My issue is my neighbor planting tree on property line, his trees are growing all over my yard, my roof, damaged drainage, blocked rainwater from flowing to street, water buildup near my house and backyard.. a whole lot of problems. Does planting trees count as encroachment? Damages to my property is more than 5000, I have verbally talked to him about these issues, he agrees to remove it but has not done since last year

Great question, Dana. Adverse possession and prescriptive easement are very similar but not the same thing. The difference between the two is possession and access. With adverse possession, after a specific amount of time, the one using the property can claim it as their own. Contrastingly, prescriptive easement gives the individual access to the property. They do not own that property but they have access to use it. For example, a piece of property used as a driveway or pathway. I hope that helps and thanks for asking! Half of that land has electrical towers and fencing moving across it. If I am to buy the land but only have the ability to develop on the 2.2 usable acres, does that electric company pay the owner on a lease, does the city get that money; how does that work and am I able to see that on the preliminary title report? You will have to look into common laws that validate the possessor. So, long as they do not abide by those laws they will not possess the land. Whoever has a land at risk of being adversely possessed, then they should seek legal assistance to protect the land.

I am selling my house the garage and carport is on Caltrans property right away, it is been there for 58 years, Caltrans says that they will not give me the new buyer encroachment permit without tearing it down meaning the garage and carport, there is no need for encroachment permit because it would not help because of the terrain and the fact that I already can get it onto the property for 58 years without it, but new buyers are skeptical of all of this, any answers to this

They fighting with code enforcement about needing a survey or we have no rights.
