Based on the scenario given by the netizen wherein she was a victim of theft and the suspect was a 12-year-old child who admitted that he stole the phone of the victim. I've learned that she must file a case even though he is only 12 for her to positively get her phone back. Even though the child is exempted from being detained under Republic Act 9344 or the Juvenile Welfare Act that protects children that were in conflict with the law. He is not exempted from civil liability. She could file theft against the suspect because under Article 308 of the Revised Penal Code. In the said article, any person getting personal belongings from another person without his/her permission is considered theft. Because of Article 308 of the Revised Penal Code, she could pursue a theft charge against the suspect. The victim should complaint/file a case to get her back her stolen phone, because if she complaint she have a possibility to get her stolen phone, if she didn’t file a case the child who stole the phone can ignore to surrender the phone, if she file a case the parents/guardian of the child who stole the phone can be involve in this incident. The child must be complained because the child below 15 years old of age, under Republic Act 9344 is exempted from detention, so what should be done is to complain to the child so that he can get the phone and even if the child is not detained he has the possibility to get the phone when he was charged.
