If you listen carefully, both him and Rajat were advised by their lawyers not to testify. So there must be something completely wrong with the Lawyers, they got paid but didn’t advised their clients to testify. Mostly because maybe they didn’t want to do the necessary work involved in preparing your client to testify.
This man has given more to charities and helped people more than the US government is doing right now.
Look at congress, 74 congress members were involved in insider trading and not one of them is going to jail. The entire government is corrupt, and worst of this is if you are not white, expect a severe punishment

I am an attorney who has handled securities fraud and a multitude of other types of financial criminal matters. It is rare to see a journalist handle a difficult interview in such a complex case with such balance, fairness, and integrity. Precisely the right questions asked; precisely the right degree of follow-up; and precisely the right measure of skepticism of both sides to promote the public's interest in getting to the truth. I was very impressed by the skill in questioning and the way facts were drawn out during the questioning. I learned a great deal about the overall situation as a result. My take is his handlers had agreed to the interviewee controlling the narrative in exchange for the first interview. The narrative being to clean my record, for I was had by a corrupt legal system and I have a book that goes into more detail.
It accomplished this but little more. I did not notice much push back but I assume if he stays on the circuit he'll get exactly that. It was worth my time but I'm left wondering what the other side had to say. I am well aware of prosecutors deep competitive unfairness and this could easily be a case of that.

Why Steve Cohen personally got away from prison . Some of his employees went to jail and he settled with court by paying huge fines in millions. It was unfortunate by his aggressive behavior with the help of FBI Barrera was able to get conviction for several minor employees only. He never nor his successors prosecuted using a disputed law after these90 cases. Even now the law is not resolved. Only congress can straighten this disparity between the courts and SECs definition of insider trading definition. Unless this is resolved there is a possibility of another aggressive district attorney may use this same tactic if a judge was willing to go along with him even though the law is weak.

This IS a VERY important interview with this man ! I remember when he went to jail and was SHOCKED because knowing what I knew about the judicial system it did NOT add up but at the time I had forgot to include a few BASIC key elements almost everyone in america KNOWS about this country. I remember listening to the audio tapes of the phone call some 10-12 years ago where Rajat Gupta clearly said something to Raj along the lines of "hey, this just off the boardroom..." and proceeds with the tipping. So when Raj says no one told him, "hey I just got this from somebody", that's really hard to believe. And if 100% of his trades were based on the written statements of his 35 analysts, why is Rajat Gupta's tip on the call "news" to Raj?
Just as Raj is guilty, Preet Bharara is equally guilty of muddying up the waters to make the case. But if Raj is guilty, so are most of the "fund managers", just not convicted yet. Justice is a joke nowadays, not a "bedrock" of anything. But we wanna go on believing that, don't we?
EDIT: “Yeah," says Rajat Gupta. “... this was a big discussion at the board meeting" to buy a commercial bank. Lookup the audio tapes.

Just finished his book and would recommend it. His version is that he got picked on by district attorney who himself didn’t understand what constitutes inside information. Based on his book it appears he was either doing the the opposite to what the tipper alleges or his team had already found that information legally and had traded prior to it. However the prosecutors, judge and jury didn’t understand markets and hence couldn’t understand what is legal and what is illegal. I plan on reading different versions of the same story from Preet and Gupta next. I remember reading books on the insider trading scandal of the 80s where people were just fined. Similarly after the banking crisis the banks were bailed out and no one responsible went to jail. But for political gain one south Asian prosecutor picked on other South Indians.

Naively perhaps, Rajaratnam had expected to get a fair hearing in court. As an immigrant who had achieved tremendous success in his adopted country, he trusted the system. This Raj Rajaratnam stole over $150 million combined through insider trading. Supported a dangerous terrorist organization with USD 3.5 million, which he describes as charity. And sat in prison only 8 of the 11 years he was convicted to. Now he wants to whitewash himself as if what he had done was a Peccadillo. I demand to punch in again for 30 years, because he is misusing his probation to turn the facts around. So please arrest him once again and punish him properly!
