  • “I’ve never been through an eviction,” said Cashaw, who rents a single-family home in Westwood that VineBrook wants her to leave. “It just felt like everything was crumbling down on me. It was so, so, so stressful getting the notices on the door, telling me I had 30 days to vacate, me not knowing where to go. My kids, where’s my kids going to go?” In a Sept. 1 complaint, VineBrook alleged Cashaw failed to pay July rent. Cashaw responded with a counterclaim that accused VineBrook of violating a federal law against unfair debt collection practices. She’s seeking damages in excess of $25,000. The company is seeking a court finding that Cashaw’s claims are without merit. As her case approaches a Jan. 10 status conference, Cashaw was not surprised to learn VineBrook is the most prolific eviction filer in Hamilton County, according to a WCPO 9 I-Team analysis of county data.     Tenants should want to keep the property looking nice because they live there. They should not get upset when someone tries

    If the lease says you have to maintain the yard, then you are responsible for cutting the grass. This lease says that. The property owner should not have to incur a $500.00 fine in violations. Either cut your grass or pay the fine. Your eviction is because you didn't pay the fine. There is not an eviction crisis. There are landlords demanding that tenants follow the terms of their lease if you want to live in their prooerties. The house next door to us became a rental property after the new owners purchased it. They supposedly rented it to an older lady and her disabled son. Within a couple months there was a river of people moving in and out, cars and kids everywhere, and pit bulls everywhere. It got so bad that we had police from different departments coming through our yard with guns drawn and police dogs. We looked out the window and the whole house is surrounded by cops. It seems they were allowing fugitives to hide out over there. We had police at our house several times questioning us about the going on over these. People use to pull up in cars all day and night. Someone would run out for a minute, then go back in. I am sure what was going on with that activity wasn't legal. It was crazy and no one should have to live around that. As of a couple weeks ago they moved out and the house is for sale.

    If your lease states that you have to keep your lawn in a good condition, and your lawn was not cut then you have not adhere to the lease agreement. Therefore, you have to pay the additional funds for the lawn citation. Management does not have to accept your rent if it is not full payment (monthly rent-fees for the lawn fine).

    You are responsible for lawns, and any fines. If you withhold any rent.That is grounds for eviction. I have had renters say well I am not paying for X. Go-to court, judge say how to you expect landlord to pay for X,y,z if you don't pay rent. Eviction granted.

    Pay your bills in a timely manner. Clean your house. Dont have people running in and out. Dont pester the landlord for everything. Always pay your rent first, at the beginning of every month. Dont leave junk in the yard. If u have kids in your house, make sure they aren't unruly.

      @@eattherich9215 Most of these rentals you pay online or by check. Did she make a payment online or via check minus the 500? I can bet you she did not. If she really tried to pay her rent she would have paid the rent minus the fee and argue on that afterwards. Just because she is talking nicely in front of the camera doesnt mean she is.

      @@rarebreedbev356 She refused. These companies take their payment online or by check. Unless she can prove she has sent a check and was returned she did not attempt to make the payment. Also, if the city or property management have to send someone to cut your lawn it will cost multiple times as the normal rate. You have to pay for everyone's time having to do the paperwork. I can almost guarantee her lawn service stopped cutting her lawn for nonpayment. Question for you, do you work for free at your job? Who is supposed to pay for the time that someone has to make arrangement to get the lawn cut and who is going to pay for the person providing the lawn service because they were called to cut it by the city or property management? You must be a lifelong welfare recipient.

    if there's nothing in your lease that states you can withhold rent when something isn't repaired,upheld, etc don't do it. There's too many stories about tenants getting out out because it still not paying rent.

Well Apparently, she can't really afford that home, if you can't pay a kid to cut your grass or a yard guy every so often, then its time to find something more suitable for you. however, "you catch more bee's with honey than with shi**" meaning your approach should have been different/solution based as in trying to come up with a plan to pay your rent and fine, instead of threatening with a lawsuit, now they really want you gone. smh. You gotta have more of a logical approach than emotional.

    Also the landlord had 1450 evictions since 2018. They have 3300 units. The numbers show only 5% a year. That is low. The landlord claims 10000 that would even lower percent This I team is sloppy.

