    Its important to note that in the McDonald's coffee lawsuit, the woman who was burned only wanted her medical bills paid, about $40k, and McDonald's refused. The jury was outraged at McDonald's and they added the extra $600k to her settlement.

      The coffee case injuries were brutal and McD's absolutely knew their coffee was maintained at an absurd temp.

      @@cheetabrad If you spill what you know is a hot drink on yourself because you are stupid enough to put it between your legs and take the lid off whilst in a moving vehicle, then it's your fault - 80 degrees celsius is about perfect for a hot drink IMO, anything else and it'll be well cold by the time you finish it.

    There was a lawsuit when a woman bought a RV, left the dealership, and as she was driving down the road, she got up to go to the bathroom and (obviously) crashed. Sued because she was never told you can't do that, and it wasn't in the owners manual. She won!

      Personally I'm glad I live in a country where such frivolous lawsuits aren't possible. The idea of penalising a person or entity for another person or entities idiocy is appalling enough - the idea of then using that money to reward the idiot is even worse.

      I owned the same make of RV, but after this incident, and in the manual the bit about cruise control was VERY clear about not engaging it and leaving the drivers seat! 😂😂😂

    Back in 2015 I had to get the whole cadaver kit because mine was torn up so bad. Dr Collins even had to spend 2hrs extra polishing the bones because my meniscus was destroyed and that can't be replaced. My sciatic nerve hurt me the first time ever for 3 days after the block wore off!!

      @@heiner71 it’s not even close. Diesel was going to block the popularity of forced EVs that’s all. They had to get them off the market in mass production. The last volcano put out more “pollution” in ten seconds than all the diesel CARs and light trucks combined would put out in decades. The climate cultists are insane people.

      We hated giving up our 2011 Golf TDI but the money was just too good. After all said and done we owned it for two years and came out $2000 ahead after figuring in insurance, cost of the car (bought used), maintenance, and fuel! My wife loved that car but it was impossible to turn down what amounted to free use of a car plus $2000.

    I hope that you are recovering from your ACL operation, and l know how you feel about knee injuries.
    I broke my tibia on the RH Side from a car pulling out in front of me whilst on my mc.
    I now have osteoarthritis in my knees, my left due to supporting my weaker right knee over the years.
    Do as the drs say, and not like myself, worked on it for 3 days 18hrs per day....day/night job in the tarmac trade.
    And had a huge haematoma in my thigh to go along with it, it was black from my hip to my kneecap.
    My nephew's thought it was funny, and they swung off it when resting it.
    Be safe and take care of each other, and the character Neelix, was a male character who was in the first series of ST Voyager.

    The $20 Billion BP settlement was only part of the deal; BP had to continue the remediation programs under LSU's guidance, as well as hiring most of the Louisiana fishing fleet to put out floating barriers and transport into and out of the near shore swamps. Their spendometer had topped $68 billion more a couple of years ago. But they are done- Exxon's foot dragging about Prince William Sound in'75 was still fighting payments in 2015 with the relatives of then dead fishermen. Exxon's total costs also led to them getting out of the supertanker business as well as ruining their "Tiger Stores" retailing program- many, many billions more flushed down the fixture. Sometimes avoiding the lawsuit can damage you far more.

    The lift ticket is a contract between you and the resort, and its fine print leaves little grounds for you to bring a lawsuit based on negligence.
    Even if you did not sign a release of liability, it still would be challenging to successfully proceed with a lawsuit because of a legal doctrine known as the “primary assumption of the risk.”
    By engaging in certain sports activities, a person assumes the ordinary and inherent risks of that activity. Football players get tackled, and baseball players sometimes get hit with line drives. It’s part of the sport, and the inherent risks of a sport may even include a participant’s careless behavior.
    In skiing, both natural and unnatural conditions of the terrain as well as the inadvertent collision of skiers have been determined to be inherent risks of the sport. In other words, careless skiers are to be expected when you hit the slopes. But good luck

    As a person who gets a ablation nerve block on both of sides of my neck every year (can only be done once a year) i understand April's pain when they miss the nerve block. It's can be agonizing if they miss which they do once and a while. Lucky for her it goes away once she heals. Mine on the other hand is permanent and will only get worse over time. 7 messed up discs will do that. Cheers!

