The judges in all of those courts have shamefully dismissed or blocked all cases filed there! It is all but an admission of the extent of complicity of France towards assisting the perpetrators of the genocide to escape from Rwanda and continuing to back the genocide intent of the Habyarimana government. Habyarimana is at times cast as tragic figure, but he does not deserve any sympathy. His government was despotic and infused chiefly by a coterie of northern elites. The state back the Radio des Milles Collines in its incitement of hate against a large section of its citizens. It was just a regime whose elites were just seeking to hold on to the privileges and wealth that they were opportune to have while they remained in power.

Genocide is never possible without the involvement of the state in one form or the other. Without state assets participating, at worst it woukd be an ethnic clash or ethnic riots. When you have state paramilitary forces involved, military grade firearms could just as well be farming tools as one cannot expect civilians to procure and maintain armour, field communication equipment and in some cases air support. A rifle without the rest isnt of much use defense wise.

I've heard testimony from survivors and officials that say the Hutu's were preparing for an invasion by the RPF, which had been assembling on the boarder with ,Congo/Uganda. Once the plane went down, the preparation for war was unleashed, something both the extremist Hutu's and Paul Kagame of the RPF knew would be the case. I fled Rwanda in 94 after my parents died, along with my sister and grandparents. I’ll never go back not even to visit!

I've heard testimony from survivors and officials that say the Hutu's were preparing for an invasion by the RPF, which had been assembling on the boarder with ,Congo/Uganda. Once the plane went down, the preparation for war was unleashed, something both the extremist Hutu's and Paul Kagame of the RPF knew would be the case. It seems that the Hutu's knew they were going to be defeated by the USA/Britain connected and trained Paul Kagame's RPF, and simply spazzed out. There is also conjecture about the breakdown of who killed who: some evidence shows that about 1/3 of those killed were killed by the Hutu massacre's, but that the other 2/3 of the dead were Hutus killed by the Kagame lead RPF when they entered the country. Kagame rejects that analysis, change the official language of the country from french to english, condemn the French report putting forth their evidence, and jails anybody in Rwanda that dares confirm details of that story. If this was a Motion for Summary Judgement to Dismiss the complaint, I would have to say Motion to Dismiss is Denied. The Plaintiffs have stated a probable Cause of Action.
