"State of Emergency": Special Report on California’s Criminalization of Growing Homeless Encampments

  • In a Democracy Now! special report, we look at the rise in homelessness in many major cities across the United States. California has become the poster-child for this economic and humanitarian disaster, with growing encampments in Los Angeles and the Bay Area as more people are forced onto the streets. The state is home to 12% of the country’s population but half of the country’s unsheltered people. As the crisis deepens, so has the criminalization of homelessness, with increasing efforts by city and state officials to crack down on unhoused people occupying public space. President Donald Trump made headlines this month for attacking California’s politicians over the homelessness crisis, threatening to destroy encampments, increase police enforcement and even jail unhoused people. But advocates say California has already employed hostile policies that criminalize homelessness, from laws against unsheltered people sitting on sidewalks to frequent sweeps of the encampments that have popped up on thoroughfares and under freeways across the state’s cities. One of these crackdowns is currently unfolding at a massive Oakland encampment that Democracy Now! visited just a few weeks ago.

    While my fixed income is increased by $20 a month my landlord has increased my rent by $350! I cannot afford it, I have no money to pay for all the requirements to move into a new place (1st, last and security deposit), so you see it really doesn't take much to become homeless in this country. If not for the help from my children I would be homeless at 67 after having worked and paid taxes for over 25 years!

      But the land lords, the property owners, speculators/investors/devilopers are all rubbing their palms together grinning, as rents have TRIPLED AND QUADRUPLED in less than 10 years.... meanwhile the poorest, who have long squeezed out survival by relying on low rent units - are all being told, $1200 for that room now, not 400 anymore, good luck. Oh you and your family built Oakland over decades of culture? That's cool, we're doubling/tripling the land value thoughhhhh .... sooooo lots of plans 'guys', lots of renovations, plenty of single high paid tech workers moving into the area, GOTTA MAKE ROOM.
      This is not so different, from how they have long been displacing natives in the Americas.
      Oh sorry, we created a little market/industry for your little resources 'GUYS'!! Annnnnd now the costs and prices have all rissssen, sssssoooooo....

      If a landlord can get more $$ for their rental, why wouldn’t they? While it may be morally wrong, what’s the suggestion? Rent control? That doesn’t work and there are plenty of examples and data to prove it.
      This is a clear example of government not curbing speculation/developers and not addressing low income housing. subsiding landlords to encourage low income rentals. That includes low cost repairs to rentals and strict enforced guide lines for both renters and landlords. If homes get torn down for expensive apartments, an entire floor should be designated low-income, by laws passed. But they’re not doing it? Why?

      I don't know where you live. I lived in California most of my life and moved to New Mexico 9 years ago. I got on a waiting list for senior housing at a place called Kingdom of the Sun in Deming, New Mexico. It is possible to get a place once one is on the list as soon as 6 months, but may be longer. Moving to New Mexico was the best thing I ever did, and getting on the list to live here where I am now was the second best thing. They have two areas - regular and subsidized. A one-bedroom regular unit is $310 a month including utilities. Subsidized is 1/3 of one's income. And they're really quite nice with lots of trees, even though this is the desert. Moving to a more affordable state or area can be a life-saver.

      If your rent jumped up $350 a month, then that may mean that your monthly rent in the past few years were cheaper. Landlords usually don't increase the rent that much unless they've suddenly learned or someone has suddenly told them that the average rent in their rental property area has gone up dramatically. Which means, while your income only increased $20, businesses near your area have opened up high-paying positions that offer salaries that are enough to accommodate your past rent + $350. When this happens, it means take the money that you have saved from your 25-year career and into an area with lower cost of living (even outside of the U.S). If you've never saved any money more than the equivalent to 1st month, last month, and security deposit.. then it's not a landlord's fault.

    I cried when he said, "It humbles you." because I've felt that before... when you lose everything and everyone you look back and think about all the times you took having a shower for granted and you start seeing things from a completely different point of view. Every single person I thought I could trust betrayed me, one friend of mine even threw away ALL my things when I went out for half an hour. People that know you're in need take advantage and try to control you and if you don't do as youre told there are serious consequences. I'm the type of person who doesn't bow down to people because they think they have power over me.. it wasnt until I had met a good person who was willing to help me out to fully feel human again. But for a while there I was like a walking zombie because I had been so broken down mentally by all that had happened from others who didnt care about my well being... So I started from scratch living out of only one suitcase. It completely humbles you and it makes you mentally stronger and better than you ever thought possible but its probably the toughest lesson when you find out its you against the world.

