    I don't think that anyone has ever really challenged these letters in a court? If I had wealth enough to make a challenge against this obvious threatening, intimidating, disgusting letters I would!

      Actually, there have been cases in the past where people sued and won compensation. A tiny fraction do it, and you have to collect all the letters, but it has been done.
      Whether I would encourage someone to do that is another matter. Legal action tends to be long winded, stressful and costly. The compensation is not necessarily great either.

      Yes, I have seen this. In a nutshell, you tell TV licencing that you don't need a licence and you warn them that any future correspondence will be invoiced. They basically copied a guy called Richard Herman who forced a telemarketing company to pay him money for dealing with their unwanted calls after he had repeatedly warned them. It sounds like a pain, but if you have enough time on your hands it would be satisfying to win, even if it was for about £100.

      Yes, for me, the phrase, "they will interview you under caution" crosses a line. For years, Capita have come close to this line but this phrase is not only intimidatory (a standard Capita ploy), it claims for themselves a power they do not have. If I thought they would do anything about it, I would report this letter to the authorities.

    When somebody knocks on my door I usually look/ask through the window to see/know who it is: so, yes, the door wouldn't be even opened to them.

      Send them to your MP and complain about anxiety stress from harassment, state you told them you don't watch live TV etc. If your MP don't hear about this they think TV licencing is what we want and will vote accordingly in 2027

    Yep I got this exact letter on the 17th of this month (Nov 2022). I have a little bit of joy each time I get a letter as I know it's cost them money to send it and it's a pointless waste of time.

    Five years, one letter a month, 12 Investigations started , 7 visits scheduled , turned up for 1 and that was only because we contacted them saying we don't need a license. Go figure..

    Jon about 60 threatening bullying TV Licence letters from Capita addressed to ‘The Occupier’ arrived on my desk at work, for new residents on a housing estate. They all went straight in the office recycling bin.

    I had a threat - o - gram yesterday in a red envelope, opened it to find it was a Christmas greeting from good old Scott Robson. The threat o gram was then used to satisfy my shredders hunger before then being given to the kid next door for his pet hamsters bedding 😎

    It's an escape thing if they put your name on it and where is menacing as that then you could tell you were being menaced personally it's a bit of a stretch but they probably say that you were inferring the letter is for you, but it doesn't mention you personally, so the only thing you should do with throw it in the bin because a letter to your house isn't for you. A letter has to be addressed to you or nobody which would assume it's for everyone at that address, otherwise you can't really open it, you're not obliged to read any letters sent to your address even if they're in your name. I just bin them.

    Sounds like a very clever crafted letter designed for high pressure and there's even a bit of "good cop bad cop" text in there. Maybe they could be classed as malicious communication.

    What the letters should say regarding the, 'visit from an enforcement officer', is that one of these salespersons will try to coerce you into incriminating yourself by suggesting that you're breaking the law by watching live broadcast television, when you're not. They'll be insistent and use weasel words in order to try and trick you into saying something that they can then use against you in a court of law. As the forgone conclusion of owning a television isn't enough evidence any more, they have to try to push people into admitting that they've watched television as it's broadcast, or having watched shows via the official on-line player. It's the only way they can now secure a conviction, assuming the campaign of threatening letters hasn't already convinced them into paying a licence, just to be on the safe side. Which is the main reason for these letters. It's to make people feel uneasy about using a television when they're not covered by a TV licence. Something that's not longer a prerequisite for owning a television. Watching legally without a licence that can easily be done, nowadays. And there should be absolutely no guilt associated with it, whatsoever.
    The best way to deal with them is not to enter into any kind of correspondence whatsoever. Don't even acknowledge them. And, if they do happen to call round and catch you when you're not expecting them, then just tell them you're not interested and close the door. The best part being that they're powerless to do anything about it. They are, after all, nothing but salespeople trying to flog something you obviously don't need, or want.

      It's always best to not speak to them however friendly they may be. I once heard a tale about someone engaging with them in a seemingly harmless conversation about football who was asked whether they saw the match last night. They said yes. Needless to say, a court summons followed pretty quickly. How true this story is, I don't know, probably not, but it is an example of how talking to them, even in what seems a harmless situation, is not recommended.

    When I was in the armed forces I did an Anti-Interrogation course. We were trained to answer all questions with the statement. "I am sorry sir I cannot answer your question". The answer was designed so that you can't incriminate yourself in any way.

    I’m never paying the licence fee again, after 3 years free of them and a far better life reading books learning how to draw with graphite powder and learning how to paint with watercolour. The best time is in the summer when you have spent the day in the garden drawing and painting a picture while mr & mrs Robin come and see what you are doing pinching the occasional mealworm. Life can be really stress free if you just bin yourself licence!😊😊😊😊😊😊😊 Do it and get your life back, you will be surprised believe me.

