My dad said to me as a 16 year old…(many years ago) it’s not just you on the road….you will encounter others on the road that you have to be prepared for. Only accident I’ve had at 70 is a deer on a dark road. Deer died….i felt so bad. But what’s happened here is so sad.
Navigating in a car is no different than navigating in your life. It's not just you in your life. You'll encounter other people that you have to be prepared for. Other things. And if you ever lose control of your car, ever lose control of yourself, ever lose control of your life or anything in it which has the direct consequence of something being lost... Either it's a shame, or you should be ashamed, and the only difference is if you stopped and/or removed yourself from the situation when you could have or should have, at least long enough to get help in getting and keeping control of what you need to to prevent losses. The crime of road rage isn't what your rage did. It's what not doing anything about your anger issues before then did.

I got rear ended in Florida, the person left the scene.. I called 911, police came and they told me, I should have chased them. I thought I could have been shot or beat up. To this day they have never been caught…

The threat to withdraw the plea was absurd. The prosecutors were not prepared for trial and neither was the defense. The defense dithered, the prosecutor literally sat there saying nothing, and it was a mess.
Love the Judge but he overstepped on this one. I wonder if it would be overturned on appeal based on his investigation beyond what was presented to him.
He didn’t though. Literally was only considering the evidence. Interpretation of the evidence presented and further investigation developing new evidence are two totally different things.

It sucks that 2 young people died but at the end of the day they pretty much did it to themselves and this guy got totally screwed by a judge who didn't want to tell their family that their kids killed themselves.

@@Longhairprettytoes I agree - judges are attacked for not caring enough or recognising the human tragedy of such cases, or they are crucified for showing that they are affected, as Judge Simpson did. Some people may feel he was too emotional, but there's no evidence that clouded his judgement or made him unprofessional. There's certainly no grounds to recuse himself, that is a ridiculous claim.
Unfortunately, when you plead guilty, you normally waive the right to appeal. He could have withdrawn his guilty plea when the court decided not to follow the plea agreement, but a jury trial is always a crapshoot.
Tragic as this was he never should’ve been charged. The girls hit him initially then took off making them at fault and seems this was done more to mollify the parents than anything. Wrong move on Simpson’s part
I love Judge Simpson but I don`t agree with this ruling. One thing juries are always told is not to let emotions factor in a decision. I think Judge Simpson did let his emotions factor in this decision. The girls were driving recklessly when they hit the defendants car and when they left the defendant. There is no evidence the defendant actually caused the crash. I agree this is very sad and if they were my daughter's I would probably feel they were wronged too, but that is why Judges and juries should only make decisions on facts.

It's not that simple. He chased them. If he hadn't, they wouldn't have been continuing to speed and drive recklessly. We also should consider that these were young teenage girls alone in a rural area with an adult male who was chasing them. And he knew that and already had all the information he needed to report them. And where in any of this has anyone mentioned substances on either side?
I agree. The plea deal should have been to not seek the death penalty or if Wi is not a DP state, then the plea should have been eligibility to apply for parole after a 20 year period with no write ups by prison staff.

Yes. He went and got all investigator and prosecutor in the matter. Making it impossible to defend yourself. For the previous actions in court he should have been reported for judicial misconduct. The sentencing is fine except Simpson shouldn't be the one sentencing. He plead and this is within the scope of what he was pleading to. He could have maxed out the guy.
He couldn’t change the charge though, he made that clear to the family. The charge is up to the state prosecutor so he had no say and could only sentence him based on that charge. He was in a tough spot no matter the sentence he made.

