We need an urgent discussion on what kind of constitution do we need. The current one is too flawed to enable us to achieve anything meaningful. I have done comparative studies of first world countries - none of them leaped to first class economies using a constitutional model as faulty as ours. We will rotate here, waiting for political saviors and none will be forthcoming.
Now we know that the government can wake up and start raising taxes. Why not introduce a provision in the constitution that the citizen is entitled to their income. That the sum of taxes or statutory deductions should not exceed a quarter of an individual’s earnings. That the state has no moral right to expropriate more than a quarter of a person’s sweat, and toil, knowing most of the money is looted, anyway!
A constitutional change should focus on two other things: first is to eradicate the imperial presidency and introduce proportional representation and a parliamentary system of government. MP seats can be awarded per county or region based solely on population and party list used instead of winner-takes-all constituencies. The party lists should be diverse to comply with the two-thirds gender rule. Party lists mean we won't waste time drawing boundaries, and neither will we have densely populated constituencies like Ruiru, being underrepresented. Plus, CDF can be retained, for as long as it is not MPs running them.
The party or coalition with majority MPs forms government and its leader becomes president. That is how kina Omtatah or Morara can have at least a handful of MPs to push the reform agenda in parliament. They are going nowhere with the current rigged winner-takes-all process.
The second should be on meaningful devolution through provincial governments that have greater autonomy. Merge the counties into 9 provinces, run by Premiers who are the leaders of majority parties in the Provincial Assembly, again elected on proportional representation. Devolve 50% of revenue to the provinces, and give them more autonomy, then abolish the senate. Have municipalities under the provinces, as happens in SA. You will have stopped tribes from fighting for the big seat in Nairobi coz most functions will be devolved.
Why should the COB complain of counties with 300 bank accounts, but lack the power to freeze those accounts and order their closure? Why should the Auditor General be producing beautifully written audit reports showing massive plunder in government, yet she lacks the power to prosecute those criminals. She lacks the power to even write to a bank and order them to freeze an account she suspects is holding stolen public funds? We could correct this mess in a constitution.

A clear sign of a lack of leadership qualities is when all promises hinge on condition when become president. Leadership isn’t about the position-it’s about actions, much like growth in a human being. You don’t wait for the position to transform an individual. If someone genuinely opposes corruption, their actions should already be visible, such as pursuing justice in court. Why wait to become president to start fighting corruption?