    I had the exact same thing happen with the nerve block! I agree with the not doing this for any amount of money! I had to get 6 back surgeries and my foot rebuilt also. My ACL surgery was pretty awful though. I still need shoulder surgery and I can't mentally do it. I was obviously in an accident and wish I could go back in time and make it never happen!

    fun fact Mcd case happend in Albuquerque NM, the car was like a Plymouth Duster with a bench seat and no cup holders after handing cup over at drivethrough....the grandmother (passenger) tried to hold cup.between her legs...she squeezed top off of cup and spilled it on seat......Franchise owner refused to pay medical bills ....what is a reasonable person standard? would you put hot coffee...100deg...between your legs?

    Neelix needs a scratching board to sharpen those claws up. Glad April is doing well. When I tore my ACL in 2012 it was about a month before I was walking and another couple weeks I was climbing towers again. No surgery needed I guess I got really lucky. It sucks being the throttle leg, at least it wasn’t the clutch side. I too have had to take care of my better half after a freak accident involving a rusty staple that punctured a bone in her foot leading to amputation of her toe and affected bones. Hopefully Aprils recovery is going well and no other complications arise. My prayers are with you both.

    That tobacco settlement was crappy.....the tobacco industry got away with lying to congress for decades..... and the bulk of the settlement was to be paid from future smoker in the form of higher taxes applied....in essence they got away with paying a small % of the profits they made overall

    Sorry to hear of April's horrible experience with her accident and the surgery. I can very much relate. I won't go into details but you know that 1 to 10 scale hospitals use to help gauge a patient's pain level? I always thought level 10 would be where your screaming uncontrollably, level eight was a large 2nd degree burn I had. I went through level 10 for nearly 2 months after getting sepsis that started in my leg. Morphine only let me nap for 20 minutes.

    Surgery sucks. Trust me on this one. It's better than the alternative, but it still sucks. I've led an active life which invariably amounts in injury. It happens.
    Those first steps after a leg surgery suck. PT sucks. PT can suck worse than the surgery. So, be aware of that. But, you have to work through the PT. You owe it to yourself to have the best recovery possible.

    Sorry April for the ordeal! yeah on not going through that again. Tyler you rule per usual. and FYI if Neelix is not on a episode twice I've turned if off early. lost both my cats recently (no cats in the household now and probally won't ever again cause its too hard to let them cross too the bridge ) and seeing Neelix behavior is a comfort.. Love the Content Tyler and April would like to see more Car topics over the other stuff. preferable. Full Knee recovery April. do it right!

    TIP for April - I do have one tip that might possibly help April, but she should check with her doctor or physical therapist first. I was experiencing severe leg pain even after going through that 2 month ordeal and my PT suggested I try getting into a pool. I did and the pain went away! Unfortunately it came back when I got out of the water.

    I used to stop almost every weekday to eat at McDonalds . Anyway back then the coffee came in a Styrofoam cup. . I would eat inside the place and have to take the coffee to my work to drink not until first break because it was so hot. Now microwaves were not common then but I knew McDonalds had them as I could see them . I was sure they were microwaving the coffee and some how that caused the coffee to remain hot for hours . So hot that it was 3 hours before I could drink it .

    mpg numbers are fluffed. there is a standardized test that doesnt mimick most normal driving. also, the test is done with normal gas. most gas at the gas station has atleast 10% ethanol. Ethanol is a let less energy dense than normal gas. you need to burn more of it to produce the same power as normal gas.

