That being said, I get the feeling this could have been averted if the listing had been clear as to who exactly provides what warranty and who doesn't. Also, when responding to such threats, brevity is the word of the day. No matter how tempting it is to tell someone that they're full of it and should go pound sand, the better response is to redirect them to whatever documentation they have and get your attorney involved sooner rather than later. AKA, please refer to the original listing, and if you have further questions, please direct them to my attorney. Never give someone an opportunity or engage on their level and fuel their emotional decision to pursue you.

The amount of times I’ve been threatened to be sued va actually getting sued is about 1000/1. In fact someone moved out on their own for no reason a week ago. Demanded a full refund and threatened to sue me. I kindly told them to go fornicate themselves
Should have ignored the entire email chain from the start. Lawyers will tell you that the more you say, the likelier you are to say something that can come back to bite you. This is especially true in criminal cases, but applies to any legal proceeding in which you may be, or become, a party to.

A $150K car is not exactly "rich" territory when you can do 144 month leases and the like to make it happen. There is a reason why the average Ferrari has 5+ owners. Most of the people who have them can't really afford them let alone pay to maintain them. They realize pretty quick that it wasn't a good idea when the rent or other bills can't get paid because they own that car.
@CoolHand273 it's almost impossible to get financing on older supercars, and even if you can get it, it's going to be for a short term at a high rate so it can make sense to pay cash. Sometimes it's actually cheaper payment-wise to get a brand new car. Plus a manual conversion would be paid cash.

Girlfriend hires a lawyer and through the lawyer made claims to nearly the entire estate claiming the deceased promised her everything. She had no proof of that and we'd never heard of that from him. We basically told the lawyer and her to Fk off.

I went through something similar in 1984. I owned a new 1982 Datsun 280 Turbo. The turbo failed after the 12-month factory warranty expired. I used a local repair shop and they had the turbo rebuilt. The shop that rebuilt the turbo offered a 12-month warranty on their part. I then sold the car as a used car, and "as is." The guy who bought the car was an attorney. 6 months later the attorney called and wanted me to fix the car as the turbo failed again. He claimed I had offered a warranty on the turbo. The buyer threatens to sue me. I said come to Houston and sue me. In hindsight, I should have never mentioned the part had a part warranty. The words part warranty and selling a used car open the door to buyer confusion. A year later Nissan offered to refund the original buyer(me) any cost associated with turbo failures. I got paid back for the cost of repairing the turbo. The buyer was an ass and I learned to not discuss parts warranties when selling a used car.
You should not have put their warranty in your ad for the car. That muddied the water. And you should not have said anything about their warranty in your email. Heck, you should not have responded to that email without a lawyer telling you what to say.
As a dealer myself, when things get to this point- I mention, when you purchase an item at Goodwill, then use that item for ( 6 mos in your case ) , what would Goodwill say when you bring that item back for " warranty work " ?? I dumb it down for people to understand what is associated with " used " items, " as-is " and warranty items...

I'm not a lawyer, but I've dealt with a few cases/lawyers on "car issues" and the emails you got have ZERO legal meaning. Threatening to sue means nothing, it's just a tactic to see if you'll "cave" and fork over some $$$$$$. Ignoring them was your best course of action.
No lawyer would take on a dealership " as-is " case from a reputable dealership, from the standpoint of the client suing that signed more than once " as-is , no warranty expressed or implied " , furthermore, if that lawyer has the need to take their clients money, then the only person who's making out during that lawsuit is the lawyer. The person trying to sue won't have a leg to stand on, the selling dealership has been through this situation before and has taken the proper measures to avoid and deter future customers who are sue happy. Now, if they bought a 4yr old Toyota Corolla, had it routinely serviced at my dealership, sent me referrals , live local and are really good customers, then, absolutely I'm going to help them out the best possible way to make them happy, but if Mr.Ferrari douche bought an 8yr old , aftermarket manually converted original automatic Ferrari though an online auction platform, that we'll never see again, that beats the snot out of it, miled it up and broke through abuse and expects their entitled douche a** to get reimbursed.... then I suggest they close their eyes and tell me what they see ?? Because that's the dollar amount of reimbursement they'll be getting.... 😂

I would tell them "hey, I'd simply rather not sell it to you then". Grasping at straws these buyers. What part of "AS IS" do you not understand???

