      Actually it depends on the judge who hears the petition. I had a verbal altercation over my parking space , with a male tenant, felt threatened and filed a petition for an order. Because the judge felt that there was no immediate threat, the order was denied.

    My father did against my mother. It was completely false. He didnt have evidence. Still was granted. It was later reversed and the judge said in 30 years on the bench, it was the first time he reversed one.
    This does happen and judge Mathis needs to put his ego aside and realise the courts are faulty and not always providing justice

      I have witnessed the same thing. I was the victim. I was falsely accused. I have to provide evidence to prove my innocence. On my time and my dollar. They need to prosecute the Asses that take advantage of the system

      He was incorrect tho. You don't have yo hand any evidence in Ky. All you do is go fill out the application and 30 mins to an hour later they bring it back stamped and signed by the judge. Now if you have evidence on the tenth day for court you get to uphold it.

      I know from personal experience. When I was young and dumb I had a baby with the wrong one. He was abusive in every way. I had evidence and was able to keep it. At the time his mother kept my daughter in the evenings while I worked. I had him banned from my job, my parent's house, my apartment, as well as his own mother's house, bc that's where I dropped off and picked up my child on a weekly basis 5x a week. But they most certainly didn't ask me for evidence. I believe he dismissed her case bc she wanted to continue to correct him. She should have left it alone and got to the part of him destroying her and her daughter's belongings. They need to stay away from each other and co-parent.

A top performing judge needs to be able to listen to both sides without getting sensitive and constantly shutting people down which he is no longer capable of. This is not a rare occurence. He does this to guests constantly if you watch his show. And this is not a "mistake". He said it was true himself so he is aware of it. He just doesnt like to have anyone say anything against him. That's a sign of immaturity.

    I'm from Louisville Kentucky and work with perpetrators of DV and that's EXACTLY how it works here. Judge Mathis was wrong in his judgement this time.

      @@knowbeonekanobe5672 he said that the defendant couldn't just go make up a story and get abs epo w the children and I am saying here in LOUISVILLE which is where they were both from, you CAN indeed go and say whatever you want and they will grant u a temporary epo until the court date, THEN the judge decides if its true or not. Yes it seems ass backwards but that's what we do here in Louisville. Judge mathis said that it's not, the plaintiff tried to explain abs and he dismissed the case. He was wrong for not understanding our family court here in Louisville which is unlike any other family court in the nation. (Google it. 20/20 did an expose on our family court system.)

      Seems like her ego was the issue. After all, she was suing for bleached clothes. Whether she was right or wrong about the order had nothing to do with proving he bleached the clothes. Instead of arguing that point, she should have conceded so that she can prove her case regarding the clothes but she wanted to argue. No judge is going to let you argue with them so... contempt.

Idk but I do know laws from state to state court to court are not all equal because of relativity.

      This broad ain't "right." You sound stupid. You might be able to lie and get an initial order issued. But the lie will fall apart at the court hearing, when you have to prove your lie in order to have the temporary order made permanent. That's what the Judge was telling her.

    Judge Mathis is one of the most emotional judges. A lot of his decisions are based on how HE personally feels and his ego rather than him listening and looking at all evidence. For example, when he finds out someone is/was on drugs they automatically lose in his eyes like his parents or somebody close to him must’ve been on drugs or something and it messed him up because he has deep issues with that. He needs to put his ego and feelings aside in some of these cases.

    The lady knows what she’s talking about. You can literally go down to the court, tell them something happened, and they’ll give you a temp restraining order until the actual court date. He doesn’t know everything. 🙄 this just pissed me off

      @@stayintuneusa962 Research it yourself. It's easier to get an original restraining order than to make it stick come time for the court date.
      Its usually done ex parte but to be on the safe side its granted temporarily until both sides get to plead their case before a judge.
      You just have to be fairly convincing that the supposed perpetrator poses significant threat. That's all you need for the original restraining order. To get it for a year to permanence requires adjudicating this before a judge in court. It is at that time real evidence comes into play.