I haven't been able to watch all the hearings yet but from what I gather one driver hit the man in the video above, and the driver who hit the man fled and ended up getting killed? Why is the man getting charged?
The girls (who were killed in the rollover accident that the judge was discussing) rear-ended the defendant in an earlier accident and left the scene. The defendant pursued those girls, ostensibly to get their license plate number. The girls were driving recklessly and rolled their truck over at the railroad tracks. (There were also allegations that the “victims” may have been under the influence when the accident occurred.) The defendant pleaded guilty to not stopping at the _first_ accident. The plea agreement did not contemplate jail time, and no one would reasonably expect jail time for leaving the scene of a minor fender-bender that you didn’t cause. The girls’ mothers, who are unable to accept that their daughters caused their own deaths, were unhappy about the plea agreement, because they believe that the defendant caused the second accident by needlessly chasing the girls. They begged the court to launch an independent investigation into the circumstances surrounding the second accident, which the court did. The judge concluded that the defendant had lied about how far away he was from the second accident (which the defendant was not charged with) and therefore chose not to follow the plea agreement. He was prepared to sentence the defendant to significant jail time. The defendant’s attorney objected to the judge’s independent investigation into facts that were irrelevant to the offense that the defendant actually pleaded guilty to, and he threatened to withdraw his client’s guilty plea. The judge delayed the sentencing to give the defendant time to decide whether to withdraw his guilty plea. At this hearing, the judge still decided not to follow the plea agreement, although I get the impression that he did not order as much jail time as he would have ordered at the previous hearing. @@justinphoenix21People leave the scenes of car accidents all the time. That doesn't necessarily equate to a jail sentence. I had a guy cause $7,000 worth of damage to my car during a hit and run on a car repair lot. Luckily he was caught on camera and I went to the police station daily until an officer went to his house to cite him. His insurance company reimbursed mine but he was never prosecuted even though he committed a prosecutable infraction.
I love Judge Simpson but he allowed himself to become impartial due to the mother's statements and their understandable grief. As the defense attorney who had to amend the original agreement with the DA to include jail time, I would've been very tempted to allow Judge Simpson to continue his hearing and then hand down his modified sentence knowing it would most probably overturn at the appellate level. But the client might've spent more than 45 days during that process. It's sad two young women died but it all started and ended by their own actions.
I don’t think he amended the plea. I think the judge accepted the plea but added I higher fine and the jail time. I could be wrong on that but that is how I understood it. Either way I hope the defense can appeal the jail time.

Everyone blaming this man and that is wrong. Those girls made the wrong choice but ultimately a deadly choice. He had no control of that. The judge is way too involved with this case and overstepped.

He, the victim, pursued them as often happens with a hit and run, usually to get their license plate and insurance info. The girls fled, and still drunk and high, crashed a second time and died. The prosecution, realizing that they couldn't hold him responsible for that other accident, decided that they would charge him for leaving the scene of the accident in which he was the victim of a hit and run (which often doesn't happen, because why would the victim stay once the perps have fled??). Well, the judge did his own investigation into the crash that this man isn't on trial for, which is misconduct to even consider evidence not submitted into the case (which couldn't be admitted because this case isn't about that crash). Well judge Simpson decided to refuse sentencing guidelines and sentence him to the maximum possible in order to punish him for the accident that he isn't responsible for and isn't on trial for! Can you imagine being sentenxed to 90 days in jail, 2 years probation, 100 hours of community service, $1,550 in fines, and have to undergo random drug testing and a driving safety course, on the charge that you were a victim of hit and run and left the scene of an accident where the drunk and high perpetrators had already illegally fled? Because that is what happened in this case.
And then what? Do a pit maneuver then citizens arrest? This is an interesting case. I think Judge Simpson was out of line and I also think the defendant should never chased after them. He had her contact info. Just let the cops deal with it.

In no way should he have been allowed to continue being the judge on this case. He got way too involved and that's something you're not allowed to do as a judge. Those girls essentially killed themselves by fleeing at a high rate of speed away from the scene of the accident before he even started following them. They did exchange information and he waved them off then they accelerated and sped away. It was their own reckless driving that caused their death and their family couldn't accept this and pleaded with the judge to fix it the only way they could which was by giving this guy jail time. Which is completely uncalled for. I'm sorry but if I was this guy I'd be having a fit and make an appeal and making my own cases against people. Normally I love this judge but this was beyond unprofessional.

