As a prior officer in pasco county, the deputies are absolutely correct. This is felony grand theft of a motor vehicle. There are so many reasons why this fits the statutory guidelines for that charge. If the tow truck drivers carried a firearm which ive never met one that did not, the charge can be enhanced. Then requiring money to get it back carries more charges. This is absolutely criminal and asinine. An hoa can have rules but can not operate outside the law. Technically if they want to get creative this was organized crime. After forwarding the news clip to my friend that currently works as an attorney he said it is also racketeering and carries a 30 year sentence if convicted.
The HOAs seem to be masters at creating rules that are against the law, but not big enough issues to get the government involved. Terrible practice overall. If we are going to have pseudogovernments, there need to be HIGH consequences for criminal activity carried out under their perceived authority.
They should arrest the HOA and tows under RICO and get them in jail together. That tow company knows the laws and no HOA ever has legal rights to do this and the tow driver becomes part of the stealing.
I work security, I called pd or sheriff on more tow companies for crossing the line of going on to private property to just check the tages. I got one arrested for trying to pull the car out of the person garage. The best part was a repo guy. The repo company lost there state license, the home owners sued the repo company, the lean holder settled out of court writing off the loan as paid in full. But I have stopped and had tow companies from towing cars that were backed in and had pd or sheriff have them drop the cars and did a trespassing warning and told them if they come back and they are armed, just like you said, they be going away for a long time
The HOA is about to be sued. When the sheriffs show up and say the HOA and truck drivers are going to be charged with vehicle theft you know it’s illegal. Get your money people time to sue!!
They have no right to go onto private property unless they have a court order regardless of what the HOA says. Reason the cars are off the public street is probably because of the expired registration I'm assuming. And why are the tows taking place in the middle of the night?? Driver knows what he is doing is shady
Technically, anyone can walk up the driveway and to the front door as long as there's not a No Trespassing sign out, it's part of the implied permission. Doing so in the middle of the night looking like you're about to steal stuff, and then you actually do, I can see where homeowners might get confrontational.
To be honest that tow company SHOULD be charged with grand theft for the other TEN vehicles that he ADMITTED to stealing already. The HOA doesn't have the authority to just take someones private property, they can FINE the homeowner for breaking the rules but just taking it is THEFT.
It's not theft if the HOA is in control of the property as a property management you've got an unregistered vehicle on their property I don't care if it's your yard or not you agreed to the HOA when you moved in there and sign your paperwork and another thing is not Grand Theft unless you cross the state lines!! You should have your vehicles registered to prove that they're not stolen!!
TBH, people need to be ADULTS and not whining 2 year olds when they own a car.....be responsible and keep car current....it is NOT STEALING to tow a car not properly registered and in violation of HOA rules

@@HudsonGTV That's right. Some contracts are unlawful and unenforceable from the getgo. This is one of them because it infringes on private property rights protected by the constitution. This is the reason the HOA was forced to suspend the entire practice.

While I had the HOA on the phone (land line) I called the non-emergency police using my cell phone. I asked if the HOA was allowed to tow my personal property from my driveway. The police stated that the HOA can tow but once they do it is considered theft and I can press charges against the HOA. The HOA heard this conversation and my case was closed.

