There’s the “kill em with kindness” way of doing things to keep things fine in court. You don’t want to lose a case because you didn’t give the subject every opportunity to defend themselves. It’s usually evidentiary gold to the case, as they do dumb stuff the same as this subject did here. The body worn cameras and dash cameras are a godsend, sometimes it’s better to let the subjects misbehave. I was reasonably strict with them but if they wanted to create evidence to better convict them, I would let it go.

I think knowing it’s forever memorialized on UA-cam is more effective. Someone - friend, relative, coworker, boss, supervisor - will see them on YT and will them. You know they’ll watch to see what everyone else has seen and that will be more humiliating than anything else.
Criminal defense lawyer here. There are tons of legitimate reasons to dismiss charges. Most of the time it is because it is for a complicated plea deal involving other charges from other incidents. Sometimes, the charges are amended to something else and it may look like it was outright dismissed. The litigation of criminal defendants is a complicated, difficult procedure from both the prosecution and the defense sides. Prosecutors and Judges are not out there dismissing charges all over the place and criminal defense attorneys are not using loopholes to get people off.
Almost all of the DUI videos on here result in charges being dismissed and I don’t understand it. Then, they wonder why people end up with 3 or 4 DUIs. Take their license away.

Pretty much every state’s DWI laws state that if a person is in the driver seat, they are in control of the vehicle, and are considered “operating”. If people don’t like that, talk to the state legislature.
Most don't even have to be in driving seat. Most just being inside the vehicle when key is ignition. Was told by a cop that if you ever are drunk and just want to sleep it off in vehicle, lock your keys in the trunk. Where your keys are will play a big role in court. But just best to call a ride and not get near your vehicle.

There’s the “kill em with kindness” way of doing things to keep things fine in court. You don’t want to lose a case because you didn’t give the subject every opportunity to defend themselves. It’s usually evidentiary gold to the case, as they do dumb stuff the same as this subject did here. The body worn cameras and dash cameras are a godsend, sometimes it’s better to let the subjects misbehave.
I was reasonably strict with them but if they wanted to create evidence to better convict them, I would let it go.

Criminal defense lawyer here. There are tons of legitimate reasons to dismiss charges. Most of the time it is because it is for a complicated plea deal involving other charges from other incidents. Sometimes, the charges are amended to something else and it may look like it was outright dismissed. The litigation of criminal defendants is a complicated, difficult procedure from both the prosecution and the defense sides. Prosecutors and Judges are not out there dismissing charges all over the place and criminal defense attorneys are not using loopholes to get people off.
Almost all of the DUI videos on here result in charges being dismissed and I don’t understand it. Then, they wonder why people end up with 3 or 4 DUIs. Take their license away.

Pretty much every state’s DWI laws state that if a person is in the driver seat, they are in control of the vehicle, and are considered “operating”. If people don’t like that, talk to the state legislature.

Was told by a cop that if you ever are drunk and just want to sleep it off in vehicle, lock your keys in the trunk. Where your keys are will play a big role in court. But just best to call a ride and not get near your vehicle.
