It's confusing, but this witness was not the defendant at this point in the story. Note that his stepdaughter was sitting with her attorney at the defendant's table. Note also that McCoy asked the judge to treat him as a hostile witness. If this was a defense witness, he would have already been a hostile witness, and McCoy's request would have made no sense at all. Therefore the witness was called by the prosecution. McCoy did suspect Mr. Martel of being the true perpetrator, and he used this prosecution to "convince" Maggie to tell the truth. I don't know if this is legal in New York, but I'm sure the bar association would rather the ADA to not prosecute a witness to try to compel testimony (McCoy's boss, Schiff, said that if this failed, McCoy would probably be disbarred).

That's a big difference. He charged her with a crime he didn't think she committed based on the evidence, primarily to obtain her cooperation in sending her lover to prison for murder.
May I point out that these shows are the product of a paid writer? It is fiction produced under time restraints. Expecting real world actions is antithetical to most created works. Characters only behave as their authors imagine they ought. Seems a futile question to me.