      @@dennisclark2925 well it started off with my mom dying.. then depression and then getting fired from my job which was done out of male dominant issues.. then my ex at the time did something insane and got me evicted under false accusations and my roommate (instead of fighting the case) sided with the property manager and made me look horrible in front of my lawyers. It was just back to back smearing campaigns left and right and if you knew me personally you would be just as confused as I was cause it really felt like I was being framed or something. Then I went to my old bosses place but he had a heroin chick living with him too and she was nuts and convinced him I bent her hats.. so one day when I left to do some errands they threw all my shit out and didn't allow me to come back. So I was left with a backpack and one friend who didn't have a roof either really... But then suddenly after everything and everyone was gone I felt more free than I had ever felt and I believe that mindset of freedom and not sadness over lost items I slowly began to meet better people and turned my life around. I believe I had a lot of toxicity around me that I needed to clear out so I wasn't stuck in an illusion of love. It's humbled me and I guess I am one of the lucky ones... Not everyone is tho and soon once I'm really ready I want to assist I this homeless crisis we are experiencing. I know what life is like on the other side and it's very difficult to pull yourself out of it especially if you do have addictions or mental problems.

      @@rudystraight1750 I'm in a home with my amazing boyfriend who literally was a blessing. it took me a while to recover and he let me have all the space I needed to heal and now I want to give back. I can't yet because but it's definitely going to happen somehow. I used to judge people that were homeless (out of fear) faced it and got out. homeless people are not all drug addicted thieves (even though theres many who are) but it's also veterans and women just trying to get away from abusive men.. our society needs rehab especially the youth... And the man made fires don't help out much either. Who cares about the 99%? We need to change who we choose to treat with kindness and who we see as snakes.. because I've seen the rich and they are literatly the most evil and sad people ... Backwards world..

    Wow! That's something you see in 3rd World Countries. USA may eventually become a 3rd world country if this continues to expand.
    Anita is right, the City needs to release public land for Tiny Homes as an immediate temporary solution. Otherwise, these encampments will grow and get worse.

One in particular told me that he was happier when he was homeless because he had no rules and he had no bills and he could do anything he wanted to do.     I lost my house to job loss and wells fargo selling my title. Been on housing list for 7 yrs finally got an appointment was promised housing and city worker decided to put my file on hold and put me on another list. Ive been homeless with no alternatives for since 2013 and employment at my age is impossible. All of us need serious help!!! Help!! I live in northern ca. Shame on america for this tragic circumstances.

It actually frustrates and angers me even MORE. Case and point, I don't give a shit if other situations are worse. Mine is still bad, and it affects me greatly, and I have every right to feel the way I feel, and complain about it. Most people don't seem to grasp how shitty my situation is. I can't function. I can't hold a job. I can't save anything. I can't even pay my damn bills. All I'm doing, is going progressively more and more insane with depression, and falling deeper and deeper into debt. I'm a dysfunctional mess. It's killing my damn soul. Nothing ever gets any better. I feel so empty and dead inside. I'm severely depressed and miserable, every fucking day.       It's not a Democrat or Republican issue. It's a human issue. Neither of these parties really give a shit. They both are playing a game, putting on an act and they both are only accountable to their donors. They've left the American people out to dry one too many times. When the crash happened the people suffered. I'm sure some of the rich did, and not all of them are bad people, but the average person paid that price.
      I'd say screw both of the parties. We need people who really are humane, humble and show that they care. The middle class is shrinking; while the rich are getting richer, the poor are getting poorer, and the jobs are becoming more automated. We need to have a overhaul of our government and the people who run it. They can find money for war, but can't come up with funds for programs to help people. Fuck that...

      @@noahbanks9155 Years ago I read a piece in Life magazine about homelessness and a woman with a child who was living in her car, selling off parts of it in order to survive. I'll never forget it. The point of the news article was that most of us are only a health issue, one job loss, one a paycheck away from homelessness.

