Brooke Shields recently revealed a disturbing surgical experience where her surgeon performed an intimate procedure without her prior consent. This isn't just a celebrity issue-thousands of patients, especially women, face consent-related violations during surgeries, including pelvic exams under anesthesia. In this live session, I break down critical steps you need to take to protect yourself when undergoing surgery, especially high-risk or intimate procedures.
We'll explore what informed consent truly means, using real statistics from malpractice claims and studies in the Netherlands and Australia. You’ll learn how to ensure your consent covers every possible procedure and why it’s important to review your surgical paperwork closely for any unapproved exams or procedures.
We'll also dive into the history of medical ethics, including landmark cases like Schloendorff v. Society of New York Hospital (1914), and discuss your rights regarding pelvic exams under anesthesia, using examples from California law.
If you or someone you know is preparing for surgery, watch to the end for actionable tips, including writing down your concerns, bringing a support person, and setting reminders to check your consent form before signing. Don’t let your dignity be overlooked. As Brooke Shields said, "shame is no longer an option."
Join the conversation and share your thoughts-do you feel informed enough when you undergo medical care? What steps do you take to protect yourself? Let me know in the comments. And if this helps you, don’t forget to subscribe for more empowering patient advocacy content.

Hysterectomy and then surgeon said two statements.."i took the appendix while in "there" and since you are almost 40, i didnt worry about tucking in "fat" pockets" as you won't be wearing a bikini".
I was so impacted by his audacity. Even now at 70, the evidence of his nonchalance towards my body and my self image remains.
Surgeons without ethics and compassion and respect should be held accountable
Disgusting behaviour, too many toxic men like that surgeon.
A woman decides what's best for herself.Period.
omg that's terrible, I'd've said well as it's my body, I want that to be done being as I'm almost 40 and not dead yet
I always request I will only sign a hard copy, not sign on a tablet as wording can change or signature copied. On the hard copy I state above my signature, no trainees are to perform any procedure. Why, in the past, a trainee blew out one of my ovaries when doing a camera scope for presurgery.
I agree and they are not held accountable
That's outrageous! So disgusting. I'm sorry you went through that.
My daughter works in surgery and she has always told me, don’t have ANY surgery unless absolutely necessary. Take your own notes about everything they say and do and if possible have them sign it.
@@gaylaluttrell3227 Yes, yes, and YES! THERE ARE NO SUCH THINGS AS‘SMALL’ SURGERIES!
@@gaylaluttrell3227 good to know. We should all know this.
why is the "permission" consent form given to the patient right before surgery ??? Isn't that a form of manipulation when a person is most vulnerable and not of normal functioning state of mind ? Why can't that be signed earlier when of sound and safe and relaxed mind?
💯. I'm on the table, no contact lenses, and they've taken away my glasses. And then they hand me a document on a clipboard to sign. 😮
It should be given a few days before so you can read it thoroughly when you have some time. I haven't read one, but I imagine with all the medical jargon, they are a bit hard to digest in one sitting.
@@awifeinterrupted that's just so wrong. I hope your op went well.
It's called "emergency pressure" to me! Isn't that a sales tactic? 🤔 🤨 Just a thought.
@@MrsMiniverask for it ahead of time. They still will probably you want to have you sign it the day of the surgery, however.
It’s not new for Dr.s to do harm to women “as a favor”. Back in 1980, my Aunt gave birth, and while her Dr. was stitching her up, he said “And here’s the boyfriend stitch.” He stitched her up so unnaturally that she was left with a great deal of discomfort for years, until she had another child.
But I will say, that as a mother who has had to sign surgical consent forms for my children quite a few times, those forms are designed with the intention to protect the Dr.s from litigation, not to protect the patient from malpractice.
They basically say in legalese, “Anything can happen, we’re not responsible for anything, even your death.”
OMG. That's horrible. I'm so sorry.
The way my jaw just dropped…😮
Same story, 1978, first child, doctor says "i put a couple extra stitches in for your husband"... I was disgusted and felt molested.
This happened to me!!! Sex and even periods were horribly painful until after I had another baby. No one asked me if I wanted extra stitches.
And lately, they've stopped showing patients anything except the line to sign for permission, with no other accompanying info! This happened most recently to me before oral surgery. I signed, but asked if I could have the paperwork showing WHAT I signed for, was told "yes", but never got it! I refuse to fall for this unethical tactic ever again, though. And yes, oral surgeons own their own practices/surgery centers.
I love that you’re sensitive to patients and alternative medicine and are humble and honest.
I had to have a hysterectomy back almost 20 years ago. They gave me a form to sign giving permission for removing the ovaries as well as the hysterectomy. I crossed out/x-ed out the ovarian removal and wrote in big letters “NO OOPHORECTOMY.” I verbally told the doctor that I didn’t give permission for my ovaries to be removed.
Guess what? He removed my ovaries and when I questioned him, he said, “What does a woman your age need ovaries for, anyway?” There wasn’t anything wrong with them per labs.
I should have sued him.
OMG. The indifference of taking your ovaries against your will and pitching them in the trash. Why? Why why?? To me this is hatred. This surgeon should have been sued.
I canceled a surgery the night before it was scheduled. The resident who was helping screwed up my meds and I was hospitalized for that. I told them no way is he touching me or assisting.
They were astonished. Say no if you want to. I worked at a hospital that covered up for years an Anesthesiologist who was sexually assaulting patients during surgery. He was sly but eventually OR nurses and surgeons knew he was up to no good. He went to prison, forever.