I agree. I've begun to sour on him recently, anyway. I was disappointed to see him in a case, within the past few days, where he was making fun of a litigant and laughing with his staff about that person. It happens sometimes before or after he hears a case, which is troubling enough, but this was in the middle of the proceedings as that person was walking to the stand! It was so disrespectful and gave the appearance that he wasn't going to be giving any weight or serious consideration to that person's testimony at all. I was shocked at how blatant it was.

I disagree with the judge on this one- I don't think that man should spend one day in jail because I don't see him as being responsible for what happened, nor do I think he would ever forget those two girls, jail or no jail. But they didn't flee the scene. They state dropped the ball on this one and just found an easy way to check it off the list to not deal with it...they exchanged info with him and he waved them off and then followed them. As a teen, I'm sure that scared them but he shouldn't be charged with their death as he didn't run them off the road but he could have just did the report and went about his day.

In any event, he was not charged with anything in connection with the second accident, so there are no “victims” in this case, and the mothers’ inability to process their grief should not be held against the defendant.

I think the problem was, maybe the allegation was that the defendant chased them down leading to a high speed chase which killed both girls. The defendant denied this.
This was tragic, but he was first struck by the girl driving who then proceeded to leave the scene at a high rate of speed. The actions of the driving teen caused 2 deaths, not this man. The judge just gave a sympathy to the mothers sentence, not a fair sentence.
The girls did stop at the accident with him. He had their information and it looked as though he waved them on to leave. It was the second accident that killed them due to their speed - the question was whether the defendant's actions contributed to it - and the defendant lied to the judge about his role in it.

@@cindyterry347 It absolutely is a terrible tragedy. I feel awful for them - young lives cut way too short - and their families and friends. That tragedy doesn't mean that someone who had nothing to do the accident should be held responsible for it. Simpson took a tragedy and added another victim to it. That needs to be called out.
I'm not being a smart alec, but maybe you did miss something. Judge Simpson used a satellite map which he displayed in court which was not a part of the trial but was used for sentencing. The judge suspected the defendant's story did not add up and the judge was basing the sentencing on that.
They didn't hit and run. They stopped, photos of license plates were taken. Still, they did get the heck outta there quickly, leaving defendant by himself, and 5 more minutes on the road and voila, a second "accident". How many are they allowed to have before karma kicks in?

It is an absolute offense to justice that this guy has any kind of punishment. The out of control teens caused 100% of this. The mother is a complete disgrace to society to put the blame on an innocent man for the actions of her dead brats.

He just sentenced a man to 45 days in jail to satisfy their grieving mothers even though that man did not cause their deaths. That 45 days can be life ruining. This poor excuse for a judge gets no love from me.
You are unaware of the facts of the case. The victims hit the defendant. They stopped, exchanged information, and defendant waved them along to go. They left. The defendant called the police and said he was chasing them to get their information, which he already had, then slammed into them, as they did to him. Two girls were killed and one survived. Defendant is very lucky that the police and prosecutor dropped the ball on this one, as his original sentence of wreckless was 15+ years.
I do agree that this entire situation was tragic and never should have happened. However, in my opinion, their blood is not on his hands. I would have taken this to trial. Were I investigating this crash, there never would have been a charge to begin with.

Absolutely, this sentence was to appease the families and bears no resemblance to the charges the state brought. Simpson even said so after the defendant walked out "it was the best I could do folks".
I have a ton of respect for Judge Simpson, but I think his handling if this case was inappropriate. He certainly didn’t have to accept the plea, but the prosecution offered the plea because they didn’t think they could prove the other charges.