      Clean food & water, safe shelter, adequate clothing, access to personal hygiene resources like showers and toilets, and healthcare including preventive care should be basic rights. People will still need to work, but now people won’t get caught in this homelessness loop. No one wants to give you a job when you’re homeless, even at entry level jobs like McDonald’s. You can’t help the fact that human beings require food, shelter and places to use the restroom, but people are being jailed for not being able to provide those things for themselves for one reason or another, and it may not even be their fault. Also you definitely aren’t having “fun” being homeless in the summer in my state, you are at extreme risk of heat stroke and death on a regular, ever increasing basis. I used to work at a gym, and some people would try to sign up simply so they could have A/C, a place to shower, and maybe even a safe place to sleep for a while. My bosses refused to sell them memberships or let them use the bathroom, even if they had the money.

      It shouldn't be that perplexing. The money that is allocated for wars become revenue and profit for the suppliers that sell and provide the machines, weapons, and goods for wars. Nobody earns money when you feed the hungry homeless... the food is consumed and you get a thank you and maybe not, then this cycle repeats itself with little monetary gain. It's not necessarily an "American" greed. It's a "Human" natural greed for survival. Even homeless who don't contribute to society but expect free food can be categorized as "Human" greed.

Drugs also are a problem. A lot of the homeless are not interested in working but I believe many would if they could get some job skill training, etc. Just my thoughts.

You run into the same issue in most states - fears of lowering property values for other homeowners, and that's a common fear among Dems and Repubs. If you can find some county that is losing lots of tax revenue due to depopulation there is a lot more room for building outside of the codes for size (etc.), but most places make it hella difficult to impossible (without lots of money and/or friends with influence).

      Nancy Chasteen the elephant in the room that people are tip-toeing around is that 85% of the homeless population is either mentally ill, addicted to drums or both.     Thank you Amy! It’s about time someone covers this.....I’m a Californian and I’ve been without a house and hated for it. It shouldn’t be illegal to have a home which doesn’t have four bedrooms a garage and a big lawn......you can be perfectly neat and clean and law enforcement will still write you tickets just for sleeping in your car.

      i have never understood why a home must be four bedrooms, garage, lawn. never. home is what you feel most comfortable at and all forms of living should be legal, that way it won't be a crime to sleep in a car or form a community regulated tiny home community/ tent/ hammock camping / van homes you name it.

    Me and my boyfriend share a small apartment and the landlord raised rent for the second year in a row. We can't afford 1500/month on minimum wage. Looking to move to a cheaper state. California is pushing the lower class out.

    The only thing that kept me from living on the street while residing there was the fact that I have a small amount of disability income for reasons beyond my control. Thankfully, I was able to have a stay in a homeless shelter for a short period of time before being able to relocate and acquire residence in a different state. It was one of the most heartbreaking things I experienced while residing in California. There is limited resources if any at all for the homeless population and many of the homeless population are punished for things that are beyond their control and the state government has long since been negligent in attempting to create any solutions to help the growing homeless population. The state prosecutes them which creates more of a burden on the system. Along with the added environmental issues, failing infrastructure, over-taxation...the homeless population is an issue that the state government and it's county governments is where the problem originates from and it perpetuates it. It is not a simple fix nor a simple solution. As someone who was lucky to be able to survive situations that are terrifying for anyone to experience and not end up completely on the street, it is bad and I'm told it has gotten worse after I left. I still think of California as home, but I won't be able to return home simply because there is an over-burden and no help and it's unreasonable and criminal to not have the state and county governments help the homeless population that the state and county governments of California created due to negligent state and county government operations.
    California is really a beautiful state and the diversity is fantastic. But the state and county government's priorities are not in line with the citizen's of California and their needs. You can't get blood from a stone but the state and county governments keep squeezing the state's own life blood out....which is and comes from the citizens of California. Those issues also affect the rest of the United States. I miss home. I want to go home but I can't and won't return until there's reform. I can't afford it just like a lot of others who left home. It doesn't make me feel very good. Speaking for myself, I was fortunate in some ways to be able to get a little bit of help. But, it's clear that not everyone there can or does. Home is where the heart is and mine is still broken and it will never be the same living elsewhere as I do now even if I do have a stable roof and a safe place to lay my head....because there's no place like home.

