Just the state making unconstitutional "laws" to extort funds from hardworking individuals.

My associate paid $4000 and got a lawyer from a respected firm. That lawyer put the judge and claimant in their place and prevented all sorts of illegality by the claimant and the judge. Not bad for one day's work and they noted about 10+ points of appeal by the judge's own conduct. A biased judge? There are many ways to expertise other than an undergraduate course in biology or chemistry. As the conversation goes on the judge becomes a little more open to listening to the witness and his qualifications. Good for her. Her decision - right on.
I guess its the realisation that she will have overseen possibly hundreds of cases where the evidence has been wrongly assessed and/or improperly challenged. I think most people would be initially resistant to that.

Love hearing your sidebars! I completed my first year of law school, but never went back for year 2. Marriage & children became my life. Years later, and a Masters in Teaching from USC, and again, family is more important and I cared for my Father for 6 years until he passed. As I watch your youtube channel, and the passion with which you analyze cases, and in this case, litigate cases, I am becoming excited about the law again & actually toying with the idea of going back to law school. And FYI, best line of the proceedings, 'I will not step outside the bounds of the ruling of the Court.' Showing respect for the Court, respect for the judge, and a fierce, steadfast determination to go head to head with the judge to get your expert on the stand! Fantastic!
He’s probably the only person left on earth with any knowledge or interest in that field… I don’t know what he could do to become any better of an expert!