    I have partial ACL and PCL repair not fun!! But in all honesty it was a piece of cake compared to spinal fusion surgery and a double dichotomy and corpectomy lol

    One of the most silly lawsuits was that goof who drove away from a McDonald's drive thru with a cup of hot coffee between her legs. And she won! Got reduced on appeal, but how in any world with thinking people is it McDonald's fault this lady put a cup of coffee between her legs and drove off? That one case alone made me permanently disgusted with humanity.
    Funny how Tyler was praying the SeaWorld thing was Florida.....because he hates Florida I guess....and looked disappointed that it was San Diego.
    As Tyler wins in life, Tyler will win his lawsuit. TYLER WINS!!!

      You do know that the coffee was extremely over temperature? 190 degrees.
      And that McDonald’s had been warned about not serving coffee that hot?
      That the spilled coffee fused her labia together? She had to have skin grafts.
      That she only asked for her medical bills to be paid for? That McDonald’s refused to pay the bills and that is why she sued?

    Had to stop eating when you mentioned cadavers. As someone who once worked at a med school, I got to see lots of cadavers. Actually I didn't intentionally look but there a lot of dead bodies the students operated on. They tear those bodies apart! But I guess since you have a ACL from a dead guy, you know! lol
    Glad you guys are suing the hell out of whoever it is. And the ski resort i hope! Glad you're recovering, April!

    I'm surprised they didn't give you ketamine for the surgery itself. I just had meniscus surgery and they gave me ketamine during/before the surgery. That plus the nerve block made it pain free.

    I’m in the medical field and also had the whole leg pain block myself when I was in the hospital a few years ago. They use the local anesthetic as much as they can now in lieu of pain killers after the whole prescription narcotics/pain killer situation. Before that doctors used to literally give out pain meds like candy. Turned out many hospitals and physicians were getting kickbacks from the drug manufacturers - the more they prescribed the more money they got. You should look up that lawsuit too - that was a big one and it wasn’t that long ago. Maybe 6-7 years ago.

    Hoovie next time ski at Deer Valley or Alta where boards aren't allowed...also don't let students practice on April, if you care. Regarding the lawsuit, you may get NADA if it goes to a jury. When you ski its implied risk I believe.

    I hear ya on that Missed The Spot painkiller shot. I was 8 or 9 and I cut the top of my foot open down to the bone. I was in the emergency room and they had to stitch my foot closed. In preparation for the sewing..they hit several spots around the wound with novocaine so you don't feel the operation. Well...yeah. Either the novocaine needle was empty or the nurse didn't use nearly enough because I felt most of the jabs as the needle went in and then came out and went back in...over and over all the way along the top of my foot. The doctor doing the stitching asked my why I was flinching and I told him I can feel that needle as he was working but he told me it was all in my head. You remember that scene in Rambo: First Blood where Rambo had to sew his own arm closed? Yeah. Exactly like that only the entire length of the top of my foot. April...you're a rock star for going through that!

      I don't understand what is about doctors. I had a head-on collision where my left knee hit the console. After I got out of the hospital (over two hundred stiches in cuts around the left knee), I went for several visits to my doctor and complained of knee pain, but the doctor did nothing, no x-rays or MRI. About eight months later, I took a job transfer from MS (where the accident took place) back to CA. Roughly six months after the transfer, I could not straighten out my left leg and the left knee was very painful. Turns out, my kneecap was fractured in the car accident, healed on its own creating a rough surface that proceeded to cut up the meniscus padding underneath my kneecap. I had to get knee surgery to smooth out the kneecap and repair the meniscus. After successful left knee surgery and three months of intensive physical therapy, I was back to normal. That damn MS doctor should have sent me to an x-ray that would have found the fractured kneecap, but all that doctor would do is tell me to man up. One x-ray would have saved me two years of pain.

    Right now I am being sued because someone stole one of OLD EXPIRED tags and put it on their car and got in a wreck. How is that right? Court date coming this summer.

    Just beware that you may absorb any ailments that the cadaver experienced before death. Even being active and back to my activities a few months after surgery, in very short time I developed high-blood pressure, severe gout in the hands, elbows shoulders and ankles and diastolic heart failure. Oh and have had fully detached retinas in both eyes.