      Fine points, but...i could be misinterpretihg you, but think about what you said...you literally moved out of the state bc of the homeless, people like me, in fact, not bc theres no services for us and the system is overburdened, bc that clearly wpuldnt effect you...seems to me an illustration of NIMBYism, easy to convey "compassion" when people like me are no longer a prob you have to deal w bc you literally escaped across state lines to be further away from us

I was fortunate enough to be able to move away...but, the cost of that is still no different for me. I'm just barely able to get my basic needs met and I know I am always one step away from losing all even now. I'm still affected by my experiences while living in California. I still keep up with what's happening out there. I believe as a Californian you are aware of the pride we share for California. We all have different circumstances. I'm still dealing with mine and trying to manage 2 years later. I have to be grateful for what I experienced then and what I'm experiencing now because it is a direct result even still of my experiences in California. I moved back where I grew up and recall and live, still, every reason I wanted to leave where I'm at now. I was born here, but I cannot claim it as my home. Home is where the heart is and my heart is still in California. I do have a roof over my head and live off of very little means to with multiple health issues that will never go away. I knew I was not going to survive what people like yourself and I live and lived. I know those struggles. I'm still dealing with them internally but even now I know I am always one step away from losing all. I had family here that I claimed they understood and they would help and they kicked me to the curb just like always...and, I'm a disabled person and I don't have a choice in that aspect of life either. I never have.
      California is overburdened and I'm still burdened by it because I want to go home. I've learned that life is precious. It's also humiliating and humbling all at the same time. And, for over 4 decades...no matter where I'm at or why...I just want to go home but you can't heal in the same place that breaks you. For me, it isn't here, and it isn't there. I'm killing myself just to live...I'm still in survival mode...just like you. But, we have to do what we have to do to make it through even just one more day or one more night. I'm forgotten here just as I was out there. Different place, different time, different circumstances...but it's all the same and I'm right back where I started no different than before and no different than in California. I'm suffering just the same and fearful just the same and although my tears are different they flow just the same every single day. Empathy and understanding due to experiences I wouldn't wish on anyone...I might be here where I am physically, but I'm still in California and I'm lost either way. I'm trying to make peace with things because I'm tired of suffering and I need to be able to help and heal myself before anything else.
      So, please don't misunderstand me, Mr. Boess...it's not about you or people like you because I am most certainly one of you no matter where I'm at and I'm always one step away knowing you can't take it with you when you go. Hope is the only thing that lights my way back home. I'm sorry, Mr. Boess. Please be safe and do whatever you can to help even if all you can barely afford to do is speak from the heart in hopes that it helps someone to keep hope and keep moving forward. Even responding to you puts me in the deficit and I've been on the edge of what some consider the great divide and I've looked out over and I can still see it clearly because yes, I'm still suffering and there's no end in sight...but, I'm a survivor. It's what I know. It's what I do. I wish I wasn't. I wish I didn't know. I wish it wasn't what I have to do. But, we do it because we have to. I've never actually had a permanent home. No safety. No security. No stability. I'm no more, no less a burden than I always was treated and perceived. I'm just trying to make peace with it so I can find my way home because I am so lost even still and this all I have left to give. I have to be on my way now. I'm hurting. It's not your fault. I wish you well.

      Just remember you are not alone. Even if we all don't walk the same path, many do endure the same hardships. It's part of life. To test us, see what we are made of. If not for God, I wouldn't be here. The reality of accepting what life hands you, or putting a twist on it, is up to us. You went home. I have too, a few times. It never is what you hope. For some reason, family becomes resentful. They feel guilty is why. They don't like it so they take it out on you. It's their failure, not yours. We need a co-op for disabled and those who are just not able to make it on their own. Like an apt, they would apply. Basis wouldn't be on funds... I don't know why we don't care more. We should.

      Gentrification building is booming in Philthadelphia. You can see the changes in Old City. A whole new class of people that dress the same and unfortunately act the same The Me, Myself, and I. Rent for this type of building has increased buy 25% and more in some case “Ethnic Cleansing at Work Rite Before our Eyes”.

    Oakland is my home town. This story simply breaks my heart. I had to move away years ago as the cost of living just kept rising. I’m in a new State now and folks here are freaking out as property values rise and their children cannot afford to buy a home. They resent Californians coming here, but really, they still don’t have a clue as to how bad things can get. All goes to the highest bidder. I was hoping to spend my last years in beauty and peace but folks are pouring in paving over pastures and hay fields. There is no where to hide from greed and displacement.
