going to have a party in the park and I contacted the parks. I made several calls until I got the right people. You have to do your due diligence.

My thinking would be that the defendant's business would have a contract that specifies that it is the customer's responsibility to obtain the necessary permissions and permits and then on the day of the event, before anything is set up, the permit has to be produced by the customer, otherwise nothing happens and $x is forfeited! Common sense and good business practice, to have such a policy, in my book!
I agree with you, but businesses only care about profits in the capitalist system we live in. Since he's not liable if the party gets stopped, he doesn't care. Also, he may think that the client would not get a permit and maybe cancel him if it's costly, so he just shut up and let them pay for the consequences of not having permits. I doubt this is the first time he encountered negligent clients like her who didn't get permits.

Definitely the plaintiff's responsibility, but I agree with the judge, the defendant should add it to his contract (just a customer friendly, smart business practice).
If I was in the plaintiff's shoes, i would have asked about it with the park or city long before contacting with the defendant. She was clearly disorganized, based on her own testimony.

even though BOTH! litigants have fault, like Judge Milian stated, the defendant SHOULD! have in his contract that the client is responsible for all permits needed for their gathering/party whatever; plaintiff just thought she could arrive at the Park and set up without a care in the World, lesson learned on both sides (maybe)!
I google/ read reviews and articles before doing anything major or minor 😂( I love knowing other people's experiences before buying or going somewhere), and here a quick google about throwing a bouncy castle party in her local park would've made the difference. As the judge said, he's morally liable for not letting people know they should get permits, but she just wasn't prepared.
Who would think it's ok to throw an entire Party with a bounce house without permission from the local park commission??? It takes one phone call or email...she's just as negligent.
@James Sonatore I’m not a man but ok. As I said, doing research would’ve helped her understand the permits she needed and if it was allowed. I have 2 university degrees and the best skill I learned was research research, had long papers and could do nothing without research and getting the right information. People who think they know it all end up in court because they never do, it’s okay to not know things as long you know you don’t know it all you’ll learn.
Girl that is your job. Lol.. I had my son's party in a park under a Pavillion. My plan was to have a cookout but after my research, realized it wasn't permitted. You picked the right one that man knows his business and he knows that he is not your party planner you plan the party hello perhaps the parks you’re used to allows anything you want but apparently this park that you chose for this party has rules and regulations that you must follow, not him not the caterer not the person that made the potato salad you bought at Walmart you are responsible no one else…

A simple google search tells you in the first article, that you should check with your city before setting things up. Most come in a first come first serve basis, others require a reservation and all require permits to set up any bouncy houses

The judge is wrong when she told the defendant that he didn't interrupt the plaintiff, he never verbally interrupted the plaintiff all the judge told him was to stop bobbing his head, anybody knows that if you throw a party in a public area that you are responsible for getting a permit, it is not the job of the person you are renting equipment from to advise you that you need a permit or to go get one for you, the plaintiff has nobody to blame but herself.

@@qp3105 Most people I know just show up to the park at the break of dawn and set up. I've never heard of anyone having a problem. But running machinery is another story. That's what tripped her up.

@@qp3105 I have and it was at a small Yogi Bear Waterpark Resort in my town of Pelahatchie. I didn't get permission from the facility or the town but I had rented the facility and the space big enough for the bounce house. The facility never said anything and the manager came down when were getting ready to go and she didn't even mention a permit.
Damn those poor kids, you know there was a line at the cotton candy machine too, lmao!

I love the simple fact that the rangers went there, gave them a warning as long as everything was shut down, and then they turned it off, and then they turned it on again and it's the defendant's fault they got a fine? the plaintiff was smoking something that I want a piece of.

This judge is annoying me and needs to sit off her bench for awhile. First off, she’s tripping out on the guy for bobbing his head but yet in another case where the female defendant shouted out shut up and kept making comments out loud to the plaintiff she says nothing to her or doesn’t trip out. Like seriously? The people she really need to go off on she doesn’t but the ones she don’t, she do Smfh. Second, it’s not hearsay, the clown is his employee and was there when everything was going on so how is it hearsay?! That’s his witness and his employee was there when the problem occur 🤦🏻♀️🤦🏻♀️

Not true he just rents equipment, if I rent a backo, ditch digger, generator, etc they don't ask what job it's 4, if I need permits or building inspector, what job I need 2 do with rental equipment. I rent a car they ask 4 insurance and license but DON'T tell me where I can drive in it( what state town), speed limits, basic road rules because I should know that b4 rental. If someone rents something it's their job 2 be prepared ESPECIALLY if u r dealing in a Public place and/or situation. If guy was the ACTUAL PLANNER would be different or if he was a contractor needing permit

I feel bad for the Plaintiff not being able to give the kids a full party but in no way is the entertainment responsible for the Plaintiff’s lack of due diligence. And I think she just didn’t know.

