  • The content revolves around a court case involving Alexis Tabaka and Christopher Tabaka regarding child support. The court was asked to determine the effective date of child support and address objections raised by the parties. One of the main objections was regarding the credibility of Christopher Tabaka's testimony, with his attorney arguing that the referee's determination was unfair and not supported by the facts. The attorney also highlighted discrepancies in the handling of discovery and questioned the referee's decision to blame Christopher for not having certain data readily available during the hearing. On the other hand, the opposing counsel argued that Christopher was underemployed and not earning up to his full capacity, pointing out job opportunities that he had refused due to personal preferences. The opposing counsel believed that Christopher should be imputed a higher income based on his earning potential. Ultimately, the court had to weigh these arguments and make a decision on the child support matter.
    The content summarizes arguments made during a hearing regarding child support. The speaker defends Chris, stating that it was unfair to expect him to have all his financial information ready for the hearing as he did not anticipate testifying again. They argue that the responsibility falls on the other party to prove income and that sufficient discovery was not conducted within a reasonable time frame. The speaker also challenges the credibility of the referee's determination against Chris, citing past litigation where he was not found to be untruthful. They argue that utility costs on a rental property should be deducted from gross profits when calculating income for child support. Finally, the opposing counsel argues that the referee's decision to find Chris underemployed and evasive in his testimony was appropriate based on his voluntary work choices and qualifications. The opposing party argues that simply wishing for the individual to earn more is not enough and that the law regarding child support must be followed. The court also addresses objections regarding tax considerations and how certain income sources were classified.The attorney pointed out discrepancies in discovery handling and the referee blaming Christopher for not having certain data available. The opposing counsel argued that Christopher was underemployed and should be imputed a higher income based on his earning potential. The court had to consider these arguments to make a decision on the child support issue.

    The fact that there isn’t one number across the board is crazy. How do they justify someone paying 210.00 vs 10,000 just because someone makes more money. Lifestyle should never be considered.

    I got a divorce and immediately quit my engineering job and took a job as a custodian..
    The court didn't like that, but I said indentured servitude is unconditional and they were trying to force me into an employment contract which they can't do.
    They cannot force you to sign a contract, all employment requires a contract. That point stopped the court in its tracks. They cannot force you into a civilian contract.

      The court still made you pay a percentage of your custodial income for support. If this is even true, the court could have ordered support based upon your earning potential. I hope you enjoy living on a janitorial salary, it’s got to be a major adjustment. You stuck it to your ex and kid, I guess you think it’s worth it.

    That is the mother's attorney attempting to make the father out to be a bad guy. Another just horrible attorney and a BMT that just wants the $$ and that is it.
    Again, being able to force someone to take jobs which are not in their potential. See again it is all about the $$ to these heartless women. Vets do not make the money like a person doctor. Again, he is not going to take a job that is not in his wheelhouse, or outside of his school set. He should not have to move for work, which makes it harder to see his children. Again, why can't the mom get off her ass and work to help support the kids as well. No, it is not computed to the earning potential it is what he actually makes.

    Her attorney says the kids suffer because dad is underemployed and will definitely say that the kids suffer if the dad had to move away for employment. If the mother feels that she can’t adequately support the children with the current child support maybe she should allow dad to have primary custody of the children.

    • @bhilyer
      @bhilyer 28 днів тому +4

      Child support is NOT for the child, it's for the maintenance of a child, such as rent/mortgage, house bills and anything else required to maintain a child. It's not money for the child, almost all of the judges I've seen on these types of channels say that over and over again. Why would anyone, man or woman, be expected to prove what it was spent on if they're paying the necessary bills? It is more often than not that women abuse the child support system, but I don't see keeping a track record would help anyone but would add to the headache for courts.

      It always makes me laugh when people say things like that. Why do people (usually those ordered to pay support) believe that child support is basically like allowance for the child to spend on whatever they want. It’s to help provide everything the child needs. Lots of women, like this one in the video is definitely trying to take advantage though!!

    So the courts can make a person work? Make a person ove to accept a job? I know several people with college degrees , one with a masters, that have chosen low paying jobs as the corporate stress was too much. They now enjoy a more relaxed life but scaled down. Mental health is important.Hating your job is bad on mental health. I heard nothing about the ex wife's work history. She is expecting to live off what a doctor makes but divorced the doctor. I wonder what he has to pay in child support. Sad if she must lower her standard of living.