hm. i'm disappointed. i understand when you've lost someone so suddenly, you want someone to blame. you want to feel justice. you want to be able to say, "that guy did it, and now he's punished. my loved one has been avenged." maybe bringing down the hammer on this guy feels like justice in the moment. that's just the feeling of accomplishment, though, and i think if they search deep within themselves after this feeling has passed, they'll find that this isn't justice. wanting someone to blame doesn't mean that's true, no matter how much anguish you're drowning in. no matter how much you yearn for something to make sense and feel good again. and what's even more painful is that as a human being, _he_ probably feels guilt and shame. we do that. in a traumatic event, a lot of us take on regret: if only i hadn't x, if only i had y. it's irrational, but we're generally pretty empathetic creatures. in a normal situation, that's something he'd be able to work out and let go of in therapy. but then this judge comes forward and says, "good. you _should_ feel guilt and shame. this was your fault." i know firsthand what it's like to have your irrational self loathing inexplicably affirmed. it fucks you up for the rest of your life. you stop dwelling in it eventually, but you never let it go. no one can ever convince you something is all in your head ever again, because when it counted, your irrational human response was affirmed by someone you needed to stand up for you. i think judge simpson is very intelligent and kind, but sometimes i think he gets too attached to cases and oversteps. i think he projected onto these grieving families as a father and wasn't being impartial, which is a crucial part of being a judge. and as a result, he kicked a man when he was down. which the man took with grace, agreeing gently to his sentence and saying he'd pay the exorbitant restitution that day. that guy is going to carry the deaths of those girls on his shoulders and in his gut for the rest of his days. maybe their families are just relieved that they're not alone in that anymore. i don't think they were being fair, but they don't necessarily have to be. they're not judges. i wish them all peace. may the girls' memories be a blessing.
Road rage isn't worth it, and take responsibility for your actions if you hit someone don't take off. If you have the other person's info, call the police. Easy to say as a 61 year old. Kids panic, but the young driver was reckless. Heartbreaking all around.
Imagine if dui was legal, but if you crash and there is any property damage it's a minimum of 6 months in prison, minor bodily injury minimum of 1 year in prison, major bodily injury minimum of 5 years in prison, and death is a minimum of 25 years.
BS He kowtowed to the girl's family and in doing so violated his responsibilities. The judge made a victim out of a person that had nothing to do with the girl's sad, but foolish choices.
i think with everything this judge has done, from allowing the parents to request an “investigation” from the judge, to the judge doing it, to the judge overstepping and all, the defendant has quite the grounds for an appeal.

My dad said to me as a 16 year old…(many years ago) it’s not just you on the road….you will encounter others on the road that you have to be prepared for. Only accident I’ve had at 70 is a deer on a dark road. Deer died….i felt so bad. But what’s happened here is so sad.

Navigating in a car is no different than navigating in your life. It's not just you in your life. You'll encounter other people that you have to be prepared for. Other things. And if you ever lose control of your car, ever lose control of yourself, ever lose control of your life or anything in it which has the direct consequence of something being lost... Either it's a shame, or you should be ashamed, and the only difference is if you stopped and/or removed yourself from the situation when you could have or should have, at least long enough to get help in getting and keeping control of what you need to to prevent losses. The crime of road rage isn't what your rage did. It's what not doing anything about your anger issues before then did.

The threat to withdraw the plea was absurd. The prosecutors were not prepared for trial and neither was the defense. The defense dithered, the prosecutor literally sat there saying nothing, and it was a mess.

Some people may feel he was too emotional, but there's no evidence that clouded his judgement or made him unprofessional. There's certainly no grounds to recuse himself, that is a ridiculous claim.

Unfortunately, when you plead guilty, you normally waive the right to appeal. He could have withdrawn his guilty plea when the court decided not to follow the plea agreement, but a jury trial is always a crapshoot.

I love Judge Simpson but I don`t agree with this ruling. One thing juries are always told is not to let emotions factor in a decision. I think Judge Simpson did let his emotions factor in this decision. The girls were driving recklessly when they hit the defendants car and when they left the defendant. There is no evidence the defendant actually caused the crash. I agree this is very sad and if they were my daughter's I would probably feel they were wronged too, but that is why Judges and juries should only make decisions on facts.

The man was not the fault for the teens death. They ran at high race of speed from the accident.
It was a rediculous case. The teens were under the influence and died as part of commiting a crime however the defendant was punished for this.
It's not that simple. He chased them. If he hadn't, they wouldn't have been continuing to speed and drive recklessly. We also should consider that these were young teenage girls alone in a rural area with an adult male who was chasing them. And he knew that and already had all the information he needed to report them. And where in any of this has anyone mentioned substances on either side?

