Tony Sylvester (the man Allen murdered) was a 22-year-old electronics technician, the eldest of four siblings. He was planning to propose to his girlfriend.
The two men met for an instant late on July 8 when Sylvester walked out of his bedroom to investigate a noise. He surprised Allen, who was burglarizing the downtown Las Vegas home with another man, looking for a way to get a cocaine fix.
“Tony was in bed” when James Allen broke in, Tony’s mother, Hama Sylvester, later wrote to the Nevada Board of Parole Commissioners. “Without his glasses, he couldn’t even see James Allen, let alone identify him or defend himself.”
Allen shot Tony Sylvester in the face, then fled through a broken window, leaving a strip of his own flesh behind on the jagged glass. His accomplice left through a door; he was never charged in the crime and has since died.
Sylvester died alone. A roommate, returning from work early the next morning, found his body.
“James Allen took away his future,” Hama Sylvester told the Review-Journal in 2006. “He never got married. He never had children. James Allen took away his life.”
Police eventually linked the shooting to Allen, whose blood type matched that of the flesh he left behind. Allen confessed to the crime on videotape. The confession was later thrown out of court on a technicality.

I don't believe in the death penalty for many reasons but I think this man believes he is a victim of the system by the way that he is talking. Being preyed on by older men involved in crime is a way he was taken advantage of. However, he went into the house with a weapon wanting to confront someone and steal from them. For certain mistakes, I don't believe we should be responsible for things we did as teens. Fights/assaults happen, stealing happens, drug use happens, making bad choices happens. However, a person's life was lost and its his fault. It wasn't an accident he shot a weapon. He said he couldn't see. Then said that he knew the man had a gun. How? What a liar. Even as a teen, you know that it's wrong. This interview just seems like him making excuses and him asking why he was the only young person to receive the death penalty. The justice system is corrupt. But, they are 100% sure he committed this crime. He is free and wrote a book about this and is making money from a murder he committed. An innocent person died. I don't believe he deserves the death penalty, but I believe he should spend his life in prison. He keeps talking about his mother as if what she feels and believes is fact. Shes biased. Its her child. Of course she doesnt want her child in prison or executed. He speaks of her as if shes a hero. But, I disagree. I think she acted out of selfishness and not wanting her son to face the consequences of his own actions. What if it was her son murdered? She would be fighting for life in prison or the dealth penalty too. He even talked about the older man who influenced them and was part of the murder saying "may he rest in peace". That shows how screwed up his perspective is. He doesn't deserve to rest in peace. Absolutely disgusting. He is a narcissist talking about all his accomplishments. This guy is not sorry at all. I cannot believe he had the audacity to speak for the victim saying the victim would want him to have a second chance. That is so sick in the head. You don't get to speak for a guy you killed just to make yourself feel better. What a despicable human being. He doesn't deserve a voice on this podcast. I love Steve-O, but I am really disappointed that he used his platform for this. There are many wrongfully convicted and released people he could have contacted.
Like any "Criminal" that was charged with marijuana crimes that are now legal in the state but still being held until end of sentence. Naw, this strong man right here. He's got a book about killing someone and getting away with it with out serious consequences. Just like Brittany griner. Felony drug smuggling into other countries and USA gives no repercussions towards her.
Not disagreeing with you by any means on this guys character BUT we do deserve to see ALL stories even if this guy isn’t a good example. He’s still out among us. I don’t think Steveo deserves the criticism

Justice is served on an individual platter, not an average of the whole.
He literally said, i see him every morning, say a prayer for him, leared a little about him and i think he would say give me another chance. You can think what someone might say to you, you do it everyday to almost every one you know or meet. I would imagine after 40+ years in jail he has thought about his victim and their family quite a bit. Sulking and never moving on is not going to do anything, it may seem more respectful but you should really think about how many high level gov officials moved everything to get him out, how he is going to school and stopping kids just like he used to be from making the same mistakes. You really have no idea how many lifes this guy has potentially saved and you definitely have no clue what his victim would say to him, at least he might have some idea of who the man was and is doing everything he can to better these forgotten areas of America where he was raised. I even tell my nephews, who are in the 99 percentile of intelligence in their schools and have straight A's, they are dumb. They might be smart compared to other dumb as fuck teens, but still dumb as fuck, by design. For example, compare a school test from the 1950s to a test today. In the 1950s, a kid in 3rd grade was taking tests that college adults would have trouble passing today.

