Contractor Liability in Construction Claims

Despite their best intentions, even experienced contractors and trades professionals can find themselves, and their insurers, entangled in a construction liability claim. In some cases, these claims can originate from work completed several years prior.

i have a question though, if the contract is a design build contract, lets say JCT DB 2016, and the contractor over designed something, like he proposed to build foundations with higher thickness than is actually needed (so he can profit from the extra quantities) and after the project was done the employer came to this information. is the contractor liable to the employer for such designs ??
