    The plaintiff is one of those people who makes up terms and you have to explain it to him 20 times because he settles on and never budges on how he THINKS things are.

    This man is not dumb, just stubbornly wrong. I have a friend who has several degrees, including a PH.D., who never thinks he's wrong. He thinks everybody is out to get him and believes nothing you say until the 15th time. Once he gets an idea in his head, dynamite can't blast out. Some people are just like this man. He has a straight forward warranty and still wants to argue.

    When I buy a car, I always have my sister read the warranty. One time I sold my car to her and she asked for all my warranty information. When I gave it to her she told me to send my bill of sale to the warranty company after doing so I got a refund of 1500. After that I started paying a lot more attention to warranties.😊

    How to know when someone makes terrible financial decisions: 1) they say they were tricked into buying something, 2) that thing is crappy and/or old, 3) they act like money is no issue, 4) they sue for 20 times the original cost.

    Car dealers use different lenders depending on the buyers credit and payment ability. Of course the cost was more than 3k if the Plaintiff financed. Then, the Plaintiff doesn't even understand the warranty to begin with. I really feel bad for the Defendant, the Plaintiff must have been a nightmare to deal with.

    You almost have to wonder how he got this far in life without the ability to understand simple stuff. Then you realize that he hasn't gotten far in life at all. He's just aged! That's why he has to finance an old $3000 car for 30 months. It's sad but some people never reach a point in life where they thrive.
    His numbers seem off. The car & interest was $3900. They gave his $1000 for his trade-in and $500 on his credit card. So, now it's $2400 which SHOULD be $125 for 20 months. Did fees & taxes add an extra 10 months?
    He NEVER should have bought a car with the check engine light on.
    It's too bad that the next time he buys a car that he'll have to bring himself to buy it. He's no good for himself.
    Why didn't his wife/lady friend fix his collar?

    Even as a small used auto dealership who sells a vehicle with the check engine light on, but doesn't disclose it upfront? The plaintiff shouldn't have purchased the car once he realized the dealership wasn't going to cover at 100% to fix the problem.

    Really needed more information, like what the judge asked for in this case, on what was needed to get rid of the check engine light in the beginning. Door is not something for a check engine, and the plaintiff is clueless by saying that. Then the judge would have given the plaintiff half.
    Though smart people know that they jack the price up, then give a 50% discount and still make out.
    Even if that got fixed , I can tell you the plaintiff would have more problems soon- KIA Sedona!

    One issue is if you have shown the problem within the time of warranty even if you need to pay half, it’s an ongoing issue that must be addressed until, it’s fixed. The defendant could have taken the time to explain but it wasn’t in his interest to do so , I think the verdict should be he still has an obligation to fix the problem that was brought to his attention within the time written in the warranty.     First thing to do when buying a used car is replace the gas cap. A mechanic told me often that solved a lot of check engine light problems.

    So plaintiff said he could afford $125 a month and then said the terms were for 30 months at $125 a month and “i was totally fine with it”…..wthhhhh he makes no sense at all. It’s his fault completely for not reading and understanding the warranty and documents!! The nerve…..smh!!

    He didn't realize that waiting for 30 days before he can get it fixed sounded ridiculous? He bought a $3,000 car put $500 down from a credit card and $1,000 from a trade-in. They charged him $400 to finance the loan making the loan $1,900. Divide that by 36 months and that comes to roughly $52.00 a month. What was the interest rate if his payment was $102?

    This is so sad because the sales man scammed the plaintiff. There are so many time where a sales person will say that they will take care of it if anything happens. BUT the sad part about it is, when you come back, now they have amnesia about what they told you and because you have signed the paperwork (warranty) they can use that and get you to pay. That defendant knew exactly what he was doing to that old man. He took advantage of him and the Judge did not see it that way because she was under the impression that the Sales guy had told the old man that it would be repaired under the warranty. But I know that feeling because Sales people play this game all day. It's a game of words. HE KNEW WHAT HE WAS DOING!! Think about it like this: If I just paid (lease/financing) then why would want to come back in a few days to pay more money for a repair?

    I work for an insurance company and it never surprises me how I many people do not know what they are paying for and then get mad because something is not covered. Well, you chose the policy not me and you should have read it.😂 the plaintiff didn't have a leg to stand on when he came into court. All that matters is what's on the contract that he agreed to.

Not to mention insurance companies word it so you think your getting everything and your really not.Helping out a customer would make you a good person and be less issues in the future you know it doesn't cost anything to be a nice !!

    In Pennsylvania our car has had the check engie light on since we brought it and it still passes inspection cuz its problem with the computer nothing more car runs fine so im confused as to why he says he cant pass with the light on?!

    Judge got this one wrong. What good is a car that you can’t register? Seller is a lier, resets check engine light is not the same as fixing the problem. Car seller is a scammer using bait and switch tactics.

    The car should never have been sold with check engine light being on. If it can’t be smog inspected it can’t be transferred. The dealer is not a nice guy taking advantage of a simple man.

    I absolutely despise when people say they test drove a used car with over 100k miles... heard or saw something wrong, did NOT take it to a mechanic, and let the salesperson say, "Oh that's just so and so," and then continue to buy the car. First- salespeople are NOT mechanics, they are earning their paycheck by selling you a car; second- if you're so gullible to believe anything that comes out of a salespersons mouth, you kinda deserve to get taken; and third- if you were smart enough to get a warranty, you should be smart enough to understand what is covered.

    I know the plantiff is an idiot but small used car dealerships are such a freaking scam. Try to never ever go to those places. The engine light was on the plantiffs car when he purchased the vehicle and now they want him to pay 50% to get it fixed. Plantiff never should have taken the car off the lot and signed any paperwork.
    When I was young, 23. I purchased a used car at Shannon motors, like an idiot. I drove the car off the lot during the day, wasn't until nighttime that I noticed the headlights and break lights were out. I bring it back the next day and they tried to make me pay for the repair. Luckily my dad scared the shit out of them and they replaced it on their dime since it was THEIR FAULT.

      Ok but if you listened to what happened the first time he brought it in they just replaced the sensor and didn't charge him anything for it, they made good on that issue. It was only when he brought it in a second time that they said hey this is under your 50/50 warranty and you have to pay your portion before we order the part. It's not their issue that he didn't understand his warranty

      @@Ash-83 but they only stopped the sensor from going on. They put a bandaid on the problem. They know they are scammers and dumb people (like me once) will go to them out of desperation. They knew there was a problem with the car but just turned off the sensor. That didn't actually fix the problem.

    It sounds like this guy didn't really understand He was going to be paying on a used car for at least two and a half years, if not for five full years, depending on how low the payments were. That car is going to die before that guy gets to pay it off. It's not even going to be worth $3,000 once he leaves the lot. He's going to owe more on the car than the car is going to be worth before he even signs the papers.

    There is no way this plaintiff is this big of an idiot. My guess is he can't afford to fix the vehicle out of pocket and is pulling this stunt 1) to try to get the defendant to fix it so he doesn't have to go to court or 2) just crossing his fingers and hoping the judge rules in his favour just because.

      Then get a copy of the warranty and pay a lawyer $150 to read the warranty before you buy the car. Better than being stuck w/ a $1k car that needs $5k worth of repairs.