I usually love Judge Simpson and he’s usually so level headed. But I gotta say I think he got too emotionally involved in this one. That gentleman wasn’t the wasn’t the cause of that fatal accident. And with the judge apologizing to the victims family that he couldn’t do more is a big indication of bias, IMO.

The girls (who were killed in the rollover accident that the judge was discussing) rear-ended the defendant in an earlier accident and left the scene. The defendant pursued those girls, ostensibly to get their license plate number. The girls were driving recklessly and rolled their truck over at the railroad tracks. (There were also allegations that the “victims” may have been under the influence when the accident occurred.)
The defendant pleaded guilty to not stopping at the _first_ accident. The plea agreement did not contemplate jail time, and no one would reasonably expect jail time for leaving the scene of a minor fender-bender that you didn’t cause.
The girls’ mothers, who are unable to accept that their daughters caused their own deaths, were unhappy about the plea agreement, because they believe that the defendant caused the second accident by needlessly chasing the girls. They begged the court to launch an independent investigation into the circumstances surrounding the second accident, which the court did. The judge concluded that the defendant had lied about how far away he was from the second accident (which the defendant was not charged with) and therefore chose not to follow the plea agreement. He was prepared to sentence the defendant to significant jail time.
The defendant’s attorney objected to the judge’s independent investigation into facts that were irrelevant to the offense that the defendant actually pleaded guilty to, and he threatened to withdraw his client’s guilty plea. The judge delayed the sentencing to give the defendant time to decide whether to withdraw his guilty plea.
At this hearing, the judge still decided not to follow the plea agreement, although I get the impression that he did not order as much jail time as he would have ordered at the previous hearing. I still think the sentence is unduly harsh, given that the only thing he was actually _charged_ with was leaving the scene of the first accident, a fender-bender that the “victims” caused. @@justinphoenix21People leave the scenes of car accidents all the time. That doesn't necessarily equate to a jail sentence. I had a guy cause $7,000 worth of damage to my car during a hit and run on a car repair lot. Luckily he was caught on camera and I went to the police station daily until an officer went to his house to cite him. His insurance company reimbursed mine but he was never prosecuted even though he committed a prosecutable infraction.

I love Judge Simpson but he allowed himself to become impartial due to the mother's statements and their understandable grief.
As the defense attorney who had to amend the original agreement with the DA to include jail time, I would've been very tempted to allow Judge Simpson to continue his hearing and then hand down his modified sentence knowing it would most probably overturn at the appellate level. But the client might've spent more than 45 days during that process.
It's sad two young women died but it all started and ended by their own actions.
I don’t think he amended the plea. I think the judge accepted the plea but added I higher fine and the jail time. I could be wrong on that but that is how I understood it. Either way I hope the defense can appeal the jail time.
@@Mark.E the judge was going to amend the plea as he stated on the record last month. The DA and defense compromised on a new deal Simpson accepted with some jail time.
Everyone blaming this man and that is wrong. Those girls made the wrong choice but ultimately a deadly choice. He had no control of that. The judge is way too involved with this case and overstepped.

The prosecution, realizing that they couldn't hold him responsible for that other accident, decided that they would charge him for leaving the scene of the accident in which he was the victim of a hit and run (which often doesn't happen, because why would the victim stay once the perps have fled??).
Well, the judge did his own investigation into the crash that this man isn't on trial for, which is misconduct to even consider evidence not submitted into the case (which couldn't be admitted because this case isn't about that crash).
Well judge Simpson decided to refuse sentencing guidelines and sentence him to the maximum possible in order to punish him for the accident that he isn't responsible for and isn't on trial for!
Can you imagine being sentenxed to 90 days in jail, 2 years probation, 100 hours of community service, $1,550 in fines, and have to undergo random drug testing and a driving safety course, on the charge that you were a victim of hit and run and left the scene of an accident where the drunk and high perpetrators had already illegally fled? Because that is what happened in this case.