Omg we may be from the same town
Gee did the perv have a name
I recently had abdominal surgery. While in pre-op a young man came in and introduced himself as an attending. He said he would be assisting my surgeon during the surgery. Later when I read the surgical notes I saw that he documented that he explained that he would be doing the surgery and that I gave a verbal consent. I was shocked. I picked my surgeon because we had a history and I trusted him. I also never gave consent to the second year attending to do my surgery but instead to assist my surgeon. His documentation was a complete lie. My husband who is a retired attorney was present in pre op and was also stunned at the documented lie. Because I like my surgeon so much I have not yet said anything. Unfortunately the surgery failed and now I am having to repeat the procedure. I’m in a place now where I just don’t know what to do.
Get a lawsuit! Imagine how many other patients they are doing this to?! And are suffering! It's fraud at best, and malpractice. Basically the student is " PRACTICING" Under the surgeon. That's a huge risk in itself...then it went wrong to boot??
I'd ask your selected surgeon for an explanation. He owes you that at a minimum.
That’s wrong. I’m so sorry you went through that.
I am shocked at what happened to you..I'm so sorry 😞
I had to have emergency surgery because I broke my tibia at the knee height in three places. I haven't had surgery since I was a child and no one explained to me that they were going to put catheter in and that's why I hurt afterwards and they want you to urinate as soon as possible. So that means someone inserted a catheter while I was under. I wish that had been explained to me because it kind of felt like a violation... you're naked underneath that hospital gown.
I am a pioneer woman West Point grad. I had a rare type pelvic hernia that went misdiagnosed for 8 years. I will spare you the details. Except to state that most of my entire adult life has been destroyed. And I had a full music scholarship and was very gifted in mathematics. My life was thrown away and my children legally kidnapped. Honesty is not allowed in today's world. And I said nothing about what happened to my spine. Thank you for educating people.
In my early 20's, I woke up out of anesthesia seeing the oral surgeon holding the collar of my shirt and looking inside. I don't know if he was making sure everything was put back in place or taking his first peek. Who knows what went on? I figured if I said anything they (or the cops, or a jury) would claim I was imagining it since he was good looking. I was not resourceful or had any of that kind of support, so all I did was not pay my bill and telling them the reason was that I didn't like the way he handled me. Pretty sure the staff knew what I meant. They did not argue or contact me again.
Wow. I'm so sorry. I've had more than a few doctors be inappropriate with me.
You know who else was conidered a "good looking" and well-educated professional man? Ted Bundy. Remind law enforcement of that fact.
Sorry, I forgot to mention it was an oral surgeon, removing 2 wisdom teeth. That's why I was wearing a shirt, and certainly there was no reason for the doctor to look there. I will edit.
That’s why an assistant or nurse should be in the room. SAs have been reported regarding predatory behavior by physicians.
Yeah when in my 20’s and good looking there was an oral surgeon convicted of abusing his patients. I often wondered what went on?
I think that is why it is a requirement now for a nurse or tech to be present.
I had hip replacement surgery. Signed the consent with notations that only a broad certified orthopedic surgeon to perform the surgery. The procedure failed with the wrong size shaft being inserted. Physician gaslighted me during the recovery phase when I was having issues. I went to another surgeon for a 2nd opinion, x2 . And was told the issue and consequently had to have reveisional surgery. When I read the surgical notes they read …the femoral head was removed, etc. No indication that the physician actually did the surgery. This surgery was done in a physician owned surgery center. This surgeon spoke very highly of his assistant. My understanding is that the physician does 8-10 hip and knee surgeries in a day. Lawyers told me that because this physician had a good name in the community that a law suit was unlikely to be successful.
Also, physicians and lawyers back up one another and make suing a doctor, dentist or lawyer for malpractice. A judge will ask for letters by another doctor dentist or lawyer stating the defendant was clearly negligent and they will not do it saving themselves from future litigation by the doctor, dentist or lawyer who wrote the letter...at least that's how it was explained to me by the judge when I sued a dentist for malpractice.
He needs to lose his good name.
I've ordered my. Medical records after procedures and the conversation between myself and the doctors is never documented correctly, esp with regards to informed consent. I am an attorney who works with doctors and also do personal injury, so I'm kinda tuned in.
Really??? "Tuned in" enough as an attorney to let your doctor get away with falsely documenting on your medical records? That doesn't sound very "lawyer" of you... Especially if you "work with doctors"... Unless you are one who defends the doctor no matter what they did...
@christiroseify there is no legal remedy for your doctor not docenting ur discussion correctly if there is no injiry. Each time the outcome was good.
@@9879SigmundS "IF"... If there is potential for injury in the improper documentation of an office visit, there is injury...
So, it depends on what exactly is incorrectly documented but, something as simple as a doctor inappropriately documenting your appeared emotional state can change the way an ER doctor treats you when you come in.
Something you said taken out of context can affect how you are seen & treated.
Something the doctor says to you but doesn't document... why?
"injury" comes in many forms in unexpected circumstances and words matter.
You made it sound like your doctor has mis documented you visit several times... you don't ask yourself why?
As a patient going in for surgery, we should be allowed to record our conversations with the surgeon or the doctor and one thing that I will do. I have hand trimmers so I can no longer even read my own scribbling and if they tell me, no, I can't record it then I'm going to get up and walk out of the office.
@@dmariewalker6880 I just had this situation happen. I took my recorder to the visit, recorded discussing getting an audio of my visit, he said against policy, I said I was ending the visit and turned off the recorder and 2 hours later he finally let me out of the office. He held me hostage and falsely documented the visit...