    I've reported these harassment letters many times to the police. The amount of nonsense in the replies from these so called law enforcement officers is astonishing: "If you do have a TV you must have a TV licence", "you need to make them aware that you don't need a licence". "Not complying with the above would mean that you could be guilty and
    receive the subsequent fine." "The agency is allowed by law to use threats if they are used to reinforce a demand made by him on reasonable grounds", " you need to speak to the TV Licensing agency directly if you wish for these letters to stop and to prevent any further possible escalation from the agency.". There is so much wrong with what they said, I don't where to begin. But I took their responses to the IOPC and this the reply: " the letters would not be deemed as harassment and therefore the response you received was reasonable and proportionate". Rubbish!

      I agree. The 'under caution' thing is weird, because the Census Officials also carry that line when anyone refuses to complete it, and they come to interview them - but they're representing a government service.
      It needs officially, lawfully nailing down as to who, when and how this kind of thing can be used.

    Hi I could really confuse them. I am a licensed Radio Amateur, and hold a license to transmit TV over the airwaves!! I have not had a TV license for years, and they have now given up, I have no wish to watch the rubbish that is on TV, and I object to paying for watching the commercial tv channels whose infrastructure is paid for by advertising! I do not even listen to the BBC radio, even the flagship Radio 4, which used to be a good source, but no longer. Thanks for your hard work. Jim Ham License M7BXT (for those that are interested!)

    I have received a new letter from tv licensing today. It had a little calendar at the top of the text with 7th December circled in red. It states that an investigation is on hold until that date and if I don't buy one then they will send the goon round. 😅
    I imagine that there is some data protection issue preventing them from addressing their threatening letters by my name instead of 'Legal Occupier' 🤔 I haven't moved address since I stopped paying for the TV Licence.
    These letters are 'guilty until proven innocent' in their nature. ☹️

      They will stop using your name after a couple of years. Do not be afraid of these people. I have not watched tv for 7 years now. I have done nothing illegal. Never had a visit. I get at least 1 letter a month. Don’t open the letters ever

    Ten years ago I removed their implied right of access, told them to remove any and all details pertaining to my address save for a note on their system that they must not make contact of any kind ever again unless instructed to do so by myself, gave them a breakdown of my fee schedule for if they ever do break the conditions, told them that I would accept just one further piece of correspondance from them to confirm that they had received my instructions, that said correspondance would indicate their acknowledgement and warned them that they are legally obligated to comply with the instructions. Haven't heard a dickie bird from them since - no letters, phone calls, visits, nothing.
    Simply removing their implied right of access is not enough, which is the mistake many make. You have to take the fight to them and tell them what they WILL damn well do and not do. Make the sniveling sods squirm. It's no good getting angry on the doorstep, phoning them or trying to tie them in knots through conversation. Only a clearly-worded legal letter, with proof of receipt, stipulating what they must/must not do and what, in detail, will be the concequences of their ignoring your instructions will be good enough. Without that, you leave yourself open to further harrassment.

      I’ve removed everybody’s implied right of access by simply putting a lock on the gate. Nobody can get to the front door and we don’t have a doorbell. We also have a ‘beware of the dog’ sign so no one ever wants to come in anyway (We don’t have a dog)!

    Cancelled my license last year, they send me these letters and they said they will send an enforcement officer around. I dont mind, as far as I'm concerned this all costs them money, I'm not obliged to tell them anything, let them crack on and waste their money.

    I work for a paper merchant, delivering to printers. These letters help drivers like me, the people in our warehouse, the printers, the Royal Mail, the recycling industry, et al. Long may they continue. Thank you TVL for helping to keep so many people in a job! 👍🏻

      It's still wrong. It still costs. Keep up with that kind of attitude and the TV tax will just be added to our council tax, then we'd all be up the same creek, without the same paddle. No need for letters and printers then. I'd be happier if it's just left as it is, letters or not, I don't need a TV licence.

    I've got all my letters filed in chronological order going back for many years. I must have about 50 by now, It's my hobby, I'm a TV goon letter collector. I call the hobby "Goonology" and I'm a "Goonologist". I might stick them in an album. The collection might be worth a lot of money one day lol.

    Why are receiving these letters not seen as a public order offense, i.e causing alarm and distress? Is it because getting a letter in a private dwelling isn't 'public?' If so, why is it not covered by the malicious communications act with the deliberate ingenuity

    Yes say no Thank you, then shut the door?
    If they turn up with the law, Then when they find out you are genuine. It time for you to complain you have been harassed, and ask for compensation. If they do not respond go to the Press?

