Having been a law enforcement officer for many years, the interaction should be over after finding out there was no accident. You were the subject of the original call. Once you answered the door and confirmed no crash, they should've just left. I am glad that your encounters are very positive with police and state troopers. It just really makes it uneasy for me to see them walking around your home and looking in the windows. Is unusual for that type of call for service.

That's what I was thinking. Their first action should have been on the "crash site" to see if there was a crash or not. If there was no actual paramotor accident, why would they be visiting every paramotor pilot house on the area? It doesn't make any sense.

21-1/2 years law enforcement experience here (and counting): Awesome that you have video AND audio recording of such interactions. It seems that they were fishing around to make a waste-of-time wellness call into something much bigger. A house call like this could sometimes be used to get names and information of someone else who may the the real target of any investigation. You gave that up. Maybe checking with your friends down south if they minded you giving their information out before you gave them up? Also, letting the officers know they are being recorded could keep them from getting stupid if you decide not to give them what they want. You mentioned your UA-cam channel, so after that, being recorded may have crossed their mind and by now, they have probably since watched this episode and passed it on to everyone at the station. Oh, and as someone else mentioned, stay inside your door next time. Also, anytime you are the subject of a police investigation, (however innocent sounding as this wellness call sounds,) know that your chances of ending up getting "placed" on the ground, cuffed, and taken down-town are greater than zero. You don't know if one of the cops has it in for any paraglider pilot because of some personal issue, (such as his house may have been buzzed 7 years ago at 6am and woke up his sleeping baby?) Trust me on this. I know cops. (Ha!) Some cops are vindictive egotistical bastards who abuse authority. Glad this encounter ended uneventful.

So they arrive to do a wellness check on 'Person X'. They see a car and run the plates to find out if car belongs to 'Person X' (because if so, that means 'Person X' is likely in the house or on the property) and they look around the property to check if they can see 'Person X' anywhere (either on the property or through a window in the house). Can't do a wellness check on someone without trying to find where that someone is, you know. That's not rocket science, people. 🤨 And yes, they cannot SEARCH the property without a warrant, but looking around superficially to see if 'Person X' is home (especially after presence of car makes it likely to be so) is not a 'search' in the criminal sense. (besides, even if they find something, would it even be admissible in court without that warrant?) I get it. Lots of stories out there of police crossing civil rights lines, but cops just doing their jobs usually doesn't make the news, so for every bad interaction (that gets reported on) there are probably a few hundred interactions that are totally fine (and not getting reported on). We get an unbalanced image of things, because we mostly hear of the bad stuff, so our perception becomes that cops therefore must be mostly bad. Rational analysis of what actually happened should be preferable to always assuming the worst.

100th like! Also, I was out riding my bicycle one Saturday, and rode too far, like fifty miles, used to riding twenty or thirty miles. So I stop for a break, just like anyone would in a motorhome, just stop by the side of the road, all legal if I had a motorhome, but I have a bicycle. "Helpers" turned around, then aimed their lights at me, I waved at them, resting on my bicycle. I was there resting for maybe fifteen minutes tops, then got bicycling again. About a mile down the road I get pulled over by a cop. In effect forced to produce my driver's license, wasn't driving, but whatever. This "helper," if he/she/they really wanted to help they would have said something out of their barely cracked window, something like, "Are you ok?" But no. All they did was call the cops.
So lss, the next day at work I got ribbed by a coworker who had a police scanner. Cops said my name over their scanner. Then coworkers thinking all kinds of thoughts, getting weird looks from several of them after this non-incident.
This is yet another microcosm of how America is circling the drain. And doesn't have to be. Cops should not be called unless there is a problem.
More to the point of this video: coppers messin' with these paragliders is proof that they don't have enough real problems to deal with. As a 34 year Law Enfororcement veteran, I can tell you that this type call is nothing compared to the nutty calls we get (thank God I'm now retired). On a welfare check, which is kinda what this was, officers are a little more relaxed and will typically look for 'signs of life' especially when its a possible death investigation. Is looking in the windows ok? Not really but most courts adhere to the 'plain view doctrine' where if an officer is somewhere he is lawfully allowed to be and sees something in plain view (e.g. drugs, weapnons, etc.), it can be confiscated and possibly used as evidence. Most calls like this is based on sketchy information and directions so running your tag to see if they were at the right house is not unusual and, at least in my state, not illegal.

Clear violations of the 4th amendment. Learn about your 1st, 2nd, 4th, 5th, and 14th amendments are. The cops can and do use wellness checks to gain entry. Once they are in it's all downhill from there. They knew they were at your residence before they knocked on your door. They ran the car tags to see who might be in there with you. They did it before knocking because you could have ended the encounter at any point. They want to follow up because they never know what they might find and when.
DO NOT make small talk during such an encounter but be ready for their push back.