I'm filing with the State Board and the facility is freaking out... They know they cannot defend the charges I'm bringing against them.
This craziness is just one reason I quit having any kind of exams many years ago. Many people, including the occasional physician, see female anatomy as something that can be made to accommodate most everything. Our female parts are as fragile as the human heart but are treated differently. I just don't subject myself to the groupthink that our anatomy is a veterinarian issue, something to be manipulated for shear curiosity and experimentation for so-called science.
I saw the interview on Sunday Morning today. What is wrong with the medical profession? "I tightened you up". I felt so bad for her. (She's my age)
Right? As if it’s not hard enough as we age in that area….that adds insult to injury at our age.
She should be happy that she doesn't have a big gash anymore
Before signing the consent form for my endometriosis op, I both verbally and writing on the form stated that my ovaries or uterus would not be removed. I have heard too many stories of women who lost their chance for a child as a direct result of such a decision made by the surgeon.
Prior to an operation for removing an ovarian cyst, I specified both verbally and in writing that it would be OK to remove the one ovary if medically necessary, but that all other female organs - uterus, other ovary, fallopian tubes etc. - were to remain intact. Afterwards, the doctor claimed that a quick lab test on the ovarian cyst had shown that it "MIGHT" be cancerous and therefore he HAD TO take all the female organs - a complete hysterectomy! Postoperative testing showed I had no cancer. But I'm sure the ever present medical students got a great education. Presumably the doctor earned more money from doing a hysterectomy than a minor surgical cyst removal, and the hospital would have gotten more money for a longer stay. I wonder if the doctors and hospitals are making even more money selling human eggs etc.? Or other female tissue for cosmetics? A doctor without a conscience, and a hospital without proper oversight.
Dr Kaveh, I will be going into surgery February 4, for a removal of carotid tumor. I have had urinalysis and MRI, the surgeon is a ENT and will be assisting by a vascular surgeon. I am having 2 pre opt Dr appointments. The surgery will take place at University of Michigan hospital, I know this is a teaching hospital and I would like to know what kind of questions to ask?
I am 65 retired, I also watch Dr Sunnel Dhand and he has a video where he gives the advice to ask 3 questions: ask the doctor if he is communicating with the rest of team doctors about my surgery progress.
Ask the nurse or tech to tell you what medication or test is she doing and dosage of medicine.
Also ask doctor and nurse when can I go home. The longer you stay the higher the risk of getting some kind of infection.
Thank you 🙏🏽🌟🌹😊
@roseorosco154 good luck with your surgery. Thank you for sharing the 3 questions that we should ask.
I had NO idea this was a thing, and that's terrifying considering I've had 3 major surgeries under general anesthesia and 3 related more minor procedures under full sedation. The first doctor completely ruined my life, long story, but it was malpractice - I had a lawyer who had already settled out of court twice with the surgeon. I found a specialist after, and he's been reconstructing and revising and basically just trying to fix things since the first surgery. Who knows what was has happened to me...I have ptsd or some may call it medical trauma; these procedures have occured over the span of ages 18 to now at almost 31, so I've always wondered what weird stuff could have happened but I didn't know this was common. Horrible! But I'm so glad to hear a doctor talk about informed consent because I was not provided it. Thank you for helping prevent things similar to what happened to me happen to others.
It is making so much sense now why one out of the 4 nurses...when I was having surgery on one eye lid for basal cell carcinoma...almost smiled sadistically and insisted I take off my underwear. I said, absolutely not. I'm having eye surgery. If my underwear comes off, the surgery is off. There is NO MEDICAL EMERGENCY PROCEDURE that requires my underwear be off for removal of basal cell carcinoma on my eye lid, not even if I go into cardiac arrest and die do my underwear need to come off.
Out of the 4 nurses I met in pre-op, she is the only one who suggested that, and she was the only one who gave me uber-creepy, sadistic vibes. I will never, ever forget her. Everyone else was so empathic, warm, and lovely. I won't forget them, either.
Why didn't the charge nurse in the OR say something ?
She's supposed to be the advocate for the unconscious patient. 😢
Simple- retaliation. There is a hierarchy in the OR and you don't buck the surgeon. Sad but true. Only recently has the tide shifted (a little). It still happens. Both my wife and I work in healthcare and doctors will circle the wagons to protect each other.
Normalized behavior.
All the nurses in that room should be advocates for the unconscious patient.
@@kellykraft832that is exactly true. I worked in Healthcare for 15 years. Towards the end of my retirement, I worked in Endo. We had an emergency endoscopy in the middle of the night. The antitiseoligst was so mad he got called in. He was on call. I was sitting behind the nurses station. He walked right by us, into the patients room and asked her if she had been tested for Covid. She said, No. He came out screaming and hollering. (This was when Covid was going on sky high). I asked him, why didn't you ask us, and we would have told you, no. Boy was he pissed I even said anything. It's not the patients responsibly to even think about that, even in an emergency situation. Needless to say, I got fired the next day. I really didn't care, because I was going to retire anyway. But to this day, I still feel He handled the situation so wrong, and made the whole hospital look bad. But that Dr was so mad at me that I questioned his authority. But he was so wrong.
A better idea would be for the patient to select an advocate(or friend) that need not be medically trained(yet could be) and would scrub in to the procedure. That person could monitor the procedure and call out any violation of the consent form. Such a person could also be a witness in court, so there'd be a lot less fudging and misplaced loyalty to the surgeon or the system.