Out of curiosity, when did the defendant interrupt the plaintiff?
I know at one point that the judge asked him to stop shaking/nodding his head because it was distracting her, but beyond that I don’t recall anything. Granted, I was multitasking so I may have missed something.
If that was the only thing, that was a distraction, but not an interruption.
Either way, I’m glad he won. The plaintiff was a piece of work and created and then worsened her own problems.
I saw him slightly nodding his head to and down but nothing dramatic. He did also say “absolutely “ and that’s when she said something to him.

Every park I have been through, there are signs on the pavilions and in the park areas with signs to call about reservations for private parties and they tell the planners what they need to get.

A) She needed to get all of her resources in order before setting the bouncy cotton candy and popcorn machines up period.

As an event planner, I can say he should of told her about permits . She is right now alot of people know you need permits at some parks ..and some don't let us out up our jumpers . Always disclose everything your client needs

Remember very few public parks have electricity at ALL.
Some state campgrounds do but have VERY limited hours of when a generator can be ran (it's usually midday and for only 2 hours) and the rangers can shut down a generator that is too loud at any time.
Not only is is it difficult to power large areas like public parks but gas generators are VERY loud and also emit toxic exhaust.
This ruins the quiet peaceful park enjoyment of everyone else there.
If i go to peacfully walk my dog at the park and shes acting out because of a loud generator.... Theres gonna be an issue.

I had my kid birthday party at park. And we called the park and paid a fee of $90 for five hours, which we only use two hours and they said no drugs and no alcohol. When we arrived at the park there was a lady there who hand me permit to sign for the amount time we was there.
I’ve done that as well but I only had 6 kids, didn’t have bounce houses etc. it was a simple affair and the kids loved it. These ppl love their huge parties. Fine, but don’t take advantage of public land.

Common sense if you are using a public space for private use - SHE is at fault. He has no responsibility in this. If a child in the park entered the space vet she would scream at the kid to go away because that’s what entitled people do

It's more of a safety thing as, if one of those kids got hurt, the city could have been sued despite not having given permission for the stuff.

The Defendant ABSOLUTELY should ask his customers if they've obtained the proper permits as part of his regular operational practices. There should be a check box on his contact. Smh
Yeah, this is a tough one. A lot of people don't know, you need a permit to have elaborate parties in a public park. Etc. Owners take full responsibility of their employees, and although defendant wasn't there, his employees (Clown, Snack cart man etc.) were present, and in attendance. They probably stood back and laughed while Chinese Whispers, and hoopla and gossip about her not having a permit, was being discussed. Park Ranger showed up. They should have packed all that crap up, and offered her refund in some form etc.

The plaintiff gave hearsay testimony. When she said what another person told her I thought to myself how I do t like that JM allows that. Judge Judy won’t and I don’t think a judge should.
So when the defendant tried to do it she goes off. I do t get it.
I’m thinking because the plaintiff’s hearsay testimony is pretty irrelevant. Like it doesn’t matter if another party-goer called and told her that the rangers were shutting them down or if the rangers were telling the plaintiff directly about the issue. Wouldn’t make a difference in the case. But with the defendant’s hearsay, he’s trying to show that the plaintiff went against the warning by turning the generators back on (going to the issue of fault with the ticket by trying to show that the plaintiff got a ticket because of her own actions so it’s not his fault).

Because what you're talking about are two different things. What he was trying to use as testimony was "This person told me this was their experience" while what the plantiff said was "My experience was being told this". She was actively present in the conversation with the cop while he wasn't present at the party so anything she says, the judge is able cross reference while she wasn't able to do so for the clown.

He been in business 15 its no way being in business that long that he does not know to tell the client they must get a permit. He told on himself when he said he did hundreds of parties with and without permits so he did have knowledge and he should have it in his contracts. I think the judge missed that information
The sad thing is, he's not justified to press her on that. It would have been nice if he did. Regardless. His boys. (Clown and Snack cart man) were at the party, and knew gosh darn well,, she had no permit, and they saw Park Ranger tell everybody to leave. They continued to offer services and ignore the Park Ranger, instead of packing the jumper and food carts up etc. and probably found that crap funny, while poor plantiff drove to the precinct to set things straight etc. So in that case, Defendant is a jerk for allowing Clown and Snow cone man to stay there, and should have refunded her.

It's damn amazing how people feel like they can do *anything they WANT to do* in a public space that is allocated to everyone! *How about her being considerate of others, doing her homework, and thinking about someone - anyone - other than herself and her child?* And as for the defendant, he should also be aware of permitting and other business matters involved with setting up his equipment (instead of relying on his clown for guidance and information). He's a sorry businessman whether or not he's been doing it 15 years or 15 minutes.
If I were a kid and the cops shut down my outdoor party, I'd be thrilled. It'd be something to brag about to my friends at school. Anyway, I highly doubt that the 7 year old's birthday was completely ruined. It was merely a change of venue.