In no way should he have been allowed to continue being the judge on this case. He got way too involved and that's something you're not allowed to do as a judge. Those girls essentially killed themselves by fleeing at a high rate of speed away from the scene of the accident before he even started following them. They did exchange information and he waved them off then they accelerated and sped away. It was their own reckless driving that caused their death and their family couldn't accept this and pleaded with the judge to fix it the only way they could which was by giving this guy jail time. Which is completely uncalled for. I'm sorry but if I was this guy I'd be having a fit and make an appeal and making my own cases against people. Normally I love this judge but this was beyond unprofessional.

I agree. I've begun to sour on him recently, anyway. I was disappointed to see him in a case, within the past few days, where he was making fun of a litigant and laughing with his staff about that person. It happens sometimes before or after he hears a case, which is troubling enough, but this was in the middle of the proceedings as that person was walking to the stand! It was so disrespectful and gave the appearance that he wasn't going to be giving any weight or serious consideration to that person's testimony at all. I was shocked at how blatant it was.

I can live with this decision, but based on the letter of the law, I still think that judge Simpson is overreaching. Now the law allows up to 90 days in jail for this sentence, but he is taking into account some thing that has no bearing on this crime whatsoever.
He walked back a lot of the comments from his previous hearing. If the defendant appeals this will be a huge point for them.

This is a horrible ruling, that is not really based on law, but on the mother's not accepting the choices their daughters made that lead to their death.
Usually, I find Judge Simpson to be a really good judge. But not today. He should have told those mothers to deal with their loss rather than trying to make someone else pay for it.

But they didn't flee the scene. They state dropped the ball on this one and just found an easy way to check it off the list to not deal with it...they exchanged info with him and he waved them off and then followed them. As a teen, I'm sure that scared them but he shouldn't be charged with their death as he didn't run them off the road but he could have just did the report and went about his day.

In any event, he was not charged with anything in connection with the second accident, so there are no “victims” in this case, and the mothers’ inability to process their grief should not be held against the defendant.

@@ericaw7207 part of the problem is that judge wants to sentence him for killing them, even though there was no evidence that their behavior was at all influenced by him following, and even if the connection could be made, legal liability for such was not established.
I think the problem was, maybe the allegation was that the defendant chased them down leading to a high speed chase which killed both girls. The defendant denied this.
This was tragic, but he was first struck by the girl driving who then proceeded to leave the scene at a high rate of speed. The actions of the driving teen caused 2 deaths, not this man. The judge just gave a sympathy to the mothers sentence, not a fair sentence.

The girls did stop at the accident with him. He had their information and it looked as though he waved them on to leave. It was the second accident that killed them due to their speed - the question was whether the defendant's actions contributed to it - and the defendant lied to the judge about his role in it.

I'm not being a smart alec, but maybe you did miss something. Judge Simpson used a satellite map which he displayed in court which was not a part of the trial but was used for sentencing. The judge suspected the defendant's story did not add up and the judge was basing the sentencing on that.
They didn't hit and run. They stopped, photos of license plates were taken. Still, they did get the heck outta there quickly, leaving defendant by himself, and 5 more minutes on the road and voila, a second "accident". How many are they allowed to have before karma kicks in?

I like Judge Simpson but he is wrong on this one. He allowed emotion to cloud his judgement. The simple fact he calls the girls victims shows he isn't being neutral here. He kept saying it was the best he could do and that the girls need to be remembered. They were not victims as he isn't being charged for their deaths. He pled guilty to fleeing the scene of a minor traffic accident. 45 days in jail for that is completely out of line and I think Judge Simpson knows it. He should have recused himself after the last hearing.

As much as I love Judge Simpson, this should not have had jail time. This shouldn't have even been charged. I'm sorry, but a mother always grieves their child. Their grief doesn't change the fact that their daughters made a very poor decision to flee a traffic scene. Really disappointed here.
The mother wants to punish someone so badly because she knows it's her own fault. The girl never should have had a new sports car. She needed a slow 20 year old chevy.