What if you have chosen a senior surgeon to do the surgery and he puts a trainee or fellow to do the surgery without your consent and he did not inform you before. You become a living cadaver for the training of student trainee or fellow!
All my surgeries have been done at a nearby major University Medical School hospital, so Residents, under licensed surgeon supervision is just normal. Actually the quality of care is superior to non medical School hospitals
You say to your surgeon exactly what you said to us. Unless your surgeon has a medical emergency during your surgery, no one else is to step in (and you may even want to stipulate that a plastic surgeon do the suturing, depending on where the scar might be (i.e. on your eyes or face).
Yes, people DO drop dead in surgery. My sister's best friend since high school was an anesthetist, and she died during a surgery. Another anesthetist took over.
Consents are electronic forms now and they don't show you the document, they just say, "This is the consent for the doctor to perform surgery..." etc. And they give you narcotics that they want to kick in before you see anyone but the doc who just pops his head around the doorway and says, "You ready to get this done?".
I'm a nurse and I have trained other paramedics in nurses over the years. I have always been open to student observers and if there is an appropriate activity that they can do and that's not going to cause me harm I don't mind. Obviously I don't want them performing the actual surgery but if they are there holding or watching or assisting the doctor I don't mind. We've got to get the skills into the next generation
Never have I ever heard of a pelvic exam under anesthesia, now if a patient is in a dire emergency (life threatening) setting then it needs to be truthfully documented that it was done under extreme direst.
It is definitely a thing I have read about many times. they have been allowing medical students to do these for years without telling us. Only in recent years has there been pushback.
It’s quite common in teaching hospitals. Same thing happens with a deceased patient. The deceased are used to practice the insertion of endotracheal tubes.
Back in the 70's and 80's, models were hired for students to practice pelvic exams on. They were paid well and were comfortable with being examined by the often inexperienced students. There was a limit to how much they could take, so the students were split into smaller groups so that the models were not overstressed on a given day. I have no idea what's happening today. A caring person who is familiar with female anatomy should be capable of doing a gentle pelvic exam even if he or she had never done one before. Today there are all kinds of preparatory aids, including videos. Obviously, it's much easier to do an exam on a relaxed model than it is on a woman in pain and carrying major tension in her pelvic muscles.
Dignitary harm can be worse than physical harm over time.
💯 So true!
It needs to be written into the law. Then you'll have cause that doesn't depend on a judge's opinion.
Happy New Year!
Glad to hear you are well.
Thanks for sharing.
👍😘
I asked you about the unauthorized pelvic exams under anesthesia issue some time ago so I am glad you're talking about it.
Even if a patient signs the consent form stipulating NO pelvic EUAs by medical students, how would a patient know if that EUA nonconsent was violated?
Not to sound like a prude but why do male doctors specialize in gynecology?
Saying that someone on the med/surg team should speak up when a patient's wish / consent form is violated doesn't always happen.
Case in point:
Farid Fata, M.D. hematology oncologist in Michigan who falsified his patients diagnoses then gave cancer chemotherapy to patients who did not need it.
He's in prison but after great harm to patients and families (even deaths).
No nurses spoke up, no other medical office personnel said anything that I'm aware of?
I worked with a family that was victim of Dr. Fata.
I don't trust doctors anymore, esp. male doctors in gynecology that seem more like voyeurs than doctors.
It wouldn’t even enter my head that I’d be getting a pelvic examination if I wasn’t in for that area . That is like abuse !
As a retired RN here, the NURSES should be standing up for you and refusing to allow anything other than the consented procedure, to be done.
I was given ketamine without my knowledge for a very short anesthesia procedure and I had the worst response trying to wake up….never again!
I require my anesthesiologist in pre-op to agree that they will not give ANY drugs without first: telling me the name of the drug, the dose and then WAITING for me to say ok! If they won't run! This is informed consent to the letter of the law. I demand it because of exactly what happened to you happens to tons of people- like me. Not anymore. Also put Versed on your allergy list and tell them you get full on anaphylaxis from it so they can't trick you and wipe your memory. Sad state that we can no longer trust our doctors.
I had back surgery but they had to go in through my abdomen. It was a disc replacement l5 s1. I went home that day and immediately started bleeding from my vagina and it wasn't that time of the month. I was calling the doctor in a panic. Apparently I started my period during surgery. Weird random thoughts have gone through my mind at that point related to this topic. Once I started to think about it and of 17 surgeries either four or five times I've started My cycle during the surgery. Apparently that is my body's reaction to either the surgeries or anesthesia. Most of my surgeries have been orthopedic
Some plastic surgeons are obsessed with augmentations and other things. They are very vain and narcissistic. Be straight when you talk to him or her what exactly you want or need.
You also truly need someone there with you the entire time to advocate FOR you, and make sure no one is f'ing with you while you are in recovery.
I've had very good experiences, overall, but you truly have to vet your physicians, nurse practitioners, and physicians closely and carefully, and not be afraid to speak up and let them know they should never interpret your kindness for weakness.
Ive had several surgeries, there was always a clause un the contract that said they could fix anything else they saw fit! Also ive tried to get copies of it and that never happened. Even hospital recordsI obtained from my last surgery did not even indicate the 6 days i had to stay due to the dr taking so much more than he should have. It was supposed to be an overnight stay! I'm very upset over the mutalation!
