First of all ,if it's committed with out the consent of wife ,it can't be termed as adultery rather it would be a rape ..well if wife is in comma and she happens to be sexually assaulted in front of her husband so court can take cognizance of her husband's statement and can charge M under section 376 ..where as victim her self is not aware of the situation and no one literally witnessed it ,in that case ,nothing can be done unless there is strong circumstantial evidence which can corroborate the charges made against M..thanks for such explanation. .

This law seems to be in favor of women. If wife and M agreed to be in a physical relationship and if wife is not considered as guilty then even M should not be considered as guilty. However, husband can lodge a case against both of them and use it for the grounds of divorce. In such divorce cases wife should not get any compensation from husband's salary or income. Above all, we live in a free country and having an affair outside marriage should not be considered as a crime by any party or law, but can be used for the grounds of separation and divorce

I found this law as stupid. Women's a wife property? So our law perpetrates patriarchy. But the law is heavily biased against men!! Women can easily get into sexual relationship with other men but the poor husband cant do any thing.
How is consent by the husband proved? What if he backtracks in Court? What if this law is used by a husband and wife to frame an innocent man? Sexual relationship should be a private matter. If there is adultery, then definitely it will lead to divorce. So what's the use of this law? And why is it so biased and anachronistic?

I think whole Laws on these issue need to be simplified and rationalised otherwise, as you said, can violate one's FR and Natural rights. And obviously, can be used to frame some innocent person.

Sabse pahele baat ki marriage karane ke bad koi bhi ho chahe men ho ya women and agar wo extra maretial affairs rakhata/rakhati hain and apne partner ke saath cheating karat/karati hain to use heavy se heavy punishment diya jana chahiye. Because, he/she koi kou right nahi hain ki marraige institution me aane ke bad wo apne spouse ke saath dhokadari kare and apne spose ko mentally, physicially, emotionally and economically destroyed karade.

Evidently, it is rape. Section 375 doesn't talk about feeling of victim at the time of crime.
Instance:- Rape with minor girls, who can presume the feeling of that victim.

I think this defies the fundamental of equality in our constitution. Both the people involved in the unlawful and conscious relationship should be considered guilty. Secondly, there should also be a provision made for the wife to press adultery charges against her husband if he maintains sexual relations with a second woman.
Thirdly, the foundation for this law that the wife is the "property" of the husband seems incorrect. Humans can't and should not be considered property.

In the last case it was mentioned that whenever there is not a consent of both husband and wife....
So simply it implies to all the rape cases vistimised some married women..and if the victim is not in a position to give statement then it is sure that there should and must be a special investigation of the whole case covering all the past incidents ...
With this law indian judicial system has proved how wastefully complicated they can be in framing such a conditional and confidential matter into crime against any innocent man ...

In this video, Essential Ingredients point two says "The person must have knowledge or has reason to believe that the woman is wife of another man". In this point you say if M has no knowledge that W is married or wife of a man, M can't be published. Is this right as it is the 'Violation of Law' and by IPC Statuary law violation is a punishable crime. Do I'm right? Plz clear.

If an adult boy make the physical relationship with an under 18 girl with the consent of girl but the parent of girl is in against so it will be same as section 376 or not?

madam, I have a question for you... Sparing women from punishment Under Section 497 is strictly violating Article 14 "Right to equality". My Question is why Supreme Court Rule out Section 497, instead of that if both married man and women brought under the section could have saved Article 14??

It is like self-contradictory law..... being an adult we are responsible for our acts whether its right or wrong and male or female...a wife is both adult and in marital relation.....when she is in illegal relation with some other person it means it was in her knowledge that she is violating the sacred relation of marriage....then being her an adult why law can't punish her for guilty.....if law says everyone is equal then why it consider the society as patriarch? and why all the responsibility lies with husband or male." Wife" is a human being and can't be considered as husband's property for asking any consent. Simple a wrongdoer must be punished irrespective of husband or wife and male or female ,that could be an equal society.

I think this law is violation of the fundamental right of equality.
this provision isn't unconstitutional because indian constitution gives right that special provision make for women and children. because they know that women is not wholly free. but aap log ye bat kyu nahi bolte ki women case file nahi kar sakti yha unka right is equally violent nahi hota .hence dono ko equality nahi h .sometime husband or sometime wife misuse this.so provision should be that both file case and both punished. they no one misuse it.☺☺

Well after Navtej Singh Johar case the accused shall be aqquited for legal loopholes. But maybe in the future IPC may be amended to count that in Section 497
