Utah is not a community property state and the trust and the estate of the decedent are one in the same. The judge did the right thing by not granting a judgment against the estate by the spouse, as doing so would create an exception to the statute. The alleged aggrieved spouse's attorney should have advised his client not to file a claim.

The estate attorney is educating the judge. You'd be shocked at how much this goes on. They are not totally versed on all aspects of the law. The property is owned by the trust so homestrad rights of a spouse does not apply. For instance if the property would be refinanced while in the trust a spouse would not be required to sign the mortgage waiving homestead rights. Based on all the discussions and the fact the property was in the trust she would have no claim.
The fact he had her sign a pre nup and now he's dead by her hands, allegedly, should be enough to withhold any claim by her to his estate and his life insurance.

Does anyone know on what grounds she is allowed to sue for? If someone changes the beneficiary of his life insurance with their own free will, why would that be contestable in court? Also is there any point when the legal system can determine a person cannot sue? As far as the law is concerned, Kouri Richins is possibly a murderer who killed her children's father, so is it not inconceivable that her disregard for life is matched by her disregard for her children as well? If she is found guilty of murder simultaneously with losing a battle for her husbands estate she would have orphaned her children AND left them in financial hardship as a cherry on top. The safe only had a small amount of money in it. The safe contained birth certificates and passports as well. She was going to need all those don't you think? The estate attorney is educating the judge. You'd be shocked at how much this goes on. They are not totally versed on all aspects of the law.
The property is owned by the trust so homestrad rights of a spouse does not apply. For instance if the property would be refinanced while in the trust a spouse would not be required to sign the mortgage waiving homestead rights.
Based on all the discussions and the fact the property was in the trust she would have no claim.
I wish someone had asked the judge, to turn the microphone to face him, and speak into it.
The fact he had her sign a pre nup and now he's dead by her hands, allegedly, should be enough to withhold any claim by her to his estate and his life insurance.

Plus her sketchy google searches, the record of prior similiar instances to the point he changed his will bc he didn't trust her, how he previously told folks about her 2 prior failed attempts so it was known "just in case" & how she literally threw a party day after his passing....she certainly gonna have pull some major shiiiii to prove reasonable doubt bc so far whats stacked against doesn't paint a pretty picture of her but does certainly show a motive & a cold, calculated financial incentive so yeah she does have some audacity even if it was filed before she was charged with m*rder he clearly felt she didn't deserve any of his money especially being he was financial stable & breadwinner before & during marriage w/ her, had prenup in place while she was a mess financially.