That's a lawsuit looking to happen... The hospital can't hide that even if the doctor doesn't document it. They billed the insurance for everything. Get an itemized bill, this will show so much of what they didn't tell you and show the extra 6 days you stayed. They have to justify on the bill those days as well. All you need is enough to send to your state board of medical examiners to get them to investigate... That's easier than you think
Send a written records request certified mail, by law they have 30 days to send you everything you request, include an unredacted audit trail, this will show everything that is "edited", added or removed...
Don't let them get away with that. Proper documentation is a legal requirement.
I've worked in a couple hospitals & several nursing homes, I know for a fact when there's an inspection & especially a death in NH records/documention are doctored or rewritten. It's shameful. They are afraid of lawsuits on wrongful deaths. I'm retired after 31 yrs as an LPN, I.V. Nurse; I've seen much in those 30 yrs.
@@dmariewalker6880 With electronic recording today, they can't just delete or change things undetected. You can ask for an audit trail that will show every time a record is "edited" or deleted.
But yes, this is a big problem, and the reason doctors won't let you record your visits.
I learned a lot! I agree with everything you said!! I donated to the anesthesiologist Foundation on new years, I really enjoy donating to the anesthesiologist Foundation, since it was hard for me to go to college because of my cerebral palsy, I really wanted to be a anesthesiologist !! My MRI went good on Dec 23, I had a great anesthesiologist, he was hilarious, he told me he had a Tesla, i told him I
donate to the anesthesiologist Foundation that awesome I donate to the anesthesiologist Foundation
I was given a hip replacement due to a fall. I was 70 years old. When it was all over My left leg came out almost an inch shorter than my other leg. Before the operation both legs for the most part were the same length. When I spoke to the doctor at my after surgery and was ignored. I had several after surgery and still never received any answers they just continued to ignore me. So now I am 73 years old and nearly everyday I swear out loud..."I hate that doctor"and I will continue to say it until the day I die. Because I have had to buy lifts for my shoe and my husband made a special sole addition to my favorite shoes so I could still wear them. Because my leg is an inch shorter on one leg only. And without making up the difference somehow I can not keep my balance. I also can not walk barefoot anymore and I used to love to be barefooted all my life until now. "I hate that doctor"🤷🏼♀️😢
During the birth of my 2nd child, I had a teaching hosp experience. My admitting dr was who I had previously seen and was comfortable with. At 28 wks gestation it was a very active labor. Chief of obstetrics informed me he would be taking over. He did not ask. He had performed an episiotmy when I did not have one with my first child. The placenta did not descend after just a few minutes. The chief pulled on the umbilical cord with great pain i screamed. I then began to hemorrage. I received 2 pints of blood. The resident who was closing me up remarked that he was giving me a few extra stitches to make my husband happy. In the delivery room was 11 residents and interns that no one asked me about.
My GOD
I have been very lucky with my surgeries I guess. At 32 I went in to have some of my reproductive organs removed. I had to sign a form saying if things were worse than thought, I gave permission for a hysterectomy. Unfortunately that’s what happened but my dr was so cool, she took a video of my insides to show me how bad things really were…I am sure she did it to protect her but nonetheless.
This is horrible and unprofessional. No doctor should do a surgical favor on anyone with out their consent. Just do what's necessary and do that well. This makes you wonder what else he dis that wasn't authorized 💞💞..
Exactly
Labial reduction sounds like surgery that is nearly always unnecessary. And painful.
I was thinking the same thing.
Some women have very large and/or long labia that rub on their clothes and are obvious and uncomfortable in pants/jeans.
The consent forms these days allow surgeons to do almost anything they feel like doing if “they believe” it needs to be done. You don’t get to take the consent form home to look it over.
I was botched many years ago because of what a surgeon did to me and I never consented to it. I had a lawsuit but I lost because my lawyer never entered my expert witness on time. Later, I was contacted by the prosecutor’s office stating I could sue both the surgeon and my lawyer for negligence. By the way, the surgeon was in charge of medical malpractice at a prestigious hospital. My case made the legal intelligencer. Long story short, I did not have the funds to pursue a new case but karma came back to the surgeon since he had a very painful cancer and died a few years later. I don’t know about the lawyer though. I still suffer from ptsd from what happened to me.
People have a right to demand that any forms be provided perhaps a week before any elective surgery. Any form only provided on the day of the surgery should be legitimate grounds to reschedule the surgery after you, your lawyer, and your advocate have read through and perhaps amended the form.
I had a C section and my gp did the cutting and not the surgeon. After the surgery i was in tremendous pain from the epidural i could only lay in one position. After a few days i was allowed to go home, still in a lot of pain and discomfort. Years later i was having an ultrasound on my bladder because of issues i was experiencing when the examiner asked me when did i have surgery on my bladder, i responded, i have never had bladder surgery. Now all the dots connected ... my gp cut too deep doing the incission for my C section and nobody told me of the error. I still have problems to this day 30 years later.
this is why I would always always always go to a large reputable hospital, never ever go to private practice because not only will there be more eyes and ears to speak up but also all medical professionals on staff will have their peers around to challenge what they think is wrong or right in the literature or procedures or how to go about treatment etc and they can be supporting certain avenues of care in good faith but we always need others around us in the same profession to challenge our ideas as another perspective/they may know or remember things from their medical training or experience that the single doctor running a facility doesnt.
One report stated the reduction was the extra done. Absolutely horrendous.
Had urinary surgery and dr asked on way to or if I wanted this procedure. I agreed, but wish I had time to research it...worst decision of my life
I don't care what portion of her anatomy was operated on; the "extra surgery" was a horrible violation, as were many of the cases represented in this comment section. What can we do to put morals, ethics and professionalism back into medical care??