Exactly. Bachelors degrees do not confer expertise. They give broad general background to get in the door for expertise to develop whether via additional academic work or job experience. The prosecution knows this is the exact expert to show what LE did wrong that could introduce doubt. A judge really should not be struggling with this, THEY should have enough experience with DUIs to know what the various types of experts can testify to in a case.
I ABSOLUTELY LOVE LOVE LOVE your court videos, I mean who doesn’t love watching someone “stick it to the man” and you literally stuck it in dry on that Ol’ Battleaxe prosecutor on this case !!!! I have watch all your courtroom videos multiple times and I will watch them again!!!
How long has she been on the bench? I got a ticket in Hardin County in like 2004 and I think she was the judge. The prosecutor was an arrogant douche, sitting on the table while talking to the judge. It was a joke.
How is it even possible that blood samples that have been collected during the time of the test tube recall can be used in court? All DUI blood tests that were done with these faulty test tubes should have their cases dismissed before it even gets to this stage!
That was a fun watch... The way that prosecutor talks sounds so combative and angry.. She got you and the judge and your witness a bit flustered and angry..... Was a verdict reached!?
I do have to say that while I think she was being overly cautious, this wasn't a bad ruling in the end, at least from a layman's perspective. I noted, however, that Dr. Henson stated that he taught medical personnel, and then during one of the sidebars, the judge argued that he hadn't. That was odd to me, and I was waiting for the DUI Guy to ask Dr. Henson whether he specifically taught medical personnel, but he didn't. I found that a bit confusing, but perhaps there was a nuance that I didn't catch that made him not seek to clarify that specific issue? Or perhaps it had to be asked in a different way so as to lay a foundation? Again, layman here. A point of criticism, though: I would like to think that I would never use a word like "feud" with regard to a judge's initial rulings, at least not at that point. Perhaps if it went off the rails, but I don't think it had. Generally, I find it's best to assail ideas, not to attack people, and the DUI Guy seemed to be taking it personally -- and maybe that's a vocational hazard, especially given how many rotten judges he's found himself in front of. But I don't think it'd reached the point where it was anywhere near appropriate to state that the court was "unreasonable" and having a "feud." Of course, I'm backseat driving or armchair quarterbacking here, but I would like to think that, if I had been in his position, I'd have used words like, "I think there's been a misunderstanding" or that I found the court's position "puzzling" and so on. Anyway, very fascinating, and as always, I love your content, Mr. Forman!
I wondered about that too, I think when they sussed it out it explained what happened there. There were 3 portions of the testing that were at issue - collection, analysis and results. He testified that he had trained medical personnel in the collection portion, that's where he was talking about hospital staff taking blood draws that had less stringent Chain of Custody and cross-contamination procedures because for a diagnosis they are less important, but were creating problems in court. He then said that he had not trained medical personnel with respect to analyzing the samples after collection.
Why was she so hung up over him not having a biology degree??? Makes absolutely no sense to me why he would need a degree saying he’s an expert in the “studies of life”… if I was her, I would have been more specific of which degree in biology he would need to have, like the highest degree in phlebotomy, or clinical laboratory sciences. That would be a much better argument, say if he didn’t have anything in those areas. But, biology? Wtf does that have to do with him being an expert in this situation?
I do work as an expert witness. Once you are declared one in a given jurisdiction you are good to go from there on out. First qualifications get more scrutiny.
@@DrJoy-cw7lt I get that, but it felt extremely nitpicky and like I said, what does a degree in biology get him in this situation? And also, again, if they got more specific about the degree, it would be understandable, but I think they were just overly judgmental (lol) over non-important things in his qualifications. I’m not a lawyer or anything like that, but it didn’t seem right to me
Aww damn, the video just stopped? It was good tho, and our dear Jen B, as always, was busier than a beaver building a damn today! Swatting away the trolls like flies! Love Jen B ❤️
A couple of minutes in, He sounds very qualified as far as collecting samples is concerned. But I did not hear anything about actual testing in the lab, experience with doing lab work. I don't work in the lab, but I've had to do training in the lab as part of my military training where I had to train in every part of the hospital, as I worked in field hospitals where I had to do everything in Aeromedical Staging Squadron & Combat Rescue Squadron, I'm a nurse, EMT, & military combat medic, where I understand the importance of actual experience in the lab.
That cross examination was hilarious. “You’ve never worked as lab technician?” “Well I did when i owned one but just for a short period of 3 years before I sold it for a substantial profit” 🤣🤣🤣 “But your not a scientist or even an astronaut ARE YOU?!?!” Felt kinda bad for miss prissy pants prosecutor 🥴
It’s not that bad. At summation you literally just gain all the concessions you can and tell the jury “this is a professional witness, who has regarded what they will say to you each time verbatim.” Jurors see way through expert testimony.
At age 65 it may be too much for me to hope for, but I do hope the Commonweath of Kentucky can one day bring it's courtroom audio/video into the 21st century.
I’m sorry but you smoked her and then blew the smoke in her face! I focused on every word and in many instances beat you to the words you next said. Made me proud of myself! Hahaha
It’s VERY clear that without your continuous fight to rightly declare the specialist on blood and labs, that your client would have gotten an unfair trial. And that’s exactly what this court is used too. But you made it very obvious that the court was being unfair and biased! And that hit a nerve with the judge, she realized she might actually have to rule in the side of the defense…. So proud of you Larry, I’m very impressed!
