This landlord was more than reasonable. He could have charged her for new carpets and didn't. Tenants assume that landlords are all trying to enrich themselves their security deposit. Folks, unless your security deposit is over $100K, your landlord is not going to get rich with your security deposit. This landlord, like me, lives in his home. Trust me, he is only using her rent to help pay for the mortgage and taxes. He is not getting rich with $2,700.

If I was a renter, I'd included a clause in the leasing contract that there will be a mid-month (every 3 months) walk-through inspection of the home to make sure the dwelling is in reasonable shape. By the end of the lease term, I'm not blindsided by any huge potential damages and repairing costs, which would also help determines how much of the security deposit to give back.
I used to work for a rental company & managed over 3000 units. Town Houses, apartments, single family homes, boarding rooms, etc. We did semi annual inspections (one at the 5 month mark and then every 6 months after that). Every tenant had an inspection on the 11th month. If the unit was deteriorating quickly, the landlord could opt to not renew their lease and give notice to the tenant to vacate. It was a nice arrangement. If we had a tenant longer than 2 years and they passed their first 4 inspections, we'd move their future inspections to once a year versus every 6 months. I'll tell you, it saved us a lot of trouble. We'd give tenants the chance to clean up and fix things, we'd find pets that weren't approved and/or not in the lease, we'd find live in boyfriends/girlfriends who weren't on the lease and we'd find the smokers ( all of our rentals were no smoking inside). We had a whole department in our office set up just for inspections so everything was followed up on and re inspected after notice was given for violations/clean up. It was a lot of work but well worth it.

That's why I say no cats when I rent. You literally have to replace drywall. They scratch at walls in the craziest, most visible spots. I had to replace WOOD floors because of the stench. It doesn't have anything to do with marking, indoor cat urine smell is indescribable!
I have 2 cats but luckily they don't scratch the wood or pee on the floors. you can actually see the subfloor in the kitchen. I think they used really cheap flooring so they have to be replaced when I move anyway

The rent did not change. The part of the $50 per pet was in there from when she signed the lease from the beginning and she snuck the two cats in. What you are thinking is that typically, if he does not ask for the charges when he notices that she cats within a timely manner its considered that he "waived" the extra charges so he cannot ask for them later. This is when Judge Milan usually explains "if it was good enough for you then, it is good enough for you now, so NO!" Where this case is different is he had a lawyer draw it up and add an "anti-waiver" clause. What that would say is that, if they incur extra charges - they don't waive the rights to them even if it is not asked for right away. This is why she ruled in his favor. As for why this is still applicable after the lease expires, you still agree to the terms of the lease in regards to the rules the landlord is renting. The only thing that changes is that instead of your contract ending with the lease term, you go to a month to month tenancy (which is 30 days notice for rent changes in that jurisdiction) and the same rules are applying that you signed the lease with. For example, my landlord does not allow dogs. When my lease is up and we decided to keep renting, just under a month-to-month tenancy, it does not mean I cannot get a dog now. The rules of renting and the lease still apply. It just means that I can leave with 30 days notice instead of being stuck there until the end of the tenancy. Hope this helps. 🙂

I've had cats all of my life and they are very clean animals. When the owners don't clean the litterbox for ages, cats will not use the box because they are very clean animals. If humans had no toilets available to them, yes, they would pee and poop on the floor. I clean the boxes several times a day and my house doesn't smell.

I’m confused . So judge tells her that the lease was over, it’s month to month so the landlord gets to slide with his part on what’s required to raise rent but when it comes to the cats he’s able to enforce it despite letting her slide with the pets? Doesn’t seem fair!
The judge is a landlord herself. She is always bias against tenants.
I guarantee the plaintiff is single.

That was bullshit. And unfair. He can come after the fact and ask for something never once enforced but she can't get her money. Both things were stated in the lease. So she bound her to the lease to award him but didn't bound him to it.
So she holds her to the lease by doesn't hold him to it. It's so very obvious why.
Showing up with 4 adults for the walk through. I'm sure he wasn't easy, but she obviously made it harder. I understand where he is coming from.

I wouldn't like to be doing a walk through and have 4 other people there. Anything you say would be an argument against all of them. Who is bullying whom? As far as the cat urine, in order to remove it all, the carpet needed to be pulled, flooring cleaned and a sealant like 'Kilz' used.
