Who knows, they probably heard his song in a coffee shop one time and it came out in one of their songs. They lost a law suit for copyright infringement. Probably was an unintentional subconscious use of the rather obscure melody, but none the less an infringement.

Hey lets be honest here people a lot of bar tunes were originally hymns then changed to fit the bar and a lot of hymns were bar tunes that were changed to fit the church.
As a composer and church music arranger, I'm obliged to point out that there are only 12 notes and most have been used already. Wather's tune isn't great but it's not that bad. My biggest complaint about it is that it sounds very American and seems out of place, melodically, in an otherwise Old World-sounding service. What bothers me more is when completely secular tunes (like Thaxted or Ode to Joy) by non-religious composers are hijacked. What bothers me even more than that is when people say there can't be rock music in church because it's secular and has a pagan connotation, then proceed to sing a hymn using the tune from Holst's Jupiter. BTW, I personally think rock belongs in church like ketchup belongs on bratwurst.

The only exception I know of is "What Child is This" being set to the tune of "Green Sleeves". However even then "What Child is This" was originally set to its own tune. It's just the "remix" got more popular than the origional due to it being in a famous collection.
How about the last lines of "A Mighty Fortress", "From Heaven Above to Earth I Come," and "Wo Gott Zum Haus"? For that matter, it's not that big a jump to the last line of "Wake, Awake." And I LIKE "He's Risen, He's Risen." Only the first line resembles "Clementine".
I would attend an LCMS church that sings Christmas song to the tune of comet observetory 3 from Mario galaxy or a Catholic church that sings easter songs to the tune of Gusty garden galaxy
