I just received 27 months of backpay after the VA ruled in favor from a SMC I had been denied
Question; The VA denied my claim for compensation but I was able to receive medical treatment for my PTSD. I received an OTH 14:25 discharge in 1990. My discharge has been upgraded to Honorable in 2024 and I received a new DD-214. the department of Defense states in my records that any injustice that was put in my records should be adequately addressed. so can I receive back pay since my first intent to file was in 2010.or Do I need to request a review of clear and unstakable error (CUE) to receive back pay?
Sounds like you absolutely can. You can file the CUE claim yourself to the BVA and received that back pay.
I have a similar situation but never filed a claim that was denied. I was discharged in 1990 with an adjustment disorder & personality disorder designation without any assessment. After discharge I was told that I wasn’t eligible for benefits but never explained why. I found out this year I was eligible and I’m now service connected. I’m filing a DD149 to correct my DD214 and request medical retirement & disability backpay. Wish me luck.
Scenario: widow files for DIC (86)and is denied for service connection. Widow reapplies (95) VA denies for service connection but begins to pay survivor pension. The widow thens collects social security (2013) and then survivors pension is stopped and social security is garnished by VA (2015). During the garnishment a claim was filed for DIC again (2023) and now approved for service connected death. What year will the effective date be?….
I filed for Agent Orange disability right around 1967 after discharge from service. It was before the registry was enacted. I was denied a service connection disability because I was told no one knew what symptoms pertained to AO exposure. I filed an appeal and was later told that I had to be 100% disabled to claim AO exposure. I filed a claim before or after the Pact Act. I can’t remember exactly when. It was an appeal that had to do with the denial back around 1967. I found that I can’t find that denial in my service records or health records. Why can’t I locate this claim and denial? Do I need help and assistance? I am 80% disabled but I’m being paid at 100% rate for other service connected disabilities totaling more than 100%
What does it take to show that the v.a. made a clear and unmistakable error so that a claim can be re-opened? Thanks.
if you don't file a disagreement or supplement within 1 year of denial, that particular claim is final. Lets say you wait15 years and then file another claim for the same issue that was denied 15 years ago, if granted the back pay date is not the original date 15 years ago but its the date the new claim was filed.
I got out 06NOV2023 and I filed my claim in the one year window, and the effective date is 07NOV2023 but the pay start date was 01DEC2023. I’m confused why my back pay was not 07NOV23

Any fellow veterans out there that ever had this to happen: I was discharged n 1979 with a service connected disability o 10% n I received disability up to 1982 n then it was denied however after several years o trying to get it back I was reawarded 10% disability for the same service connected disability at 10% am I entitled to retroactive compensation ??