This is a tough one for me. He says, it was pitch black so I just fired. But right before that he said the home owner had gun. How did he see that in pitch black? Guess the details don’t matter here… anymore.

How is he able to talk about how he killed a man who was just sleeping in his home like it's just another day?? And I have to say I cringed when he said he thought he'd say give him another chance! You took his chance at anything so why would he want to give you a second?!
Yes. It is fucked up. And its a very bold thing for him to say that he thinks his victim would want people to give him a chance. Its easy to write him off. Its hard to forgive. Forgiveness is work. You can tell he is able to talk about it because he has also put in the work on his end.
If you watched the whole thing, you hear him clearly take responsibility for his horrible actions and more than once acknowledge that nobody should ever take life. He seems to also understand the difference between wanted criminal acts/ reckless violence and those who might have strayed off the wrong path and found themselves on the aggressive side of a gun.
I'm also conflicted watching this. You invade someone's home and then murder them? Shit. Sounds evil enough. But there's a point where we need to begin to break things down and inspect on a case by case basis. Yes he was breaking and entering in order to make a quick buck. But he clearly did not intend to kill anyone. The home owner, rightfully so, grabbed his gun in defense and its at this moment that James "didn't give him a chance" as he himself didn't want to get shot/ die. This should open you up to a viewpoint of empathy.
Again its easy to hate. Its empathy and forgiveness that are difficult in these situations. By all means it seems like this man has does everything he can to take this opportunity to try and turn his life around for the better.
We all deserve a second chance. You begin to loose me a bit at third and fourth chances but a second absolutely.

Prison is to rehabilitate people. Someone who commits a heinous act such as murder isn't necessarily going to be the same evil person they were, especially after a prison sentence. If the people of the parole board thought that he was genuinely a reformed, mournful individual, then they would give him parole.

Also, he's mentoring kids who would end up in the system and him having served and obviously having changed since seems like it could be helpful. It blows my mind how hard it is for you to conceive that people can change for the better and become valuable members of society. Even though he killed a man almost 40 years ago doesn't mean he hasn't changed for the better. If you listened to the end you could see that he's not a bad guy, he was a bad kid and was very misguided but has grown up and changed his life since being in prison on death row.

I lived in Vegas and all of my neighbors house were broken into, multiple while they were home. My wife and 6 month old daughter were home when someone tried to break in the front door. Our 2 pit bulls went crazy and scared them away. I have zero sympathy for this scumbag.

In the sense of the word meaning it was emotional, and intense, with a lot going on. He didn't use it referring to the family. He said he was trying to understand how they felt and everything.

I can not watch this. He admits to murdering someone. I am 100% for the death penalty, especially in cases where someone is obviously guilty of a heinous crime such as murder or rape or abduction. Allowing a murderer to run free, regardless if they "rehabilitated", while people sit in prison long term for lesser crimes is outrageous. The justice system should not allow these kinds of people to live for 25 years on taxpayer dime. While this is morbidly fascinating, he straight up said he was planning on killing another dude in prison. Full blown premeditated murder. So was the first one really a crazy accident?
He was planning on killing his neighbor on death row who was a *child predator/ child murderer* but changed his mind when another fellow death row inmate suggested an amount of empathy instead.
This is actually a very common mindset in prison, Child Killers, Child Molesters, Severe Domestic Abusers, other universally deplorable criminals, get attacked or even killed by life sentence inmates as a sort if vigilante "I am never getting out I may as well do something good and exact punishment on evil" situation. It can be debated all day whether it is right or not, but its the "prison code". So much a thing that inmates convicted of these crimes will do everything in their power to hide the details of their conviction from their fellow inmates and in some cases these individuals will be housed separately from other inmates in an attempt to prevent this "retribution".
No sympathy for murderers. I thought for sure this was going to be about an innocent man who got released after 26 years or something crazy. Gonna go ahead and skip the rest of this episode.