    I've had one of those with a date on it 11th November 2022. It also said it maybe at an other time including weekends and evenings. So why give me a date they are turning up then add all that rubbish. I've subsequently had a letter saying the property is under investigation. Then a TV goon sat outside my house for ages...total muppets...😂😂😂

    I stopped paying the TV tax. I never had any of these illegally threatening letters like this or a goon visit to my door. I feel cheated.

    i actually went back to them and filled out the form to say i dont need a licence, and i STILL get letters like this so its evident how utterly amazin they are at investigating 😂

    I always get 2 goons coming to my door, 1 rattles my door while 1 stand on my neighbour's drive 😂 when I answer the door 1 shoves his ID up at my face while I'm looking at number 2 trying to look over me and into my living room 😂 bunch of cowboy's 😂 I have a Japanese akita and as soon as he barks I need to go and contain him 😂 also I keep getting these under investigation letter's every 3 months fo 3 year's and no one has came back 😂😂😂😂

    It must cost them hundreds of thousands of pounds sending out these intimidatingl letters
    I have personally received around 7 letters in these past two years
    No other company or organisation would get away with this behaviour

    when i have spoken to people about cancelling the tv licence as i have done myself it always amaze me as to the ignorance of people regarding the tv licence ONE being you need a TV licence if you have a tv I always try to direct them to this channel to learn more.

      The police will only get involved if the goons have a warrant. They can only get a warrant if they have evidence that you are watching or recording live TV or using i player. They can only get the evidence if you tell them or let them into your home. So just saying nothing and close the door, so no evidence hence no warrant, hence no police 👍

      That's true. They're supposed to be impartial and only to prevent a breach of the peace, but I've not only seen them side with TVL, I've seen them threaten to arrest the occupier for obstruction if they don't co-operate.

    Excellent advice and thank you. My experience of this letter was via email (so yes they do know where I live). This is after I went through all the correct online procedure to cancel my TV licence a few months ago, because I no longer watch anything that requires the licence. So it appears they just assume people will still watch the "forbidden fruit", and begin this campaign to scare us into getting a licence again. Needless to say that won't be happening. I might think of blocking further emails from them, but then it is a source of entertainment as well. Keep up the great work!

    The licensing folk have no power, they try to dress to scare you and use entrapment techniques as part of their job. I would strongly suggest you buy a Ring doorbell or similar and that will show you what they are like. I think for vulnerable folk they would be a great thing to have so you don’t feel unsafe. It’s up to each of us to ensure these unwanted salesmen don’t get their commission at our expense, use a door chain for security and get used to having it on all the time. If you get an unexpected door knocker ask who they are and politely but firmly say “ no thank you”. If by miracle the licensing folk come a knocking just politely say “ no thank you” and close the door, they will have to leave empty handed and without their commission. There’s more of us than there is of them and they don’t like it up them as the old guy used to say in Dads Army.

    They keep promising to come to my house and do and investigate my TV, but they just let me down over and over. It's so sad because I really, really, want to say to them, "Are, you're a door-to-door salesman working for Capita. No thank you", and close the door in their face. If they ever turn up, I'll send you the vid.

    Had loads of letters from them, I was always at work !
    One day I answered the door to this guy who said he was television licensing
    Followed your good advice and informed him I don’t watch mainstream tv .
    The guy was a reasonable man , didn’t force the issue . Said he would knock me off the system !

    I am shocked they are now sending enforcement letters addressed to "The Occupier" how do they know someone is living there? What if the house is abandoned and there are rats, will the TV license try and make the rats pay?

    How many times do the public get charged 'Administration Fees' by companies for dealing with correspondences? I wonder if it would be possible to bill Crapita a £5 administration fee for each letter that comes through our doors.
    Maybe that would cut down on the amount of threat mail they send out each year.

      I read somewhere that a guy invoiced TV licencing for the time he had to spend filing all their letters, and for the folders and other stationary he had had to use in doing so. It went to court, he won, and TVL had to pay his invoice, plus court fees. Whether it's true or not I don't know.

    This is sickening!! If I have an untaxed vehicle on my drive I complete a SORN declaration and don't use the car on the public highway. DVLA don't send letters or goons to check me out or accuse me of lying. Who do these people think they are?? Just because I have a TV, doesn't mean I use it??

    Please don't waste your letters by throwing them away. Forward each and every one to your local MP asking why their Government permit the BBC to send you threatening letters for services you don't use and didn't request. Explain how anxious they make you feel and its impacting your daily life - ham it up. Flood your MP with these letters, as they wont have seen them as the tax payer picks up their licence.