When in college, I had to take Medical Law and Ethics, as I'm sure you did. Without question, this was a violation of ethics.
I would go to a different surgeon to fix the problems. The physician will pay for my corrective surgery and anything needed for the new surgery (medications, follow-up visits, more procedures if needed, psychological visits if needed, etc). Have his license revoked for his lifetime. Possibly, monetary compensation. Also, the physician must sign my official consent form to protect me as the patient. "Tit for tat".
Love your videos doctor. I do nurse anesthesia in Texas and on some consents is the phrase and indicated procedures which I have seen some surgeons take advantage of that clause. But usually the surgeon talks with the person who is with the patient.
Thank you for educating us on this topic. I wish I was I had this knowledge before I had my first surgery. If I ever need surgery again. I will be asking all the questions u suggested!
We need to be and have advocates who can be on watch for our rights and needs. IMO a patient advocate should be assigned every patient.
The patient(client) can and should select either a friend or other informed outsider to scrub in on the procedure. That person should be someone from outside the local medical community.
When I delivered my daughter, I tore a bit...I had asked him to cut me before I tore and he said he didn't think I would need to be cut... well after I tore he was sewing me up and told my husband he put in a few extra stitches for him...I was like...wtf? I was already pretty tight even though she was my 3rd child...i couldn't sit right after that and sex was extremely painful afterwards.
Yes. And he’s a man, he is doing what best for another man not his patient.
malpractice
Extra stitches should be discussed with the woman and preferably the couple. It should definitely be their decision!
They rerouted my intestines and left me with 70 percent of my stomach removed. Also I was given the Vovid vaccine unaware and severely vax injured now disabled. My elderly relative gave phone consent as I was unaware and unresponsive. Now they refuse part of the med records. What can I legally do ?
Does anyone still trust doctors?
I have heard of it and I would sue if I knew they did it to me.
I hope she sues him into oblivion. File criminal assault charges for something she did not consent to
The laws really need to be rewritten so all parties involved r protected so no malpractice suits ever happen!
I am of 2 minds about medical residents and trainees doing procedures. They don't seem to be well-supervised by the attending physician as they are supposed to be.
I must live in a bubble. In 25+ surgeries across 3 states, I’m treated with respect, kindness, and caring- every time! Maybe it’s the gratitude I express, or my ready smile, but there’s always mutual respect. ❤
The patient's behavior should have zero effect on the ethics and professionalism of a medical team. Zero. No effect. And I'm a very cooperative but self advocating patient. Practitioners love me.
You live in la la land
27:27 I have only seen that on one of my Surgery consent forms. I asked nothing, but I wrote that I do not agree and this must not be done and crossed it off of their list. They said they understood and they claimed to not have done it. I don’t know whether they did or didn’t. Maybe I need to start putting a listening device in my hair before surgery!
Clear, concise and HELPFUL as always! Thank you.
I had my bladder removed and woke up to find to my vagina had been removed too because it was so diseased ! And had been reconstructed , yes I can say it was a shock , however what can you say ! Not a lot , my vagina and bladder were so diseased and were removed as they were so stuck together that no other way was possible ! So what way can you do apart from carrying on , my surgeon did ring my husband when it happened and gave him the options but what options do we have ? When I awoke in ITU it was explained to me two days later it was a shock ! UK LAW I had a mitrofanoff urinary diversion
I had my son at a teaching hospital in Seattle, emergency C-section . I wasn't unconscious and when the nurse came in to shave me for surgery there was about 7 people behind her watching. When I asked who are all these people? She told me students .
I was in a lot of pain and embarrassed for about 2 seconds. Thank Godess they had already taken my glasses off of me ,so I couldn't actually make eye contact with anyone 😅😅😅
You should know that anytime you are in a teaching hospital, YOU are definitely consenting to be the subject of having many people learn from your condition, whatever that condition is.
I was having an 'intimate' procedure in the doctor's office when, as the doc entered the room, he had a gaggle of med students right behind him. My doc did ask if it was ok if they observed. I told him 'no'. Maybe some OTHER procedure, but his one, NOPE.
@@catbee1452I had the same thing happen to me about 45 years ago. However I wasn’t even asked if it was ok it just happened as if It wasn’t a choice I had.
When I was 16, I went to a male gynecologist for birth control. He gave me a pelvic exam and a rectal exam. I had no idea that he had no reason to give me rectal exam let alone the pelvic. He wore a gold superman medallion.
Ugh
vulnerable is expected - that's different from dignity. I have not had any experience with pelvic exams under anesthesia
Ms. Shields has already been through postpartum depression and shaming about that. Nobody should be violated the way she was, but this is definitely adding insult to injury for her. It also shows that it doesn't matter "who you are," you're vulnerable to exploitation on the table. I hope she sues the crap out of them.
Imagine denying 99 patients of life saving care because 1 person might die in the procedure? That's what happens to chronic pain patients daily! Let's push them to seek illegal substances or to un a live themselves to alleviate their pain bc of 1 persons choice to get their fix from a dr rather than a de al er
Your videos are always so enlightening, thank you.
My heart goes out to Brooke and so much respect for her bravery to speak out. Her mom exploited her when she was underage (allowed nude pics, etc), a gross cult leader tried to shame and humiliate her postpartum depression, and now this.
Surgeons deciding what other men would prefer with our lady parts then performing the procedures without our consent is just insane.
