  • The plaintiff says he bought a 2008 BMW from the defendant with 98,000 miles on it, but when the DMV ran the VIN number, it came up with 236,000 miles. He claims he was ripped off and wants his money back. The defendant says he sold the car as TMU - true mileage unknown. He’s countersuing for the balance due.

      He definitely did roll back the miles him self or knew what the original miles were because he ran a car fax before he bought the vehicle. No used car dealer would purchase a car beforehand without that b/c they need to know what they are getting and what are potential profits. He uses this tmu as a loophole probably many times. I wish the judge would have pressed him harder on that but she could only go by the law.

      That makes the judge not only stupid but unprofessional and lacking in morals and a strict code of ethics. She’s not holding up her sworn duty as a judge to rule impartially and not based off personal feelings, attitudes, or bias. She’s suppose to act in a disinterested manner, that’s neutral and favors neither party. She shouldn’t rule against him just bc she doesn’t like him or he’s disrespectful, mouthy, angry, or rude to her. She’s not only being immature and petty in this case but also violating her sworn oath as a judge

      @@phill8395 if you get attitude with the judge and their court, you can be held in contempt. if you disrespect the judge, you're disrespecting the law. and if you disrespect the law, how do you expect the law to protect you? that's the whole point of being in a court room. yes, judges look at the facts and come up with judgements but you have to respect them as people too, no matter how awful the situation is.
      the point is to look at the facts and make fair judgements. it's difficult to be fair if you have one of the litigants acting blatantly angry and disrespectful towards the person making that judgement.

    I can say this as someone that worked in the car business for over 20 years, that cluster swap is an IMMEDIATE red flag, like sirens wailing right in your face. What the cluster is is the 'dash' as we see it, not the whole dashboard but your gauges - speedometer, tachometer, odometer, temp guage, fuel guage, , where your warning lights come on, all those things you see when you look at the area where your speed is showing. When you put a different cluster in, it has the mileage reading of the car it's from, NOT the car it's going into, it does not reset to the mileage on the car it's going into. As a car dealer when that defendant saw a cluster change it should have made his spidey senses ping off the charts and find out what the true mileage was. A 'real' dealer would run from a cluster swapped car unless there was a very well documented trail showing what the real mileage is - there is in fact a spot with your owners manuals where a shop can document this and stamp off on it and/or put a sticker under the hood with the mileage information. The fact the defendant didn't and then snuck in a TMU on the title and not the bill of sale suggests he's as slick as they come. Plaintiff is no angel either, forgetting everything to prove his case, trying to talk over the judge and the eye rolls and violin playing. Am sure outside of the courtroom he's a real joy to be around /sarcasm

      Thank you for the great info and the fair assessment here. Everyone seems to be focusing on the angry plaintiff, but if it were their money they’d be angry too. Sounds like the defendant is the kind of used car salesman that gives all of them a bad name.

      @@isthisbetterwell9958Ds Yes, you are partly right! Maybe even totally right if your brand gets the mileage off the ECM and displays it on the dash. From my experience yes, the ECM does store the correct mileage but it doesn't copy over to the dash display if the cluster was changed. It WILL show the correct mileage on a scan tool if you hook up a scan tool and read it. So if the cluster was swapped, the cluster will display one mileage and the ECM will show a different mileage.

      If you listen to the conversation that was taking place at that time between the Judge and the Defendant, the Plaintiff, erroneously, thought he was winning. He didn't realize that he had already lost the case at that point and the Judge's conversation was purely for TV and entertainment purposes.

    That dealer is crooked as hell. Seems to me if u represent a car with X number of miles thru out a transaction that u shouldn't be able to slip in a document at the end that says oh we don't really know if what we presented is accurate... that it shouldn't be allowed. Sounds like fraud.

      Yup, that’s exactly what happens, he hopes the person wouldn’t catch TMU and signs it anyways, very sneaky. He got more money for the car because of the lower mileage and not only was it wrong, it was SUBSTANTIALLY wrong. I did learn from this though, if I purchase a car, run the vin and look at the miles lol

      You can't roll back miles on a 2008 BMW.. it is computerized and cannot be changed in the computer... a dealership cannot change the mileage logged in the computer. If the computer needs to be replaced, the dealership has to get special authorization from the manufacturer to install current software and the mileage is extracted off old computer and put into new one. The cluster was changed at 136K...besides..
      The federal law states that if your car was made before 2010, you're not obliged to disclose the mileage when selling it.