Having just getting off the phone with my electrician prier to watching this video about a similar manner with my construction company after ignoring letters and emails from an attorney under retainer. I'm confidant at we are all in the right and also hope both your past customer and ours are satisfied with the money wasted, I mean spent on a persistent council with no results. You did the right thing by ignoring the correspondence. You could have shut him up sooner by giving him your Lawyer's contact info and saying he's authorized to accept service on your behalf.
Dan and Josh, I'm glad ignoring them allowed it to go away. I was going to advise you to respond to the lawyer by offering to "help" them dismiss the case. They had no evidence of fraud or acting as an agent, especially since the warrantee situation was outlined in the bill of sale as well as the typical "as is" clause. Sometimes being nice to a lawyer by making things "simpler" for them can help them get paid for time and move on. In this case, ignoring was better because who knows if the lawyer got paid for his time?!
This buyer & lawyer know they are in the wrong, but have the incredible ability to put all morals and ethics aside to try to scam out some money. Not sure how they sleep at night.
The way I see it if EAG actually did send parts to the repair shop and work with them on troubleshooting I could see how that could be construed as they we're ok to do the work. Now for 3000 usd I would think EAG would want to make the problem go away. As far as NGS I see zero responsiblity with the situation and this EAG is such a nightmare company. Very happy this wound up being squashed because chances are since EAG did send parts to the repair shop they would have been found somewhat liable for the invoice.
The problem is that when you talked about your previous lawsuit, you showed that you were willing to compromise to make it go away. So from now on, every client that wishes to sue you will remember that behavior. What did EAG do wrong here? I get it, they suck - but this seemingly has nothing to do with EAG. The owner went elsewhere and then demanded reimbursement for said repairs. Sometimes, extended warranty companies allow this (as they don't own a repair shop) however this was a bit different as it was a installer warranty. Most likely what happened here is the owner is nowhere near EAG and wanted it to get done quick. Get his cake and eat it too. Who knows.

Next time don't even mention/advertise the warranty in the for sale listing and just say "contact [vendor] for more information on warranty, this car is sold by NGS as-is; that could have avoided all of this.
My curiosity is piqued - is this some sort of grey area? You sold a car as-is (aka no warranty) yet warranty was implied in the sale as simply a passthrough message on behalf of EAG. Does that make the dealership culpable? More of a legal question for any reputable lawyers here. I'm sure the as-is contract superseded anything else here (legally) which covers you but I am curious how far a lawyer could go with something like this.

Responding to that question with anything but "The warranty has nothing to do with NGS...car was sold as-is. Please direct all warranty questions to EAG" (the first time) opened the door for the buyer to think NGS was somehow involved. That's why he eventually asked if NGS would honor the warranty, etc. I know you were trying to be helpful, but that can often be taken advantage of (as I'm sure you know). Further, loss of usefulness is not a cause of action. Loss of use might be but that would only be for a monetary loss. For example if the car is being rented out and it couldn't be because it wasn't roadworthy. It would be funny if it weren't anxiety producing

15:00~ish- Don't ignore emails, even if they are total bullisht, (as in this case). Respond to every email, (generally speaking), and refute their bullisht every chance you get. Conversely, when you don't respond, it lends credibility to the plaintiff in the eyes of the judge. Remember, you can lose a case on appearances, even if you are in the right!. Don't give them this wiggle room! Always fight back!