My doctor always ask me if it’s okay . I let them check me because they have to learn but was never under anything
Dr. Kaveh, Would you please offer guidance regarding a hip fracture during surgery. The orthopedic surgeon apologized. He said he has done over five hundred arthroplastic hip replacements, and I was the first to get a hip fracture. This is the end of your podcast. Please advise. Thank you.
I literally had to write down my understanding of exactly what my surgery was to be and where on my body on the consent form and then sign it when I had my ankle fusion in April of 2024. And I was given the carbon copy of it. That's in southern Indiana.
Thankfully 6all my surgeries consent forms are signed before entering hospital. Just prior to any meds pror to entering theatre I am asked if it was my signature.
I never give permission for a blood transfusion in theatre especially with no safeguards against receiving C*19 vax blood as I haven't had any of the C*19 jabs. I have been told by orthopaedic surgeons that blood loss is collected, filtered and returned to my body. My first time needing a transfusion came after surgery, so I was able to refuse and instead went on iron tabletd. Yes it knocked me around, taking up to six months before recovering from blood loss. In todays medical world, I would still take the same action. I understand that in life or death situations it's a different story. I have done autologous donations on three occassions and stronglt recommend this path, especially following C*19 vax jabs.
Good point!
OMG😮!! Not only would it be painful - it was so wrong. She should not be ashamed.
He says “Brooke Jenkins” at one point, is it Brooke Jenkins or Brooke Shields?
Shields
Yep, purposely hurt 99 people to keep the 1 person from harming themselves. Complete opposite of any other process!
This is eye opening! Thank you
I have an issue that makes it very difficult for me to ask those questions on the day of the surgery. My throat gets very dry very quickly (my uvula doesn't produce a normal amount of mucus, so I normally have a water bottle with me), and that makes me exceedingly reluctant to talk at all, though normally I'm full of medical questions. Being deprived of the ability to drink water produces not only discomfort but actual fear. I just want to get the surgery over with, and so I would be likely to skim a consent form and sign it more quickly than I normally would.
I've never heard of a pelvic exam under anesthesia. Maybe under some emergency procedure.
It's actually very common, especially in teaching hospitals.
@@awifeinterrupted and legal under the 'assumption' that you're in a training hospital and 'you should know' aka informed consent. Some states in America have made it illegal, but you still have to opt out, and that's hidden somewhere in the small print.
Yes, extremely common in teaching hospitals. It should not be allowed without the patient's permission prior to anesthesia.
When I had a hysterectomy and because I was only 27 and small, they did a bikini cut across my lower abdominal area and it was done by a 1 1/2 year intern so she cut it to low and it severed the tindents muscles etc and I've had a issue with a pocket of a tummy 😢and I couldn't do anything about it 😢😢
I had a C-section with first baby, and have the same problem. Not sure there's a way of avoiding it. I refused future C-sections (for additional reasons) and had the other two babies VBAC.
How do you deal with it if the surgeon says the trainee will be doing the part(s) of the procedure that they are qualified for, but you’ve never met them and you don’t know what they’ll be doing before pre-op introductions, and you only want your surgeon doing the really important parts? Do they really get to just refuse to do your surgery?
The problem is we really have no recourse as the patient despite what the consent form say if you don't have the money for an attorney afterwards which if you don't have the money for an attorney you really shouldn't be having elective surgery in my opinion. What's worse is the medical boards and review boards don't hold them accountable when the complaints are made and completely founded in a timely manner, before they operate again. And worse than that they want to go over home instructions when still under the influence of anesthesia and then you call back with a problem or a question and they're rude and they tell you that they already went over it when you came out post-op and that's just unacceptable.
I had a hysterectomy leaving ovaries and taking uterus and cervix. I found out 16 yrs later, that the surgeon took out one of my ovaries. Damn
I had rhinoplasty to repair a deviated septum, and my sinus was crushed. When I breathed through my noe, it felt like cold air was blown into my head. He explained the procedure. However, during the procedure, he decided to "reduce my turbinates" to open my airway! So, now my head feels like a wind tunnei of cold air. Turbinates filter particles fom going further into your sinus or lungs. They also WARM THE AIR YOU BREATH BEFORE IT GOES FURTHER! He did not listen to me at all. I tried to find a lawyer, but he is a professor at a major university teaching hospital, and they said they wouldn't take my case.
That's horrible! I swear too many of these "prestigious" docs are essentially untouchable. Sinus and nasal procedures are nothing to take casually as an "extra." Do you have more sinus infections now?
My husband had his turbinates removed also during a 'sinus' surgery. Made his nose run almost non-stop.
True story. OR Nurse comes to get me for surgery. I told her I did not sign the consent for surgery. She kept insisting I did. So back and forth it went. Finally I said Check the chart. She starts screaming You did not sign consent.....runs into OR. Why don't they listen to the patients?
That's what the doctor did to me, a 74 year old woman when I had bladder surgery. I did not need the "boyfriend stitch" I am 74 years old and my husband has ed problems anyway. I have no intention of getting a boyfriend. I would rather have had that part left the way it was. I only needed a bladder tuck.
I never consent to having students participate in my surgeries. I worked in a teaching hospital and so many times the surgeon greeted the patient and then disappeared and the students did the procedure. Sometimes the resident would initiate or close but too often, the resident did the actual surgery. This generation of surgeons have robotics and simulators. It is one thing to spell out just what part the student will do and quite another to do most of the surgery while the surgeon is on his way to the golf course.