    I believe the plaintiff was misled & misinformed. The problem is he doesn’t keep proper documentation. He doesn’t even have an accurate record of how much he paid. He didn’t do the Carfax before he bought it. He didn’t review the documents after he got the car, even though he had a 30 day warranty. As for the odometer, they changed it, but it’s hard to know whether the people who changed it messed it up or whether the defendant’s dealership did it intentionally. However, it doesn’t matter because the son signed the document saying the “true mileage is unknown”. You have to review every thing you sign & you don’t let someone else sign documentation for you. Then the plaintiff says “I should’ve handled this *my* way” and says proof isn’t required where he’s from! To quote the legendary archeologist, mystery-solver, & investigator Scooby Doo: “Ruh roh!” 😂 The defendant better get a restraining order because that guy seems a little off his rocker. 😂

      I do not believe the plaintiff was intentionally misled. I think the instrument cluster was replaced, and then the car was sold quickly after. Those are the facts. The game theory of why the instrument cluster was not updated with the proper mileage has a plausible explanation, and it could have been nefarious. However, I don't think this was the case, judging by the testimony of the plaintiff and defendant.
      But good point about needing proof to substantiate a claim. As Hitchen's Razor dictates, "Claims presented without evidence can be dismissed without evidence." People should base all their decisions on the deliberation of the facts and consider the evidence when evaluating claims.

      I believe the defendant is a crook. The issue is the average person might not know a cluster change just before selling a car would roil back the odometer but this is his business so he absolutely knows the significance. He also knew the son was naive he probably talked the son up while he was there and had him sign the release without paying proper attention.I wonder how many of his cars have mileage discrepancies if an audit is done on his car sales.

    People REALLY need to stop buying cars from shady little cornerstore dealerships like this. Personally, I fully believe that the defendant knew EXACTLY what was going on. He KNEW that the mileage had been rolled back. This is a popular tactic with these types of establishments. Unfortunately the plaintiff shot himself in the foot with his anger issues and lack of evidence. I'll never understand why people turn up to court with no evidence. It's like they expect the defendant to provide the proof on their behalf. 😩

    I was on a long People's Court kick back when it was just bootlegs from tv posted on UA-cam, so what a nice surprise that I have a huge backlog of perfectly edited episodes from the official channel to binge now that I'm back on another kick.     I'm a mechanic. On a lot of cars if you change the instrument cluster with a used unit it will show the mileage from whatever car it was taken out of. Some cars have the mileage stored in the ECM and can be accessed with a scan tool. A reputable repair shop will either have the right mileage reprogrammed into the replacement cluster or will put a disclaimer right on it by etching it.

    This plaintiff is still incensed in court. I can see being angry earlier, when he learned of the discrepancy and for a while thereafter, but coming into court still angry years later makes me wonder what his view of life is and how he spends his days.

    People REALLY should run their own Carfax. I wouldn't rely on the dealer.
    I was on the other side of this. I was trying to install white face gauges on a car and broke the needles. My mileage was like 215,xxx. I bought another cluster with about 93,xxx. I traded it in and told the dealer what the mileage really was. On the paperwork it said 93,xxx. Before I signed, I pointed it out again and the dealership said something to the effect of:. We can only go by what the cluster says. It was an older car that they sold off, but still. And, this was a reputable dealership.

    After watching this case, all I have to say is this: black and white speak louder than words. I feel it for the plaintiff. In cases like this, he should have hired an attorney before driving down this highway to no result.
    An attorney would have been able to help the plaintiff investigate the case, collect proper documentation before filing a lawsuit.

      A lawyer wouldnt have helped asI don't think proper documentation was the issue for his claim. His son signed the paper stating he knew the mileage wasnt accurate. Paperwork was an issue on his defense however since he couldn't prove he paid the remaining amount

    Something I think missed in this case is if the car was sold with a sales price based on 98k miles and in fact was more then double that the sales price would have been much lower thus he has really overpaid for the car.

    It wasn't rolled back, you can't roll back a odometer, the dealer said the instrument cluster was replaced, probably to repair a Guage or warning light that wasn't working.
    Some (most) inst. Clusters are programmable but only at the dealership, since the true mileage is know,..bmw might be able to flash program the odometer chip.
    There was no on purpose deception on the part of the used car dealership, HOWEVER it should have been explained in a way that ALL parties involved understud the issue.