    It’s costly for the landlord to evict someone and it’s costly for a tenant to lose their home for a ridiculous $500 fine from the city. A simple solution is that all landlord should take care of lawn maintenance if that means a higher rent price then, so be it at least you won’t be getting your tenants cited or your company cited by your city unnecessarily for something as simple as a miscommunication on lawn maintenance of the property, a responsible landlord would just include lawn maintenance and any outside maintenance to the property to keep the building up to its cities codes you would think that Landlord would want their properties to look appealing R. City has a name for it and it’s called curb appeal. Now if the tenant is leaving trash and belongings thrown about making the property look like a dump kick them out but for some grass just included in the rent and add 100 bucks a month call it a day

    As a landlord with many properties, I can tell you that I would expect the tenant to pay the $500 as well. It's completely ridiculous to think that the landlord should lose $500 because you were too lazy to mow your lawn. She then chose not to pay her rent! But hey let's just make the landlords the bad guys all the time. What everyone fails to think about is that this is how me make our money. If we give you a house to live in and maintain it, you need to pay your rent and take care of the property. Why should we be treated differently than any other business?

      She had renewed her lease several times, so she had been mowing her lawn, or this would have happened sooner. So now after years of living there she is trying to sue and claim that she didn't know it was her responsibility to mow the lawn. The only thing they added to her rent was the fine that Vinebrook had to pay to the city for not mowing her lawn. This case is cut and dry, she is going to lose. Lease says, "Tenant must keep lawns in good condition".

      The answer to your last question is bc you aren't dealing in the same market as other businesses. When you are dealing with life essentials, such as housing/rent, you have different obligations to society than other businesses. Housing is not a "take it or leave it" demand/supply kind of business. If you get into housing for anything other than altruistic reasons, you're setting yourself (and your tenants) up for failure and disappointment from the beginning

    Ok- the city cited the property due to tall grass. The management passed the fine on to the tennant who is responsible for the lawn care. Instead of paying her fine she stopped paying rent & is suing the landlord? Maybe she should have paid the rent & taken the issue of the $500 fine up with the city who issued it to begin with?

      She broke the lease agreement by not maintaining the yard. She could have hired someone else to cut the grass, or rented a mower and done the work herself. Simple. The city fined the property owner, why should they pay the fine that was caused by the tenant not following the lease agreement? Then..she withheld paying rent. If she didn't want lawn responsibilities she should have rented an apartment vs a single family home with a yard. She chose this house and yard, she signed a lease agreement to maintain the yard, she agreed to pay rent timely and she lied and did none of it. Out the door...

The lease said she was responsible for lawn care, she knew that, she knew she moved into a single family house with a yard, it was not a surprise. She had arranged for lawn care and did it for awhile then stopped. Her lease said she was to provide lawn care, she signed that lease, it's no surprise. She failed to keep her agreement with the lease, she lied. She backed out of the agreement. She could have found someone else to do the lawn, or she's young, mow the grass herself.

So the landlord should just eat that $500 bill and be quiet. She should have tried to work out a payment plan on the fine by paying a little extra on her rent every month until it was paid back

    Low income. Stop having kids when you can't afford to take care of yourself. Contact the county to dispute, wave or negotiate the fine. Rent a lawn mower. Hire a neighbor to mow your lawn. Don't renew your lease with them.

      She CHOSE to rent a single family house with a yard and knew it was her responsibility to maintain the yard. She's no victim. She should have rented an apartment if she was not going to maintain the yard as in her lease. She didn't wake up in the rental property and find a yard appeared over night...That house and yard was a choice she made to rent.

      Thanks again for making an excellent comment. I always enjoy them as they are so rational. I would also note that if this detached house and yard (we call it a garden) was in England, UK, it would be thought of as a luxury dwelling. It would be near impossible for a single mother with a low income and two children to rent such a property here. She should count herself very fortunate , but that is clearly not the case. Instead of meeting her obligations as a tenant, she is complaining and making herself out to be a pitiful victim.

      @@Lucienne-zz1sw: if you live in England, you should know that there is no obligation on tenants or fines for not keeping the garden in order. Indeed, many landlords in the UK accept the fact that tenants will not necessarily keep gardens in good order and hard stand outside areas.

    Some tenants take advantage of the landlord I work for a small landlord and believe me his tenants are terrible thanks to the city and county supervisors.all those regulations they put on.

      She didn't maintain the property as agreed to in the lease...then she withheld paying rent. She is no victim. She could have found someone else to mow the lawn, or rent a mower and do some work herself. The city fined the land owner, she should be liable as she broke her lease agreement.
