🤔 Do you think ChatGPT should be sued for copyright infringement? Or do you think it is Fair Use?
This reminds me of Napster, which enabled illegal sharing of copyrighted music in the 2000s. That ended up with properly-regulated, licensed, paid-for alternatives. These models are the norm nowadays for all creative outputs, and I'm sure that generative AI will inevitably go in the same direction once the lawsuits are over. I hope it does. It's fairer for all.
I think it is fair use because it is altered enough.
It is the Napster era of AI Image Generation. It will eventually find a better and fairer business model, just like digital music has found.

Not to mention the previous controversy of home video recording and Hollywood’s attempts to stop it… Until they found a way to monetize it for themselves.
The copyright holder of a mugshot is the public and the mugshot is in the public domain. Anyone of us, including foreigners, can contact a police department in the U.S. and obtain a mugshot. The MSM does it all the time. There are conditions that usually come down to the safety of the police, mugshot(ee), and others that may prevent or delay obtaining a mugshot but it is rare. That said, there may be a one-off department in some state that is exempt but in general they are public domain. Love your shows, keep up the great work.

Etsy also has been suspending accounts without notice and for for no reason. They suspended mine after just 5 days. No notice, no reason. I know I did not violate and terms and I create everything myself so I know no copyrights were violated. So, yeah, avoid Etsy like the plague would be a good start.

The reason CHATGPT is hemorrhaging users is the way they constantly nerf it. It used to be super fun for jokes, playing text adventures, all kinds of stuff, now it just spits nonsense about being woke and respectful and stems content down to what's acceptable for an 8 year old unless I jump thru a lot of logical hoops with it. Sometimes I just want 20 new puns about farts, not a lecture about how we need to respect the delicate sensibilities about people who eat chili regularly.
It's because of the GPU issue. They need their computer power to train ChatGPT 5. But, they can't buy more, because Llama 2 and TruthGPT have even more cash and are buying them instead, pushing their prices up further. The consequence is a less powerful ChatGPT 4. It's quite interesting honestly
@@WholesaleTed I really don't think it's a hardware issue. I've never had problems logging into it or using apart from maybe twice in the last year. Sure that keeps them from upgrading the tech as quickly, but as is, it was working amazingly, until they started censoring it more and more with each update. The most import thing is user experience and theirs just keeps getting worse.

Leonardo AI had this feature earlier. I've been using MJ and Blue Willow before but when I started to work with Leonardo I completely stopped using anything else. It's just so flexible and handy.

With amazon, and Printful isn’t the requirement to have a professional selling account $39 per month ??
Or did they drop that requirement?
It is still a requirement, you do need to pay the account fee. If you feel confident in your library of designs though, the $39 fee might be nothing, compared to how much you make back!

They put an Etsy clause in the contract that tells you this. If you don’t read the fine print then you don’t know so if entering into any contract with any financial institution read the contract plan and simple

I opened an Etsy store a few months ago. I sold my second item recently after I began participating in their Labor Day sale and shipped it the same day using Etsy shipping. They immediately put a reserve on my entire amount. I tried to report it five times. First through chat and basically got the run around. Finally after several attempts to contact them I got an email back and they released my funds. Etsy said I needed to add tracking but it’s automatically added at the time I bought shipping from them.
I don’t think I’m going to keep my Etsy store. That instance was a handmade item but I have made items through printify bc I have to be with one of my children during surgery and didn’t want to set my shop to vacation mode again.
Etsy says they can /will keep My money in reserve for 45-90 days. I use a credit card but I can’t afford to do that if something start selling.
It’s so disheartening. It doesn’t really make any difference what they tell you. If they can keep your money just bc they want to.

Yeah, Etsy literally tore my store down a few days ago for violating policies. I’ve had the store for seven years, and never received so much as a warning that oh, hey, something doesn’t look quite like we want it to. Nope. Just pulled all listings. Of course they kept all the money I’ve paid in for advertising to get on buyer’s wish lists for the upcoming holidays.