The HOA has no legal right to tow anyone's car because their plate tags are expired. That's a Department of Motor Vehicles responsibility. They are trespassing. The lawyer needs replaced after making that stupid comment of "I think the HOA does have that authority".
Ha, HOAs can control the EXACT color of paint used for fences. You think they can't control non-street legal vehicles from being seen from the street? I would not buy/pay for any HOA without going through that document with a fine-toothed comb and double checking I'm cool with all the rules. People sign their authority and agency away all the time without reading. The difference here is it isn't some EULA for a piece of software that can't be practically enfored. A side topic: Repo guys can absolutely tow from driveways.
@jahbrother3602 I know they are in the drive way. That is why I gave the example of repossession of a vehicle in a driveway. You can't murder the repo guy.
So they’re trespassing on peoples private property to steal their car and hold it for ransom. This is the sleazy thing I’ve ever heard of. They need to go to jail and HOA needs to be abolished by the residents.
The major issue I have with this is that tags may show that it’s expired but the tow company don’t know if the car owner may had just paid it and is waiting for the new tag in the mail.
@@mofayer That's the main point. They are attempting to enforce things that are outside the bounds of the reasonable agreement of living in the HOA. The HOA is not the DMV and has no right attempting to act like it can police traffic law.
Private property has not meant anything for years. the state and federal government charges massive amounts of money for you to essentially rent something you're supposed to own. Taxes were never meant to be so steep that you could lose what you are supposed to own.
The reporting didn't exactly make the subtleties clear. Yes an HOA can have your car towed off your property (in most states) but they require an authorization by the HOA for each violator. They didn't have that so it was theft.
Without notice is the major issue I see. The HOA should be notifying the residents if there is a violation and actions that will be taken if the violation is not corrected in a reasonable time frame.
Kudos for the sheriff office for protecting the innocent homeowners and what a disgrace those towing company and HOA are. I would gladly 100% arrest tow truck drivers for vehicle theft. 100% unlawful towing solely based expires tag on private property. It’s not a repossession issue over late payment or tax payment.
I'm a tow truck driver and these so-called tow truck drivers are pure scum. Working in the middle of the night and I bet kickback to HOA. This should be investigated. Cops were 100 percent right.
It's Florida. Expect that most homeowners have at least one firearm minimum. I know we do not have a duty to retreat in Florida if someone is trespassing on our property. I am not sure if them being on private property is enough to warrant shooting them, but if they are unarmed, and they get caught by the man of the house, I would image they could wind getting beat up if they refuse to get off the property.
You’re going to have a difficult time justifying the use of deadly force to prevent a property crime. IF you are a gun owner, I suggest brushing up on the usage of said weapon.
Kinda hard to avoid them when they can magically claim your property as being part of their jurisdiction without telling you anything. You just magically get a bill in the mail for monthly dues and they decide it’s appropriate to sell your home for you for failing to pay the monthly dues along with whatever fines they levy on you. Effing ridiculous!
Yes, an HOA is the worst thing that can happen in a neighborhood. Most of the HOAs have these reasons why you shouldn't be part of one. Reason number 1: you have very little to no control on how should your property look like, what cars can be parked in a driveway, what collor your mailbox should be, what kind of fence you can have, if you can or cannot have a pool ect... basically the opposite of what America stands for.@nofilter.906

There is no legal requirement for the vehicle to be registered on private property. Only to be operated on public roads. That means that the towing company is guilty of grand theft auto. Just stating legal FACTS. 😅
You didn't clarify if you mean everywhere or where this took place in the video, but it depends... In my city, a vehicle must be currently registered with a tag to be legally parked in front of my house... And my state says that if a vehicle is registered, it must have insurance. So, even if it's a car that never gets driven, I must have it registered and insured. My city also does not allow any "inoperable" vehicles in the front of the house. In the backyard behind a fence is another story...
@@hoosier.daddy5000 I'm assuming that the street in front of your house is city or property. It's different if the streets on a gated community were the private property of whatever development company built the subdivision and set up the HOA. Total ignorance. The DMV says clearly, if your tags are expired, you just cannot be on a PUBLIC ROADWAY, and they advise that you just keep it on your private property.
Exactly I have several unregistered vehicles on my property. I asked the DMV if I need to register my collector's cars if I don't plan on driving them ever, she said no they do not need to be tagged unless I plan on actually putting them on the road.
She knows the law, but if she said anything wrong, she could not only be disbarred, but face criminal charges! That's why all of a sudden, the HOA suspended the contract because she called them Ather the media interviewed her and she knew they were screwed!

HUGE difference between "I think" and here is the case law that shows it is allowed. One is an opinion of a person, one is established law already decided by a court.
It's a way to keep delinquent vehicles from piling up in a neighborhood. Thing here is, any communication before this? And of course a midnite run to covertly pick up vehicles is literally insane, or more specifically, theft. This is crazy
There is a lot going on here lol but the tow truck operator needs to have a physical copy of the agreement and why is he only taking vehicles at night whether he thinks he’s in the right or wrong he needs to be careful because once again this is Florida and some people don’t take too kindly to strangers walking around their private property.
The tow company is not naive. They are in bed with the DMV, the local government (county) and that county police and likely the county board as well.

Technically, anyone can walk up the driveway and to the front door as long as there's not a No Trespassing sign out, it's part of the implied permission.