This wasn't even close to road rage. The victim acted reasonably and rationally when the girls ran away after hitting his truck.

You are unaware of the facts of the case.
The victims hit the defendant. They stopped, exchanged information, and defendant waved them along to go. They left. The defendant called the police and said he was chasing them to get their information, which he already had, then slammed into them, as they did to him. Two girls were killed and one survived.
Defendant is very lucky that the police and prosecutor dropped the ball on this one, as his original sentence of wreckless was 15+ years.

I do agree that this entire situation was tragic and never should have happened. However, in my opinion, their blood is not on his hands. I would have taken this to trial. Were I investigating this crash, there never would have been a charge to begin with.

Absolutely, this sentence was to appease the families and bears no resemblance to the charges the state brought. Simpson even said so after the defendant walked out "it was the best I could do folks".
I have a ton of respect for Judge Simpson, but I think his handling if this case was inappropriate. He certainly didn’t have to accept the plea, but the prosecution offered the plea because they didn’t think they could prove the other charges.

I'm still so disappointed in the prosecution for this case. They had a CLEAR route to charge him properly, but they dropped the ball and tied Judge Simpson's hands.
Usually when the prosecution APPEARS to have a clear case, there is something they know that isn't known to the public making them chnage their mind. Not saying I know anything, but there has to be some weaknesses in their case somewhere that they would do this deal.

Appeal is a no brainer
Typically part of the plea agreement is you waive your right to appeal as long as the sentence is within the terms of the appeal.

hm. i'm disappointed.
i understand when you've lost someone so suddenly, you want someone to blame. you want to feel justice. you want to be able to say, "that guy did it, and now he's punished. my loved one has been avenged."
maybe bringing down the hammer on this guy feels like justice in the moment. that's just the feeling of accomplishment, though, and i think if they search deep within themselves after this feeling has passed, they'll find that this isn't justice. wanting someone to blame doesn't mean that's true, no matter how much anguish you're drowning in. no matter how much you yearn for something to make sense and feel good again.
and what's even more painful is that as a human being, _he_ probably feels guilt and shame. we do that. in a traumatic event, a lot of us take on regret: if only i hadn't x, if only i had y. it's irrational, but we're generally pretty empathetic creatures. in a normal situation, that's something he'd be able to work out and let go of in therapy.
but then this judge comes forward and says, "good. you _should_ feel guilt and shame. this was your fault."
i know firsthand what it's like to have your irrational self loathing inexplicably affirmed. it fucks you up for the rest of your life. you stop dwelling in it eventually, but you never let it go. no one can ever convince you something is all in your head ever again, because when it counted, your irrational human response was affirmed by someone you needed to stand up for you. i think judge simpson is very intelligent and kind, but sometimes i think he gets too attached to cases and oversteps. i think he projected onto these grieving families as a father and wasn't being impartial, which is a crucial part of being a judge. and as a result, he kicked a man when he was down. which the man took with grace, agreeing gently to his sentence and saying he'd pay the exorbitant restitution that day.
that guy is going to carry the deaths of those girls on his shoulders and in his gut for the rest of his days. maybe their families are just relieved that they're not alone in that anymore. i don't think they were being fair, but they don't necessarily have to be. they're not judges.
i wish them all peace. may the girls' memories be a blessing.

Road rage isn't worth it, and take responsibility for your actions if you hit someone don't take off. If you have the other person's info, call the police. Easy to say as a 61 year old. Kids panic, but the young driver was reckless. Heartbreaking all around.
The girls DID stop. He waved them off and then decided to chase them. Then the accident happened.

Imagine if dui was legal, but if you crash and there is any property damage it's a minimum of 6 months in prison, minor bodily injury minimum of 1 year in prison, major bodily injury minimum of 5 years in prison, and death is a minimum of 25 years.
Very sad and difficult case. Judge Simpson showed great compassion.

i think with everything this judge has done, from allowing the parents to request an “investigation” from the judge, to the judge doing it, to the judge overstepping and all, the defendant has quite the grounds for an appeal.
