I've had the same thoughts, too. :) I kinda consider Tony the team leader for the 1st episode, since Gibbs isn't really taking any control at all until he's at HQ toward the end after the cabin exploded, and then they're headed to meet up with Ziva. The 2nd episode, I'd have to agree with you completely, I'm not sure that it counts. Since Gibbs is technically back, and though he kinda bemusedly allows Tony to be the leader, Gibbs really is the one in charge and leading the investigation.