      I think he was saying that part was true about taking out restraining orders on people but he was saying that the cops or prosecutor or whoever had to deem the child in an unsafe environment for them to also put the child on the protective order not just the adult. I think he was saying that part wasn’t true that you could just go up there and say that for the child

    Judge Mathis wanted to give the win to the Dad. He was depending on the Plaintiff's ignorance off ppos. She however understood how they worked and tried to explain herself.

      Omg yes!!! I went through this same thing someone got an EPO against me and the kids I was fostering. The county has to do an investigation then released the children back to me and said the accusation was unfounded. But they must definitely took the children during the investigation. I knew he was going to side with the man. He pre judged the entire case from the beginning. Acting like he didn't know what she meant when she said he wanted to be a family suddenly but that she was in a relationship 🤦 sometimes I can't stand judge Mathis.

      I think he wanted to side with the guy just because he did right by the kid in the beginning. But that has nothing to do with what happened after. Judges DO give ppos to the person requesting it & will drop it when the other person responds. The reason he got to keep the kid that same day is "possession is 9/10ths of the law". Unless there was something already issued by a court previously, they usually give custody temporarily to the person who comes in with the child.

    Judge, you so wrong for this one. I worked with victims of domestic violence for 13 years, and ANYONE could apply & get a temporary PO & could absolutely add the child to it. The decision was made at the final hearing whether or not it needs to be permanent & if the child(ren) need to be included. I’m telling what I saw & observed for 13 years, not what heard!!

If you file a protective order it is granted immediately until the court date where you have to present evidence in order to KEEP the protective order. Judge never asked her did they allow him to keep the order or was it dismissed. He swear he know the laws from back in the 80s so damn well he had no idea what he was saying. In 1994 they passed the law all orders are immediately granted until the court date. I knew he was gonna side with the guy when he started praising him for being a dad and buying his child clothes 🤦 judge Mathis disgusted me today with this!!!

When your actual date comes, a judge will assess whether or not an actual order will be put in place which lasts no less than a year.     I watched a case of his recently and he was encouraging people not to use protection orders to get back at people. What I got from the video is that it IS easy to get one against anyone. Otherwise, why would he try to discourage people from getting a protection order if they felt they were in danger?? He even said that he didn't want to give anyone any ideas.
    And, I swear he uses the contempt thing just to end cases early. 🤣 When he said, "Don't teach me the law," I knew that she was going to lose. This man's ego. It's a good thing that he's not overseeing any criminal cases.

      @@jasonito23 She was in a relationship and got with him who was also in a relationship. Can't put the blame on a baby because you decided to step outside of your relationship. Should never deprive a child of their other parent because of your wrong doing. I would see if he was a busove towards the child but he wasn't.

    Watching it back a lot of this stems from the judge his inability to listen because she clearly said it was an EPO meaning emergency protective order and he kept saying PPO as in permanent protective order. And he completely ignored the fact that the 10 day window was of course during the waiting period to be in front of a judge. This judgement is just terrible all around...

    I didn’t agree with this one judge! My daughters father filed a order of protection against me for some bs. It’s very easy to go downtown and file a restraining order with no evidence! He didn’t even try to hear her out!

    He let the judge sit there and make his baby mom look like an incompetent mom. And as many of these cases we see she was definitely one of the better moms.

    Even if the judgment was premature, speaking with the judge like that won’t win him over. You’re disrespecting him by trying to teach him something he’s been doing for 30+ years. If you’re able to talk to him like that, I can only imagine how you would talk to the defendant.
    On top of that you got pregnant by him while you were in a relationship. Which put question to your character. Plus your ex is apparently in prison for whatever reason.

    I believed every word that man said!! He tried to call an Uber and she did not want him to leave. Hitting him with phones. No ma’am. Get some self esteem, a good therapist and learn to love yourself first! Jealousy and possessiveness is poison. Sad for that little girl.

    This man infuriates me at times. How he gone dismiss her for contempt when in fact you don’t have to have evidence for a EPO. The law can be so biased, it’s a pretty common thing now and I know someone personally that it happened to… and she no longer has custody of her oldest child cause the father outsmarted her. This is a clear case of old head syndrome. Think they know everything when in fact they don’t!

    She is absolutely right. They will grant a TPO based on someone's statement whether true or false. There is usually no hearing to get both sides until the court date