Mugshots are public domain, but some states like CA have made them illegal to sell on merch on the grounds it's a privacy violation.
The lawyer stated that each jurisdiction chooses, and that not all jurisdictions choose to place them in the public domain. It seems like the federal government does, but each state can choose, and I haven't seen any confirmation on any interviews with the Fulton County Department confirming or unconfirming what the legal status is there. Until that is provided, legally, I wouldn't assume it is public domain!

Off topic - but is there any way to sell a “bundle” via Printful? I want to create a set of 8 stemless wine glasses - each with a different, but related design - and sell them individually - as well as in a set of 8 - but I can’t see any way to set that up as a product or template in Printful. Can it be done?
Sort of. You can't automate it, but you can do a manual order with 8 different saved product templates. Doing a manual order with saved templates is very fast. We had to do it a lot during covid. My team got real quick. It would take us 2-3 minutes for each order, haha
@WholesaleTed isn't it the same as any other variant. Is it like printify? You make drafts of each design don't publish. Copy past the skus into the etsy listing on the etsy side? I could be wrong.

I was hoping that Printful might have the ability to do let me bundle items together and push them to my store for automatic fulfillment - and ensure that the entire order gets shipped together too (instead of 8 separate packages) - but I guess it’s not the end of the world to do it the way you described. Are shipping fees any cheaper if I order 8 items at once - or is it just 8 times the price of shipping a single item?
Hi Sara. I'm also from NZ and want to start my POD Etsy store. Do your stores specifically target the US market and have US pricing? Is the conversion fee high as compared with having your country's currency price? Does your course cover topics like opening a US store but from other countries?
I absolutely target the USA and absolutely sell in USD. If you sold in NZD it probably would affect your conversions, since you would artifically make the price look higher than it actually is for them, since our dollar is weak to the USD!
@@WholesaleTed But then you lose profit as Etsy pays you in NZD and you take on the conversion fee, right?!
Stripe also does that, the reserve, for up to 3 months or more.. which makes no sense. For items that have already been delivered.
If you have a reserve with Stripe for 3 months, I would be wondering if the account has some big red flag on it. I haven't encountered this issue!

Mugshots are public domain if they are relased to the public. Tax payers fund them. They can also be obtained by FOIA. Dont use the first search result you get.
When we create a. Image in midjourney can we use that in Print to buy or can't buy or whatever site you're launching your t-shirt business from can we use those pictures that we created mid journey for those sites to make t-shirts
Yes, you have the legal right to resell images you make with any of Midjourney's paid plans

👉 I was kind of wondering. I came across a design platform online which offers many arts effects to implement on your photos. Some these arts effects are named after the original artist like Vangogh. The platform does not make any copyright claims, meaning you can sell your new arts images with the Vangogh effects implemented.
👉So here's my question. If the Vangogh guy comes across your image online with the Vangogh effects on them, will he have the right to sue you?
Interesting question! Art style is not copyrightable, you can't copyright any particular art style, so a filter that makes your image look similar in style to another picture, seems like it should be OK, but I should note, I am not a lawyer!

