The literal rule is meant to be used even if it leads to an absurdity, but the golden rule can be used if the use of the literal rule would lead to an absurdity. Does this mean that the judges can decide how big of an absurdity there would have to be before using the golden rule ?
Judges have discretion to decide what counts as an “absurdity” . So the threshold may vary from judge to judge. This is often a criticism of using anything but the literal rule as it makes the law hard to predict and possibly inconsistent. I hope that helps.