Even more to the point; the issue at hand were the effect(s) of deviation from established, standardized procedure. Hell, the complete lack of chain of custody record is damning. The common auditor’s refrain that “if isn’t documented it never happened!”rings true not matter the industry/field.
The whole series of objections and bench conferences could have been avoided had it been stipulated that the witness would testify as an expert solely with respect to the collection of blood and the output of the gas chromatogram. The whole point of why Dr. Henson was there was to point out the existence to the jury of the two unknown substances on the gas chromatogram and the non-existent record keeping of the whereabouts of the sample.
After watching Kyle Rittenhouse, and Depp v. Turd, I feel that his $2000 expert witness fee is remarkably reasonable Listening to him I trusted him. I felt he knew what he was talking about, he handled himself well and I think it leaves open reasonable doubt as to the lab process that was used.
I love how hard you were trying to throw the prosecution under the bus right in front of the jury even when you knew it would be objected to. "Sorry Doctor, the prosecution seems to have some confus-"
Oh my goodness. I barely breathed through the courts challenge of your expert. Whew! I think the judge dozed off during the expert’s discussion of his training because she missed some information twice! The ADA was loudly & forcibly interjecting her opinion of the educational requirements of an expert. Are there not standards noted somewhere? Great job keeping your cool - which you always do so well.
I thought the Judge was quite reasonable here. She was just trying to clarify this guy's expertise and setup some parameters as to what he can or can't testify to. You guys are always trying to make this about bias when that simply isn't the case.
I’m an ex police officer and if the chain of possession isnt documented on a key piece of evidence surely that should be inadmissible in court, how did this even reach the courts?😅
What a joke that judge is.. "I will not let you say feud" hahaha omg I can't stop lol. It was similar to a child wanting to take his toy & go home. Even her mannerisms during that was seriously ridiculously funny. 😁😂😆😂
18:35 Prosecutor: "Outside of that 1 week have you ever worked in a laboratory setting?" Dr. Henson: "I have worked in a laboratory setting I started a laboratory and then sold it 3 years later..." Prosecutor: "But you didn't work in the lab is what I'm saying. You didn't run the tests." Dr. Henson: "I did. Yeah, it was me." *crickets 🤣
The first 40 minutes of this is incredibly frustrating! It does seem as though the judge has preference for the prosecutor and the defense is automatically having to fight harder than necessary for equal treatment. You rocked this Larry!!! I’d never seen these videos of you working, just the commentary on the Depp vs Heard case, which was awesome too! I’d totally hire you if I needed a good defense attorney, you don’t hold back and you put your foot down when it comes to legality issues.
DUI Guy, the degree of patience in your argumentation is commendable. No, it's just amazing. The judge's resistance to not admitting this expert witness really shocked me. He was well qualified. But in the end your calm persistence paid off.
As a medical laboratory scientist I know we are those who are correctly trained, qualified and competency assessed to perform blood alcohol analysis in clinical and forensic laboratories.
what difference does the fee the expert is getting the states expert gets paid so the defense should only have expert that come free it is none of her business how much does the city pay her for doing a job of work
What I heard the Judge saying: "I will NOT allow your expert to interfere with our revenue collection and some potential slave labor!" (Yes, when you have to work in jail, it's slave labor. It's in the 13th amendment).
This whole process starts with a cop who gets 6 weeks of training at the police academy and spends most of its time teaching cadets officer safety and how to Taze or shoot citizen.
I would think a thesis on DUI and being an officer himself in the past would be enough for me. Geez who would they consider an expert?? Published and peer reviewed and they want to question him being an expert?
As a forensic scientist, I’m certainly glad my qualifications are not questionable all the way trough graduate school. I’ve spent 20 years in various biology and chemistry labs. After graduate school in biomedical forensic science, I came so close to going to law school, we have an associated well known law school that several of my courses were part of, criminal law I and II, moot court, expert testimony, etc. all done through our law school. I had two letters of recommendations for law school from two of my professors and thought becoming an attorney with an expertise in forensic science would make me unique…at least that’s what my professors thought. They said many attorneys learn about forensics, but few attorney were or are qualified scientists with a long history in forensic science. I decided to forgo law school…I wish I didn’t. In my 40s now. ..sometimes I wonder if it’s too late for law school. :-/ Love these videos!😊
...the problem was the two extra vials the prosecution attorney and her expert could not explain. Also the prosecution attorney doesn't know the spectrum of what certain degrees cover. This lack of knowledge also exists in this judge. The judge in her confusion and lack of knowledge shows, especially in her attempts to asks for specific expert information from the witness. And the prosecutor also has lack of knowledge.
I can understand & appreciate the prosecutor & judges concerns. And trying clarifying what areas he's going to be talking about in the case, as an expert, can clearly be a nightmare.
So originally he said that you use Sodium Oxilate for testing blood for alcohol, this is not correct. We use the Grey Tube with Sodium Flouride, must be kept cool, they cannot cleanse the site with alcohol either. There must be documentation called "chain of custody", as well as the cooling container being sealed properly. Sodium Fluoride is either crystaline clear or white. Inversion is 8 to 10 times.
When the judge is coming back with degrees on the experts, what is the degree of the cop? He has a high school diploma and 6 months training. He can not even sit in a chair!!
First thing...the fact that you move the podium EVERY CASE! In my opinion it gives you the upper hand..at least in the officer testimony. Very impressive arguments and speed and tone changes you make when the witness realizes he has a black eye and is bout to be knocked out. Keep it up bud.

