In my view, yes. Sociology (as I would define it, opinions vary) isn't just concerned with legal effectiveness. And insofar as its aims are scientific rather than jurisprudential, it passes no judgment on what law is desirable or undesirable. I would say Pound's complaint that law should change more is a value position, a jurisprudential claim -- it's not a scientific theory or fact.
