a lot of artists who release their songs for free, even beats that get used by popular artists then get copyrighted so if you use the same beats or tune you'll get striked, this is a serious problem because I think for a while a lot of the minecraft soundtracks were copyrighted by a rapper who used the tunes in his song and abused the system, this isn't similar to that but if your music is open or free use, someone can claim it for you and thus apply a copyright to every other subsequent use of the song be it prior to the copyright and after, its a horrible thing because it happens to other media as well
Pictures that were released for free get reuploaded to Stock photo network storages and then get copyrighted from there, if they spot you using those images they will instead cause legal troubles from those stock photo groups even if in public domain, not sure if it still happens but watch out for that sort of stuff; it gets finnicky

@@Vincisomething this has 0 to do with UA-cam and is based on the US copyright system. UA-cam was indeed about to get burned down by the music & film industry and was forced to implement the system. Which is not UA-cam judging copyright, but them saying "take it to court"
Legally, they can’t do that. He would fight it in court, because those things are masterpieces, and that company is going to try to sue him when they hit a tough spot.
The main problem is how much of a headache this causes for pewds. Despite the fact that THE copywriter holder uploaded to THEIR OWN channel a company can come in and ABUSE UA-cam’s copyright claim system. When a company claims a video or music, the channel owner has 30 days to appeal it, the company then has 30 days to deny and accept that appeal, then the channel owner gets 30 more days to appeal it again to the same company with the possibility of getting a strike from UA-cam which disables a bunch of features and possibly resulting in a band for the channel. And finally the company gets to wait 30 more days before finally rejecting or accepting the appeal, normally at this point they accept it unless they wanna lawyer up. This just becomes a massive time sink as the company can sit on the response for 60+ days, while pewds would deal with the headache of sending in an appeal every 30 days and not getting to touch the ad-sense rev from that video for 60+ days.
most of this info comes from “totallynotmark” as he’s currently going through something similar in regards to copyright infringement and the abuse of UA-cam’s system.
Not to mention this same headache applies to many other creators that would like to remix or even use the song within current copyright law, and those people won’t have all the resources and knowledge that pewds has to fight back against these companies and probably get bullied out of creating on this platform AND will think it was pewds doing it.
There is a gap between the law and the enforcement of law. Some people use that time or inconvenience to their advantage.
These places know that it's illegal but they also know most people won't go to court to battle it.
Your honor you cant let people steal other peoples music and when they use it the artist loses money dont let this thief vet awah with this judge - but hes him the maker

@@liuzhaoqi2003 I don’t think it’s the law which says that a video becomes stolen property and eligible for a copyright claim just because there were 2 seconds of a song being played in the background or because Pewds sung a scuffed version of Despacito. It’s called exploiting and easy to use mechanic which UA-cam just straight up ignores or refuses to address.
The current system of how copyright claims works on UA-cam is that it makes actively difficult for UA-camrs to fight any claim. Pyrocynical recently made a 7 hour long review of a show called “Utopia” but it was then copyright claimed by a company because it had a few seconds of music in it.

Literally the point of this video was that a video on his channel, of a song he made, was copyright claimed by a company that doesn't own it, on "his behalf." That should never be able to happen.

It is, you cannot represent someone like that for a copyright claim. Even a lawyer, who can file claims for you, would not be the named party of a copyright claim. It would never say "claimed by lawyer on behalf of company/person", only "claimed by company/person"
That said "strong case" is debatable- the damages need quantified before we can say that. Without damages, there is no case.

Same thing that happened with photographer Carol Highsmith with Getty Images, where she was sued for posting her owned photograph which she had donated to the public domain. Because it was public, you can make it your own, and Getty Images did exactly that

Worst part is, there’s no laws against a company claiming photos, songs, or videos in public domain. I remember hearing about a trial involving gettyimages and a random photographer. This random photographer donated 100,000+ pictures to The Library Of Congress to make them public domain for all to use as a gift. Gettyimages found 18,000 of her photos, claimed them as their own, and flagged her for her own photos as a copyright violation. She then sued them in court for $1B and lost because those images were public domain and free to claim by anyone. Apparently its kinda like how anyone can claim/publish pd literature like Shakespear or Dickens. If Shakespeare or dickens tried to copy exactly the penguin publishing house version of their works because they like the covers, penguin would sue them and win too, despite not having a product to publish without the original creator. It’s so backwards and fucked up.

It’s illegal to claim from public domain. You need to purchase that right from the actual owner/creator before it is released in order to legally claim it. It’s still illegal to claim it as your own even if you own something someone else has made in order to sell it for profit. That undergoes fraud and is pretty much illegal everywhere in the world.

This happens to my band Scyla even here in Japan constantly. We have to prep our release a month in advance so I can dispute copyright claims despite my band having made the music, the animations for our songs and writing the lyrics….. it infuriates me.
It also sucks I can’t talk about and introduce brilliant music by creators on my channel. It used to be nice hanging out with your friends and sharing tracks, now you can’t enjoy music together unless you jump through countless hoops.