Because it hurts the state🙄🙄🙄🙄

While he has tons of experience with training law enforcement, that doesn't translate to medical experience

This dude is a professional instructor. Why all the questioning? He’s not the suspect
The questions were to establish him as an indisputable expert.
Because the prosecutor and the judge are two sides of the same coin. They have to do the most to assert jurisdiction over man and woman in order to extort money and cause harm under the guise of the justice system when there is no harm caused to the state. Just the state making unconstitutional "laws" to extort funds from hardworking individuals.
Trying to impeach him as an “expert witness” by alleging he lacked the proper credentials and experience in the subject matter he was called to testify about. Obviously Mr. Forman wouldn’t let that happen, hence the super thorough line of questioning to establish his education/experience/training/peer reviews/publications etc etc. 🤓😉👏🏽 He was sooooo well qualified he taught law enforcement/lab clinicians, but that didn’t stop the Prosecution from objecting THREE times. 🙈😂😂😂😂😂😂😂😂😂😂😂 Disgusting bias from the state, especially the JUDGE 🙄

My associate would be in jail if he went in with a no-name $500 lawyer who was just making quick cash on low-risk stuff and clearly a legal whore. My associate paid $4000 and got a lawyer from a respected firm. That lawyer put the judge and claimant in their place and prevented all sorts of illegality by the claimant and the judge. Not bad for one day's work and they noted about 10+ points of appeal by the judge's own conduct. He won on a technicality in state law and that his lawyer would not let the claimant or judge violate the rules of evidence or due process. We speculate the judge told the claimant not to appeal as the judge's own behavior was career-ending.

A biased judge? There are many ways to expertise other than an undergraduate course in biology or chemistry. As the conversation goes on the judge becomes a little more open to listening to the witness and his qualifications. Good for her. Her decision - right on.
No ....her decision was based in her not wanting an appeal court to say what an idiot she was

My degree is in Accounting but I’ve worked zero days in Accounting. I’ve worked in Purchasing/Procurement and Supply Chain for 20+ years. You want me to do your taxes? I wouldn’t. That lady attorney is a real 🍑

@@GenXBitch that's okay though, that's how we learn.

Is it over ?? What was the verdict??? I need more!!!
A background on biology? Wtf is this judge smoking? Biology has nothing to do with blood chemistry lmfao.
Yes, the State didn't want him used & was freaking at straws cause she knew she was screwed in this matter & he's be the one to lower the hammer!
The lack of a chain of custody in and of itself should eliminate the lab results for that sample.
After watching Kyle Rittenhouse, and Depp v. Turd, I feel that his $2000 expert witness fee is remarkably reasonable
Listening to him I trusted him.
The trooper looks like he is sitting in a hot seat. Putting his face in his hands makes me think he realizes he isn't getting this DUI to stick.

Yall think criminal courts are bad. Try being a dad in family court. Love your dedication to your craft Larry.
The witness is so obviously an expert it is ridiculous/silly to keep challenging him.

The first 40 minutes of this is incredibly frustrating! DUI Guy, the degree of patience in your argumentation is commendable. No, it's just amazing. The judge's resistance to not admitting this expert witness really shocked me. He was well qualified. But in the end your calm persistence paid off.
Awesome expert. State lackey was flustered and it showed.
There you have it that expert is a medical professional and NIDA certified
The pause before « …would the court like a copy? » was almost comical
I would think a thesis on DUI and being an officer himself in the past would be enough for me. Geez who would they consider an expert?? Published and peer reviewed and they want to question him being an expert?
and the cop be like “I graduated from six weeks of police training.
Love these videos!😊
...the problem was the two extra vials the prosecution attorney and her expert could not explain.
