      Or they have serious medical conditions yet that wasn't seeming to be the case here, this man is getting what looks like scammed big time, IMO baring any conditions or out of the norm expenses no child support should be over 1500 a month UNLESS both parties agree to such.... as realistically a kid is going to need maybe 600-1000 in direct expense per month as the rest is there anyhow, though I'm a bit shocked he'd let this level of support be given in the first place, sure they give the number based on incomes though it's not set in stone and can be fought against to lower them to reasonable amounts.... that being said the fact this woman has the audacity to ask for more money is unreal, I hope they get a full banking history and payment rundown on where this money is actually going as there is NO SHOT they're using anywhere near that payment each month on the kid EVEN if they went to some extremely high class privet school and did all the extra shit it's not coming close to 5600.

      There are formulas to calculate the child support for one or more kids. The amount a kid costs in a household are based on what an intact family would spend a year. This is then averaged for the year and the total costs is divided by the number of people in the home. The costs of a kid = cost for adult in this calculation. In general support for one child is around 14% of gross income. Each additional kid has a multiplier to that.
      There are many flaws to the study used by governments to assign child support. It ignores that single parent homes do not spend the same as the intact family used to calculate costs for kids.
      The formula are weighted to account for the difference of income between both households to ensure the kids have a similar standard of living in both homes (that the lower income earner can spend big bucks on the kids that they would get from the house with the higher income earner).
      Yes they are stupid laws that reward someone who chose a low income career and marry someone who makes a lot more. The lower income spouse becomes another kid that the higher income parent has to pay for because the amount of support money is far more than the higher income earner would ever spend on their kid under their care.
      The only way to get these laws changed is to attack the government who made the laws to get them to change those laws. Child support payment laws were made at a time when most women didn’t work. It’s a lot different world nowadays and the amount of bitter women who want a huge windfall in support payments is because they know they didn’t work hard enough to provide for the kids the same way they had when they were married.

    Emily is a Senior Healthcare Analyst in Michigan which averages 100k+ per year, in addition to the ~$70k per year she gets in child support. The house she sold was 100% paid off, sold for a million, and was entirely hers as part of the divorce. I saw a previous hearing where she complained about the same medical expenses, childcare, and private school expenses which is why the child support was increased from ~$3900 to ~$5600 per month. Now her attorneys are using the same arguments to attempt to increase it further. I also find it interesting that her attorney is allowed to blatantly lie to the court by stating the mother is the sole financial support and the father contributes nothing. Apparently the $5600 doesn't count as contributing. That father pays more per month in child care than I make before taxes and I comfortably support a family of 4, have no debt, and own my home. My kids are also 10 and 12, and they basically take care of themselves. There is absolutely no reason why they can't look after themselves while she sits at her desk in the same home and leave her alone. My kids cook, do the dishes, sweep, vacuum, clean their rooms, clean the bathroom, and do their own laundry. She needs to fire the nanny, put them in public school, stop wasting her money on frivolous court battles, and grow up.

      @@unapologeticallyamy9031 poor people dont only do this... its also a aspect of parents teaching responsibility which if you havent noticed.... is quite rare. Its the literal reason channels like this exist. These are the what the people become when raised without forcing them to do anything as kids. They grow up to feel the same as the adults we see on this channel, which is why court orders get broken, kids get kidnapped from custodial parents, child support is ignored.... all because they were never taught what a obligation of responsibility was. So when they are adults they thing if life isnt play time then they just quit or ignore it.
      Also rich parents on both sides that is USUALLY make the kids do babysitting or other labors of the house. Why? because when you make good money on both sides of the parents you know play time can wait since they played for over a decade already and adult hood is coming up. Every wealthy client I had always made their kids work hard because they know what it took to be able to give them everything they had. Its a reason you dont see overwhelming amounts of rich people in child support or family court drama. The way they are raised is usually influenced by this "force" of babysitting and other chores.