      My temperature gauge was not working and had to replace the cluster panel. I bought one off ebay and had it installed. The mechanic didn't change the mileage to what my old panel said. So my car reads less than it should.

      I totally agree it should have been explained better. All the defendant needed to say was "The instrument cluster was replaced with a used one. In most cases the odometer mileage is stored by the instrument cluster, not somewhere else in the car. A used instrument cluster will show the mileage of the car it was removed from, not the one it is installed in." Too often people who are in a business where this is common knowledge forget that other people don't understand how it works, or even saying "the cluster" isn't as clear as saying "the instrument cluster." There was a point I was really afraid the defendant might lose his case because he never clearly explained it and the judge didn't understand. She kept saying and likely still believes someone intentionally rolled back the mileage.

      my husband blew an engine in my little sports car. we elected to replace it with one from a junkyard. it had less miles on it than the blown engine. my odomoter replects the mileage of the old engine. It could have easily been an engine with more miles and still the title woild be correct. this was an interesting case

    I am a dealer in Ontario, Canada, and by law we must disclose material facts that would alter the potential customer's opinion of the vehicle in a very detailed manner. If the cluster has been replaced, it must be reported to the customer and they must sign a statement on the bill of sale attesting to that. I don't know what the rules are in the plaintiff's jurisdiction, but he got duped and it's no wonder he is fuming mad. The dealer must research the vehicle's facts before sale. The defendant shuffling all that paperwork around made him look shady also..

    Did anyone catch him making a veil threat at 10;37 "I should have taken care of this my way!" Question is, what is his way? As for the case, I love Judge Milian but i feel she missed the mark on this one. I feel strongly that Car Dealership had some knowledge of the car's mileage prior to selling. Why, because it was too easy to research. They fraudulent sold the car with that disclaimer fully knowing it was clearly over 200k...which would have decreased the car's value significantly.

      Nothing fraudulent.. cluster was changed before it made it to the used car lot causing a low reading on the odometer.. the car is a 2008..The federal law states that if your car was made before 2010, you're not obliged to disclose the mileage when selling it and the marked it as true mileage unknown ! The paperwork say current Odometer reading..which was 98K and dealer sold it as unknown true mileage... I buy a lot of cars.. I have a $15 scanner that gives all faults and actual mileage and I do my own car fax, but car fax isn't that good as private repair shops do not file repairs, only dealerships and ins companies report to car fax.... mileage stored in computer can't be changed.

      No, the judge was right. Court deals with evidence and the only thing the plaintiff brought to court was his anger and sense of entitlement. The mileage had been rolled back, but who and when is unclear. The son signed the form clearly saying that the true mileage is unknown. Big mistake.

      @@user-bo1rj2xu2s I have been a mechanic for 35 years.. YOU CANNOT ROLL BACK A 2008 BMW ODOMETER... it is digitally controlled and permentantly logged in computer.. If you understood what is meant wen a cluster is replaced you would know what happened.. A cluster has a new Odometer in it, so when it is installed, the new odometer reads zero. The 2008 BMW has no way to set the visual reading of mileage back to where the old one is... They obviously replaced the cluster at 136K..after hat it was driven for 98K... The guy who sold the car knew the cluster was replaced and only stated the visual Odometer reading is 98,000 but does not know if its true.. He only had the car for 10 days.. when he got it, the odometer read 98K.. Since this was a 2008, he does not have to fid out the actual mileage when he sells it.. If it was 2010 or up, then he would have to get a computer hooked up to read the actual mileage stored in the Electronic Control Module...BUT THERE WAS NOT A ROLLBACK..A CLUSTER WAS REPLACED..IT IS A COMMON THING TO REPLACE FOR MANY REASONS AND IS VERY EXPENSIVE TO DO AND NOBODY HID THE FACT BECAUSE HE HAD THE PAPERWORK SHOWING THE CLUSTER WAS REPLACED.. NOOO WAY TO ROLL IT BACK...LOL

    The look on the plaintiffs face at 15:15 was priceless!!
    I purchased a vehicle that had a fraud issue. Somewhere before I bought it the cluster was opened and the warning lights were covered up! I noticed with a couple days and ended up being able to return it for all my monies back!

    When you replace a gage cluster you have to program it with the mileage. Obviously they intentially shorted the mileage. They only use drills on the old manual odometers.

    I think the defendant absolutely rolled the mileage back and slipped in that disclosure form in a sneaky manner.

      The mileage wasn’t rolled back a new cluster was put in . The new cluster would have the car it was originally in miles
