Unpermitted Vendors Defy Police and Rush Pier

- Santa Monica Code Enforcement Officers, with Santa Monica Police Officers unsuccessfully try to push unpermitted street vendors off the Santa Monica Pier on Sunday, November 7, 2021. After a stand-off, the vendors rushed through the officers with a convoy of carts and resumed to sell food at mid Pier.
A food cart fell over during the rush. One Santa Monica Code Enforcement Officer was injured and transported to the hospital.
The unpermitted vendor sweep was unsuccessful.
No citations were issues and no one was arrested.
Allied Universal Private Security Guards guarded all Pier entrances to try and prevent unpermitted street vendors from entering the pier. The unpermitted vendors arrived to the pier before security started this morning.
The Santa Monica Pier has a worldwide identity. The City wants to preserve our decades old wooden Pier so it can be enjoyed for years to come. Because each unpermitted butane/propane cook-cart is a potential fire hazard for the Pier, the City’s Code Enforcement, the County Health Department, and the City’s Police Department periodically conduct educational and enforcement campaigns to help keep the Pier safe. This safety focus calls to eliminate all unpermitted carts, while addressing improper hot grease and trash disposal, and unsanitary food service conditions on and immediately adjacent to the Pier.
A new emergency ordinance passed on August 24, 2021, which prohibits dumping of commercial trash in public receptacles, disposing of liquid waste in public spaces and in storm drains or on any street, sidewalk, bike path, public parking lot, public park, the beach, the Santa Monica Pier, or any public receptacle citywide, and the use of unpermitted combustible fuels on and around the Santa Monica Pier.
Street vending is restricted on the Santa Monica Pier.
All vendors need a City of Santa Monica business license and vending permit to sell any items in the City, and vendors selling food must also obtain and display a Los Angeles County Department of Public Health permit.
As part of the City’s program, sidewalk vending is restricted in certain congested, high-traffic areas to protect public safety. This includes on and around the Pier, where all vending is prohibited except the City’s existing licensed vendor cart program, and the beach, Third Street Promenade, and Palisades Park, where stationary vending is not permitted.
A new ordinance passed on August 24, 2021, prohibits any person from using any combustible fuel (including propane, butane, any other liquid gas, kerosene, steno, charcoal or wood) on the Pier (including the Pier Bridge) or within 25 feet of the Pier, for any purpose involving the fuel’s combustion including heating, lighting, or cooking without a permit from the Fire Marshal.
Violations of the new ordinance may be handled as infractions, misdemeanors, or through issuance of administrative citations, in addition, combustible fuels used in violation of the new ordinance will be subject to impound by the Fire Marshal.

Just Arrest these vendors and seize their carts. The city is liable if their is an injuries from the carts or food poisoning. That's why the vendors need permits. If they have no permits they are trespassing.

Once again, the police stop and do not force these rogue vendors all the way out of the pier. Why aren't they insuring that these unlicensed vendors are removed completely? Enforcement is toothless and amounts to police standing by as the unlicensed vendors rush back to the pier and begin selling their questionable unsanitary foods/drinks. This happens over and over and then the police says: oh, we can't enforce it, they just arrive in the morning before security gets there. The last frames are of the unlicensed vendors all lines up selling their junk to the public. So, not only are the police useless, the security the City pays for is useless and the City laws are useless.

There is no control over how the food has been prepared coming from those carts. I got deathly sick from eating at a Mexican food cart.
In my line of work, I go into many people’s homes, Mexican and American alike. I’ve personally seen the less than unsanitary conditions of food being prepared for the Mexican food carts. An absolute disregard for standard rules of hygiene. Not that I don’t eat at taco stands, I’m just very picky.

Street vendors require a permit that must be managed in your particular city. On January 1, 2019, the statute SB 946 came into effect. This law decriminalizes street vending in California, allows obtaining a permit

Some vendors are legal and have the permits to sell their food or merchandise so they are legit but a sign is posted that Vendors which do not have permits and are NOT in compliance with safe food cooking standards and safe handling of food are prohibited.
By looking at their customers, I’d say they just don’t care. They don’t mind sitting on a toilet for next few days. In the meantime, SM is looking mighty ghetto like. SM needs to empower their police. Confiscate, arrests for resistance and fines for selling unlicensed food.

We used to get those guys in Malibu and San Pedro. The Vendors would be arrested and booked and their carts seized.

Simply put the SM PD cannot do anything as their are no physical penalties for vendors who refuse to exit the pier area. The illegal vendors know this so they play games and rush back in. Confiscation of the carts is the only solution if disobeyed and warned.

Selling illegal drugs has its own set of laws and is clearly defined in any jurisdiction. But these people's offence is not obtaining a permit to sell foods and also not in compliance for how to cook food. Also a tax permit as well as they are a business as well. Can't compare the two offences.

The barriers should be posted closer to avoid carts being brought into the pier. Allow only those with permits in the early hours through a different gate.

Carts should've been photographed and impounded. Anyone resisting orders to remove should be cited, handcuffed, and banned from the property. Any attempt to re-enter the pier should result in a trespass violation and arrested on the spot.

These kids rent the carts start taking them away for a good while.
We did park clean ups of illegal food ice cream carts. I waited with dump truck police came through park and brought the people and carts to me. Police photographed the person with their cart and gave tickets. After that the person had to push the cart into my truck where it was crushed. The last cart we were able to help ourselves to as much ice cream as we wanted. That's the method Santa Monica should use

The police won't be able to say squat. Their department's official spokesperson would have the BS statement to give. It'd mean nothing and all boil down to CA being a sanctuary state. Of course they'll never say that outright. So the only thing to do is vote them out and vote in people who will utilize the police in a proper manner. That way streets are being patrolled, crimes are being solved (hopefully), and just a couple of officers could keep this from happening daily. I said a couple, which is wrong.