No lawyer would take on a dealership " as-is " case from a reputable dealership, from the standpoint of the client suing that signed more than once " as-is , no warranty expressed or implied " , furthermore, if that lawyer has the need to take their clients money, then the only person who's making out during that lawsuit is the lawyer. The person trying to sue won't have a leg to stand on, the selling dealership has been through this situation before and has taken the proper measures to avoid and deter future customers who are sue happy.
Now, if they bought a 4yr old Toyota Corolla, had it routinely serviced at my dealership, sent me referrals , live local and are really good customers, then, absolutely I'm going to help them out the best possible way to make them happy, but if Mr.Ferrari douche bought an 8yr old , aftermarket manually converted original automatic Ferrari though an online auction platform, that we'll never see again, that beats the snot out of it, miled it up and broke through abuse and expects their entitled douche a** to get reimbursed.... then I suggest they close their eyes and tell me what they see ?? Because that's the dollar amount of reimbursement they'll be getting.... 😂

@@normalguysupercar I used to always drive the 100% AS IS point across multiple times and in writing in each transaction just so buyer could back out at anytime prior to purchase. I would tell them "hey, I'd simply rather not sell it to you then". Grasping at straws these buyers. What part of "AS IS" do you not understand???

Having just getting off the phone with my electrician prier to watching this video about a similar manner with my construction company after ignoring letters and emails from an attorney under retainer. I'm confidant at we are all in the right and also hope both your past customer and ours are satisfied with the money wasted, I mean spent on a persistent council with no results. Dan and Josh, I'm glad ignoring them allowed it to go away. I was going to advise you to respond to the lawyer by offering to "help" them dismiss the case. They had no evidence of fraud or acting as an agent, especially since the warrantee situation was outlined in the bill of sale as well as the typical "as is" clause. Sometimes being nice to a lawyer by making things "simpler" for them can help them get paid for time and move on. In this case, ignoring was better because who knows if the lawyer got paid for his time?!
They didn't really seem interested in reality so I felt engaging them further would not be of any benefit.
The moral of the story is, don't hire an attorney off of Craigslist.

The way I see it if EAG actually did send parts to the repair shop and work with them on troubleshooting I could see how that could be construed as they we're ok to do the work. Now for 3000 usd I would think EAG would want to make the problem go away. As far as NGS I see zero responsiblity with the situation and this EAG is such a nightmare company. Very happy this wound up being squashed because chances are since EAG did send parts to the repair shop they would have been found somewhat liable for the invoice.

What did EAG do wrong here? I get it, they suck - but this seemingly has nothing to do with EAG. The owner went elsewhere and then demanded reimbursement for said repairs. Sometimes, extended warranty companies allow this (as they don't own a repair shop) however this was a bit different as it was a installer warranty.
Most likely what happened here is the owner is nowhere near EAG and wanted it to get done quick. Get his cake and eat it too. Who knows.

My curiosity is piqued - is this some sort of grey area? You sold a car as-is (aka no warranty) yet warranty was implied in the sale as simply a passthrough message on behalf of EAG. Does that make the dealership culpable? More of a legal question for any reputable lawyers here. I'm sure the as-is contract superseded anything else here (legally) which covers you but I am curious how far a lawyer could go with something like this.

Sorry, Dan, but...first mistake: When the buyer first asked "Was this the understanding of NG Supercars about the warranty, blah blah blah..." Responding to that question with anything but "The warranty has nothing to do with NGS...car was sold as-is. Please direct all warranty questions to EAG" (the first time) opened the door for the buyer to think NGS was somehow involved. That's why he eventually asked if NGS would honor the warranty, etc. I know you were trying to be helpful, but that can often be taken advantage of (as I'm sure you know).
Also, the buyer's lawyer sure is a drama queen...

Sell As-Is and move on to the next, maybe repair F1 pump if needed and move cars along like candy 🍬. 15:40 at this point, I wouldn’t even change the oil in a Ferrari I’m about to flip for profit u less it needed a repair, so new owner can just drive. 15:00~ish- Don't ignore emails, even if they are total bullisht, (as in this case). Respond to every email, (generally speaking), and refute their bullisht every chance you get. Conversely, when you don't respond, it lends credibility to the plaintiff in the eyes of the judge. Remember, you can lose a case on appearances, even if you are in the right!. Don't give them this wiggle room! Always fight back!