    My daughter is 18 now but years ago I was voluntarily paying about 1000 a month with no court order. Never been to court for child support. Her mom said our daughter had a field trip to DC that was gonna cost 400 and wanted to know if I'd pay for it. I've always been generous with my money so I said no problem and just paid 2000 a month for 5 months just to help her mom get caught up on things and even sent 3000 the month of Christmas. Then February rolls around and she texted me asking if I was ever gonna send the 400 for the field trip. I was like "wtf???". I immediately told her I sent extra money that could have paid for that and she got an attitude with me. Then 2 months later I got notified of child support court. She thought if I could pay her 2000 a month then a court would order me to keep paying it. Funny thing the court ordered me to pay 550 a month. So she got way less than what I was already giving her.
    (This edit is 3 months later, I know shtty women exist. My daughter's mom may have stepped over the line in this instance but she's a good mom. I don't wish any hate or derogatory comments towards her.)

    • @dorbie
      @dorbie 6 місяців тому +6

      True for some stuff, not for others it depends on the order. Add-ons like child care & medical out of pocket are typically extra. If you noticed she expected dad to help pay for a nanny while he was available to watch he kids and that didn't sit well with the judge after dad spoke up saying he was available on Fridays. Right after that the judge reworded the dad's lawyer's request as a continuance pending an evidentiary hearing on custody. So reading between the lines this was a spectacular own goal for the mom.

    • @qwa711

      @@dorbie I don't know what state this is but child care isn't an add on in California, if she is the custodial parent during that time she is responsible for child care, that goes into the support allocation. My question to you would be, what does the child support pay for? Why is she considered the custodial parent of he is responsible for the child care?

    • @dorbie
      @dorbie 6 місяців тому +1

      @@qwa711 that wasn’t true in my California case. It was an add on when I paid support and when I received support. That might change if one parent isn’t working but with two working parents it makes sense. I’m talking about daycare where both parents are working and are obligated to work. A nanny would be the equivalent, although a luxury most of us can’t afford. P.S. your questions are already answered in California law, not by me. The parent dropping the child off retains custody during the stay. This caused some ridiculous situations in my case with mom trying to intercept me before a daycare drop-off in the morning with the police called to try to take custody and prevent my drop-off. A hint of her behavior that led to me eventually being awarded primary custody.

    • @qwa711
      @qwa711 6 місяців тому +2

      @@dorbiewell it was true in my California case. Mother took me back to court to try and get more money but when she asked if the new child support amount ($938/month) was in addition to the preschool tuition that I was already paying ($275/week). The judge said no, since she was considered the custodial parent during that time it was included in the dissomaster calculation. She was upset because she ended up losing money from what I had been paying willingly prior to the new order. We both worked but I made more than her and only had 3 overnights/week. How my case worked out makes sense because the amount of child support is based off of the dissomaster and parenting time, whether both parents are working is irrelevant, that would just impact the financial calculation. Sounds like you got got. I didn't even have a lawyer 🤷🏿‍♂
      P.S. who drops the️ child off isn't the determining factor. The courts simply go off of overnights. No clue where you're getting your info from

    • @dorbie
      @dorbie 6 місяців тому

      @@qwa711 Well I'm sure not getting my info from you because you're very confidently wrong. Google "California child support standard add ons" and the first sentence says "The most common add-on costs are uninsured healthcare expenses and childcare expenses related to employment." This info from the child care law center matches my experience from about a dozen orders being on both sides of the equation, you might have been the exception to the rule, it happens. As I thought, daycare being "employment related" is a factor.
      Furthermore, even when I had no overnights, my time spent parenting counted as parenting time so I'm confident your opinion about overnights is as reliable as opinion about standard add ons.

So she can travel away from home to her attorneys office while on the clock (I don’t know if her job knew) but she can’t care for her kids in her own home. This is not even accounting for the fact that the 12 year old babysits other kids so why can’t he babysit his 10 year old siblings? And why does the 10 year old even need a nanny? My mom use to do the same stuff to my dad but it wasn't about the money. She would repeatedly take my dad to court in the hopes he would miss enough work due to it that he would get fired. The ultimate plan being that she wanted to have him put in jail for not paying after she got him fired. He was paying $1750 / month and I saw none of it. Every bit went to my mother and step father to support their non working lifestyle and drug habit. I asked him later why he never brought up the fact that she was using child support to fuel her drug habit and he said it wouldn't have mattered because the court system sides with the mother most of the time so it wasn't worth the time and money to argue about it.

Be mindful that the lawyer may not share the views of her client but thats not what they are hired to do. I had a situation in the past where I wanted to send a family law court lawyer to the depths of hell , but after the court meeting which he won , he sort me out and explained that he was fighting for the client to the best of his ability , not because he believed them but it was what he was paid to do as a public defender.