It used to be acceptable, immediately after childbirth, for the Doctor to insert a contraceptive coil. Sure there was a brief discussion about whether, or not you were planning to breastfeed, and whether you were planning to use the pill. There was very little information given, and this was within 5 minutes of delivery. So my head wasn't in the right place. For a year I had terrible pain and other health problems. I went to another doctor who treated me like an idiot. This was in the early 80s. I tried to draw a picture of the device that had been put inside me. I was drawing a lippes loop. The second Doctor insisted that I was wrong, because that style of IUD had been known to be dangerous since the 1930s. It could have perforated my womb or killed me. And yes! When I did finally get this removed, this was exactly what the first doctor had used, after presumably finding some outdated stock and a means of saving money. The arrogance of doing that to another human being beggars belief.
Back in early 80s, a coworker, after she delivered her 3rd baby, and while still in hospital; the doctor offered to tie her tubes. And she agreed. Not sure she gave much thought to it at the time. I think that doctor tricked her into consent.
Should we have sue the doctor for lying about my colon and he never would tell what happen to my throat . I had full life I have alotof heath problems. But I could swallow fine before surgery now on feeding tube.but the doctor fixed the colon the best he could .That doctor never wanted me to come back after surgery I had a lot of surgery I always had to go back my stomach was left open…..the home health niurse said if u don’t go back surgery would not be payed for .. thanks to that home health nurse
I’d love it if you did a video on how to choose a center for ketamine treatment. I’d like to do psilocybin therapy for ptsd but it’s not legal in my state. There is a ketamine treatment practice about 80 miles away, but the staff is just 3 nurse anesthetists and no one with any psychiatric or psychology training, so it just looked like a scam to me. They do treatments for chronic pain and psychiatric issues, but no pain specialist on staff either. I might give it a try, but this group looks dodgy and they’re the only ones in my state doing ketamine treatment.
Absolutely inexcusable!
I had my cancer treatment at a teaching hospital. What bothered me was the “kids” who were pushing to the OR put me out while the gurney was moving.
However, I know they probably were allowed to insert speculums into me once they got to the OR. It’s the same teaching hospital where my parents and sister trained.
Better to do your first one with someone who is under. You certainly would freak out if it was a kid’s first time while you’re awake.
Doctors have to learn.
@@sarahferrell5458not without permission. Their first lesson should be informed consent
I had a rectocele repair done. The dr. also did a 'lift to make me tighter for the pleasure of my husband'. I did not heal properly for some time. I reported him to the hospital and they said he did nothing wrong. It destroyed my intimacy with my husband.
I have never heard of a ketamine clinic. What is it for? I am a 76 yr old female. Retired RN. I know things change but it seems like the medical field is not so good now. Since my family doctor left where I live, I have been having a hard time finding a new one. I live in Arizona. I have watched your videos a couple of times. You seem like a caring Anesthesiologist. My experience has been with Nurse Anesthetists. I was fortunate to have worked with really good and caring ones. Being from the health care profession I have great anxiety going to a Doctor for any reason. All of the Doctors I use to know are now retired or deceased. It helps to know who the good and bad doctors are and I have lost touch with that perk.
What if we scan the consent with our smartphone?

Dr.Kaveh, thank you,for your honest, straight forward, information regarding this topic.I would not know what your age is,tho,I thought you could be in your thirties. Thank you,Dr.Kaveh, for Being the person You ARE. Sincerely,Nancy.
I’ve never heard of a pelvic
Exam under Anesthesia
My surgery team decided to take the whole uterus out vs leaving it in after taking cancer out of ovary and part of uterus. It was 60-40 to take it all because that is what I was expected and wanted. I would have been very upset if it was still there when I woke up.
10 minutes in… And you’ve basically said one thing (numerous times)
A plastic surgeon operating in his own surgery center might not have as many eyeballs on him.
Ok. We get it.
Please give guidelines for finding a ketamine clinic
He has a wonderful ketamine clinic in San Francisco
I need shoulder surgery for detached rotators. Not happening, ever. I’m not in pain, so I’m not having that done.
My husband gets mad at me keep saying he going to throw my meds away … calling me druggy. I have 9 health problems
Word of advice patients also start asking for a hard copy paper of everything you sign because they can change the computer and the tablets. Also be forewarned that when you pick cosmetic surgery or plastic surgery and it's an option not a necessity you get stuck with what you get I'm not saying that it's right. To me it's so unethical but good luck finding an attorney willing to take a small malpractice suit especially since they all make you sign a non sue paper before you can even speak with the doctor. At least that's how Florida is and they here have no malpractice insurance for the most part. It's certainly not required here in the state of Florida 😢
Last year, I had steroid injections in both hips. Weeks before the procedure the doctor spoke in detail how it was to be preformed. I assumed he was going to insert the needles through the sides of my hips because that was the only area he would point to on my body. When I went into the OR a week later, they began to prep me by exposing my groin area to disinfect it. I was shocked and so embarrassed that I wanted to disappear or get up and run out of the OR. ( I'm a 68 year old plus size woman.) I kept trying to pull the sheet back over me out of shame until I finally gave up and let them do their jobs. No one told me they would go through the front of my hips in the pelvic area to reach my joints. I wanted to cry. It made me have a flashback of when I was sexually assaulted on a exam table by a doctor years ago. And my doctor that preformed the procedure reminded me of this sexual predator in appearance only. Although the assault happened over 40 years ago, I never got over it. I guess I was traumatized.
30:00 there are ketamine clinics inARKANSAS. There are so many more in bigger states.