I know it seems a bit redundant for them to go to the lengths they did, but, seriously, kudos to those guys because they did it right. They didn't just take the word of someone on the phone, they went the extra mile to lay eyes on the person to make sure nothing was, for lack of a better term, "untoward". It's nothing personal, but they didn't know you or the guy on the phone. They wanted to make sure that it wasn't just people making up a story and covering something up. Those guys see a lot in their field and I'm sure neither wanted to be the one to explain to their commander that they didn't a do a complete investigation even for something that sounds as pedestrian as this. If nothing else, it shows their work ethic and attention to detail, which, I'm sure, is something they would rather be known for than slacking on the job. Instead of first confirming that the car was the stolen car, they shone lights into the darkened house / living room, banged on the door, and scared the 💩 out of me with a mini interrogation with no explanation until they were interrupted over radio to inform them the stolen car was located elsewhere... 🤦🏻‍♂ Didn't they have a VIN or plates for the stolen car, and couldn't they have looked up the plates on the car in my driveway, confirmed the vehicle registered with that plate matched the description of the car in my driveway and eliminated it as possibly being the stolen car? 🤷🏻‍♂ I generally have a great deal of respect for police, but I've had a few negative experiences and a relative had a bad experience with some young/green cops with massive egos whose counsel quickly/quietly dropped their case (related to an oversize transport permit they wanted to claim was insufficient/invalid) when they realized my relative had legal representation. I might be criticized for saying this: When the police come to your house unannounced, do NOT step out onto the front porch. If you stay in your home and talk to them through the door they cannot enter unless they have a search warrant, arrest warrant, or exigent circumstance, but if you step out onto the porch they can legally detain you and even put you in cuffs. Also, the police said they were making "wellness check". While that will be true most of the time, the courts have ruled that when police are conducting an investigation they are allowed to give false information to people they speak to as part of their investigative tactics. So, just because they say they are doing a wellness check does not necessarily mean that is the reason they are there. I love, respect, and support the police, but we need to be careful and informed about our rights when talking to them.

I distrust the police at every turn

    • @tadgriffith
      @tadgriffith Рік тому +35

I cannot agree more emphatically… Once you were on the porch, you were detained.
If you had not agreed to give over your friends names, you could have theoretically been arrested for obstruction.
If you remained in your house and communicated through your cameras, you could have simply said, “I’m fine.” If they asked additional questions, you could have simply told them to leave a card and you’d contact them if you heard anything… and simply stopped talking and gone back to bed. (Presence is required for detention during an investigation.)
What is telling? After finding out you were OK, they were still asking probing questions. This is normal for police officers, but I would be very concerned that they are trying to establish something tangential.
For example, “where do you normally fly?“ This could then be applied to a different investigation. They get you relaxed by talking about something life-threatening, and then casually come back to something where they can get you to admit that you were somehow breaking the law. This would be especially significant if they want to more broadly interpret the laws regarding flying over populated areas… and I am pretty sure that is exactly what some viewers of your channel - especially the ones that live in your area and disapprove of your paramotoring - are trying to get the police to do.
In the future, to protect yourself and your friends, I would recommend communicating through the cameras on your property. Then, I would never admit that I “knew“ where your friends are, or are not flying. Instead, I would suggest that you say something along the lines of, “I don’t know where my friends were flying that day. I can send a message out to the community and ask. Can you leave me your contact information, and I can email you any responses I get?”
If they say that that will not work for them, I would be highly suspicious that they are actually investigating you and not a potential crash.

@@fightingfalconfanThere is no legal requirement to provide information like that to the police. They could apply for a warrant to search his phone and see who he was texting, but since they weren't investigating a crime they would never get that warrant.

And if the cops called me to ask if i was ok and i said i was…i had not been in a crash…and then they called other cops near my home to come to my WORK and question me, in front of my boss and coworkers, i would be hella mad about that. I would tell them i already confirmed it via phone call and i cant talk right now cause im working. End of conversation. It started as a welfare check, but then turned into an investigation of all the pilots in that area. Because “we got a call”. What they shoulda done was gone to the area of the supposed crash and look for debris. No debris = no crash

Did they bother to look for a crash site before they sought to see if the local flyers were alive? You shouldn't have given them the names of your friends, no reason at all to sick these guys on them, they could be 100% lying trying to catch someone for some illegal activity. You gotta brush off cops at the door as quickly and giving away as little info as possible. They aren't trying to help you

Hmm, serving by dancing around an interaction. There is ALWAYS an attempt to ascertain if the person they are talking to is doing something illegal. So, no, it's all about feeding the state with revenue, period. If they weren't concerned about prosecution, first-and-foremost, they would have just spat out what they wanted; not looking for incriminating evidence. I mean, running plates on a car sitting on private property is looking for more to make an arrest. Courts have ruled they can run plates on private property, where the police do not have to enter through a gate... still doesn't reflect well on intentions.

There was a recent "welfare check" where three officers opened fire on a lady who dared to wield a hammer. All three of them shot her through a closed window -- didn't end well for the older lady with mental problems. Whenever you call the cops for anything, you can expect things will always get worse before they get better . . . if they get better. :(