Trumps photo is public record. No one can restrict it's use. The funny thing is, the state doesn't HAVE copywrite protections on ANY of it's content. So they would lose if they tried to enforce something like this.
AI should get sued for copyright infringement - both for training on images that had no right to and for texts they fed into it. That's why we have copyright laws, to protect creators, it's only fair.
I do hate that for Amazon and Printful need to pay for the professional account, which is an upfront 40 a month. Kinda lame imo.
Sarah, could you make a video about using credit cards with Etsy? PLEASE. I don’t have the best credit, but I recently was able to get a capital one card, with a low balance, and plan on using that for my Etsy POD business, but you can’t be paid from Etsy on that card, so what do you do? I don’t have a bank account, because I was unemployed for a while. I do plan on opening a new account, eventually, though. I was just wondering, though, if you may have some ideas for people with not so great credit, or who may not even have a credit history, like younger people. You always do the best research, into these things, and I was just wondering if you have any ideas??!! And if you could explain how you have your shop set up through Etsy.
WAIT! I am in America. The Laws are way different here regarding Mugshots. Mugs are not copyrighted here. In the United States We have the freedom of information act (FO.I.A.) I have been using mugs shots for years. The People own those photos. They can not be copyrighted in this country.
From my research, mugshots and other photos taken by government agencies are supposed to be public domain in the USA. The reason is because it was taken by a tax payer funded photographer. I am pretty sure that professor is wrong about Trump's mugshot.
I had read that too, but honestly, the websites I had read that on were not particularly credible, whereas an actual interview with a law professor is. I was already skeptical of those websites stating mugshots are in the public domain due to them being government agencies, because I know for a fact, that that is false. That is why NASA having their images in the public domain is so remarkable. Most government agencies choose to retain their copyrights. There are only 2 federal agencies in the USA that I can think of, that open their images to the PD (NASA & the Parks/Recs department, I can't think of their official name off the top of my head). The others don't.

Yes, so, while a lot of what is created is in the public domain by the government in-general, images still often retain their copyright. If you look through their library of images in the public domain, it is actually a fairly limited selection. Most images created have the copyrights retained: www.loc.gov/free-to-use/ this is also not a federal agency, I believe that the Fulton Country State Department would fall under state law. I think. Haha

Federal agencies mugshots would be public domain. State agencies can decide on their own. Some states require the subject to agree so Donald Trump may be able to use his photo but not others. We don't know Fulton County's position.
Yeah it's interesting, historically, the political niche has thrived in POD because it is extremely rare for any politician to invoke their right of publicity. Usually their photo is used to make fun of them, not support them (unique case here) however, it's generally considered socially "beneath" a politician to take down. There are very few cases a politician has. Obama did, when a jacket company made it look like in an ad that he was endorsing their jacket brand by using a photo of him, wearing their jacket. But very few cases like that.
Chat GPT most likely won't go bankrupt. Twitter, Uber have never made a profit. Amazon, Tesla went like 15 years before they turned a profit.
Tech companies can go years without making a profit.

You know, Fulton County may not sue but, in my 20 + years as a pro stock photographer, I'd advise to stay away from "ify" images. I was threatened by *SkywheelTM at Myrtle Beach even though I personally shot the image from the sidewalk across the street. And remember, they don't have to win-- those big name lawyers only have to threaten to sue-- then settle for whatever you can pay. I'm just sayin'...
In my opinion, these lawsuits cannot win. There is virtually no precedence in the law for this new technology. Copyright doesn't allow morphing, in other words, only the exact image is protected, and it was created anonymously, as in there was no intention to copy.
I was amazing just jazzing around on Leonardo AI, A picture created from the prompt turned out to be from a picture that existed on the net.
It was a total accident I even saw the picture, but it was similar, not the same, close for me to see the similarity but it was not exactly the same. If no target to make a copy of a copyrighted item, they cannot be liable.
In another aspect, I like to use Salvador Dali as my painter, people who are living resent that a person can create a picture that can be drawn like a particular artist. I think that was a lawsuit. that one is a little trickier, but you are not drawing a copy of the artist's work, and a machine, like a Xerox copy draws something that looks like that artist might draw. where is the violation?
The artist's feelings hurt that a machine can draw like him? A person can take a Xerox copy of the artist's picture and have no responsibility to pay or be worried about the artist being upset. So, this art-making with AI is a whole new thing, and not a lot of people are technically astute enough, especially lawyers to use the law against AI. AI is essentially a software machine that does 1001 things fast and efficiently. Things have changed and adaptation is the rule of the day.

Personally I think if you use a person's style/face/voice to generate art, they should get some $ as long as they are alive. If their style was so good it made me money I don't mind a reasonable share. And I also think only your children can continue to collect residuals off your work rather than some outside agency. But I don't make the rules.
