    Thanks Glenn for your excellent and fair-minded reporting. I don't support either dominant political party in the U.S. -- both gawd awful -- but was disturbed by the wildly excessive sentencing directed at non-violent protestors on Jan. 6th.
    Ironically, the sentencing of these protestors was far more punitive than the Chinese courts were for the leaders of violent protests in the Hong Kong "pro-democracy" riots. Since China is supposedly the "authoritarian" government and the U.S. a "democracy" with First Amendment rights , it was mind-blowing to compare the leniency of China versus the U.S. Federal courts.
    Another irony is that Pelosi and the U.S. Congress were gleefully supportive of the Hong Kong rioters, while condemning Jan. 6th as an attempted coup.

    Using a law to prosecute people that was never designed for that specific purpose is indeed overreach.

    • @SmallSpoonBrigade
      @SmallSpoonBrigade 3 місяці тому

      This is exactly what this law was intended to prevent. These people flooded the capital with the intention of preventing the lawful counting of electoral votes. The court got this wrong and it's time that something be done about it. The justices that vote for this ought to be impeached and removed from office, although that's not going to happen with the GOP having enough votes to prevent that. The next best thing would be to expand and pack the court.
      But, really what this shows is just what a failure Obama was as a President that he didn't lean on RBG to resign and didn't make the GOP pay a price for not confirming his nominees.

    Judges, including Supreme Court Justices Sotomayor, Kagan, and Jackson, have immunity for decisions made in the course of their official duties. DOJ prosecutors have limited immunity, members of Congress have limited immunity, and other officials such as federal, state, and local police and law enforcement officers have limited immunity. Presidents have always had immunity for actions taken in the course of their official duties. By prosecuting President Trump, Democrats forced the Supreme Court to commit to writing the explicit terms of this formerly implicit immunity.

It is, by far, the largest reason federal alphabet agencies were able to write policies to charge unlawful fees (read: taxes), impose restrictions on civil rights and many other infringements on US citizens. It amounts to taxation without representation and bypassing Congress to write laws.

Charging the Jan 6th political prisoners with obstruction is laughable when they purposely orchestrated the event to put congress into an emergency forum so congressmen couldn't object to the certification, and get an automatic 10 day review/recount... Remember, everything they say and do is the opposite of what is good and true, especially in this particular situ.

    It's interesting that the SCOTUS dissenting opinion more or less said that it's absolutely ok to abuse overly broad or vague laws; That those laws should not be restricted to the context of the behavior they are intended to criminalize.
    It's even more interesting that the same justices, in dissenting to the Chevron challenge, hilariously contradicted that exact viewpoint.

      @@richardavery4692 Well thanks for the 2nd grade civics class lesson on the three branches of government. But the fact of the matter is I don't want lawyers and judges deciding on things like water quality, acceptable levels of ground contamination. There already was corporate capture of regulatory agencies. Now they've been given the whole store. Chalk up another victory for Wall Street and defeat for Main Street

    • @richardavery4692
      @richardavery4692 3 місяці тому

      @StinkCabbage wtf? Why would judges be deciding those things? All this decision says is that those amounts must be specified in the legislation itself & not to be set by the agencies themselves. This doesn't take away any power from the Legislative branch of government in any way. It restores it to them. Congress must specify in the legislation what the legal definition of clean water is or it does not exist. That does not mean the courts, or anyone else, can decide for themselves what clean water means. It forces the Legislative branch to do its job.
