There was constant traffic driving by their home, media was camped out there, their home had been stripped of many items during the search warrants (none of which had any evidentiary value), radio DJs called out to him with bullhorns while airing their show live from in front of his house, his house had been broken into, and the volunteer center and any effort to find Laci alive had ended in Modesto. "Scott's trips to southern California are confirmed by police surveillance and the testimony of Officer Skultety. Not only were the police aware that Scott was in southern California, but there is no testimony that Scott ever attempted to flee. Scott not only made multiple trips to San Diego, he also went to Guadalajara, Mexico and came back on a business trip in early February. Scott discovers the $10,000 withdrawal from his bank account. He sees the withdrawal ticket signed by his mom and calls her. Jackie then goes to Washington Mutual on April 17th and withdraws $10,000 cash out of her account. She gives the money to Scott that day to replace the money she took out of his account. She paid him in cash so that the bank would not put a hold on the funds. Scott now has roughly $14,400 in cash. Scott is arrested the morning of April 18th . He had yet to deposit the money his mother had given him the day before. Scott also had some "foreign currency" with him when he was arrested. The most likely reason for those lies is he’s guilty. I can’t believe his white knight excuse that if it came out that he had an affair it would take the focus off of Laci. It would put the focus on him is what it would do, and it did. Adultery is a leading motive for spousal homicide. It would be very rare to find that there is an affair of that that intensity, where he had talked about leaving his wife and losing his wife before he “lost” her, and have it be unrelated to the crime. Furthermore, Dr Charles March testified there is no way that Scott and Laci Peterson's unborn baby could have died any earlier than Dec. 29, 2002. Dr Allison Galloway determined the baby could have even been alive as far along as Jan 14th. -Conner was found above the high tide line and water break. -The baby's left ear was permanently flattened against the head and a rectangular piece of material was over his ear. -Plastic wrap knotted around his neck that had to be cut off, not far from a plastic bag which was never tested. -The criminologist and medical examiner, both concluded that the twine could not have wrapped around Conner’s neck accidentally. Dr. Cyril Wecht noted, "never in a million years." -Laci had a missing neck that is not consistent with any known disarticulation in aqueous environments. -Laci's uterus was at least 10 cm (3.9") smaller than it should have been, explaining why the incision to remove Conner was not visible on her body, and the injured 9th rib, postmortem injury is in the same location where such an incision would have been made.

On the day he said that to Amber he bought a secret boat no one knew about. He also made five anchors, four of which were never recovered. The one that they did have, didn't match the cement in the driveway, which is where Scott said he'd used the rest of the missing cement, proven in court. Laci didn't know about, nor had she ever been in the boat, yet, a couple of Lacis hairs were found, wound tightly in some pliers. Agreed to take a lie detector test, but backed out after his father advised him not to. Upon returning home, he immediately washed his clothes, ate, and took shower. After getting out of shower, instead of just calling Lacis cell phone one more time, he calls her mom and tells her Laci is missing. He told, at least, three people he'd been playing golf, before finally sticking to the fishing story. Speaking of fishing, Scott told the detectives that going fishing that morning had been a last minute decision. But, this was an obvious lie because he'd purchased a two-day fishing license dated for the 23rd & 24th, a few days before. Or, maybe he's just psychic, and predicted he'd be making that "last minute" decision! When he took the detectives to his warehouse, he led them to believe the power was out, when the truth was, only his office in the warehouse had lighting, but the warehouse, itself, was only lit by a sky light during the day. On the night of Dec 24th, the day Laci went missing, Scott was already inquiring about grief counceling for Lacis family. Really??? She's not even yet gone a full 24hrs! I've never heard of anyone doing that over someone being missing for only a few hours! It just seems like Scott knew she wasn't coming home. The next day, Scott called the detectives asking them if they'd be bringing in and using cadaver dogs. She hadn't even been gone a full 24hours, and, he is inquiring about cadaver dogs! This was a huge red flag to the detectives working the case! He sold Lacis car while still missing, before her body was found. And, inquired about selling their home before she was ever found too! He even wanted to sell it with all their furniture! Supposedly, he doesn't know if Laci is dead or alive, but has no problem selling her car and their home, with all their stuff in it? He told lie after lie after lie. Of course the big, well known lie was when he called Amber from Lacis vigil. Right before, during, or after just doesn't matter, at all! His mistress should've been the last thing on his mind at any moment during that event. When he did his Diane Sawyer interview, he was already refering to Laci in past tense. Another huge red flag! It was well known he didn't want children, and wasn't thrilled about Laci being pregnate. Even telling his sister-in-law he was hoping for infertility. Laci telling her mom Scott wouldn't touch her belly to feel baby kicking. He didn't participate in the searches for Laci, opting instead, to secretly go to the bay, park his car, and just watch the search that was going on in the bay. Instead of showing grief about his wife being missing he, instead chose to flirt with his sisters baby sitter. Offering to make her drinks he called, "flirtinis". The baby sitter was so weirded out by Scott, she left! In one of the recorded calls with Amber, Scott tells her that if the police find any evidence, he'd lose his freedom. Not a confession, but close enough! Speaking of phone calls, authorities secretly wire tapped Scott's phone calls. They're even more telling than the calls with Amber for just how deceitful Scott truly is! When the due date, of the birth of his missing baby came around, he didn't have a gathering of friends & family to remember Laci & Conner. No, he didn't do anything at all to remember them. And, that would've been fine, if he chose to do nothing, no problem. But, he DID choose to do something. Since that day was also Ambers Bday, Scott chose to celebrate it, by hiding a bag of jewelry and a CD, etc for Amber to pick up. It seems it was Amber he wanted to remember & honor, not his missing wife & baby. When a body of a baby washed ashore, and then a body of a woman who had been pregnant washed ashore shortly after, within just a couple of miles from where he says he was 'fishing', he never even called anyone about it to see if it was Laci. About a week or so later, he was caught trying to flee with just about everything he owned, BUT his golf clubs and golf shoes. I add that he didn't have his clubs & shoes because Scott tried telling the cops that he was just going to play golf, not flee! However, the list of things he had with him is just as long, if not longer than my list here of the evidence! I could go on & on! I know there's more, but I'm drawing a blank on the rest. Can anyone else think of anything I've forgotten? Okay so, one or two things on this list would be maybe a coincidence. three or four things --- sketchy, but okay. At the vigil in the park, there is a very pregnant woman right there. There are other women that are pregnant and golden retrievers are like the most common breed of dog in families. The cops ruled it out because they found the woman that fit the description people gave

Harshman sees the woman’s face when she is up against the fence -- that’s what he is concentrating on -- and he sees a scared look on her face. The man then forces the woman into a tan van, and someone else is inside the vehicle. Harshman's description of the van is similar to Jackson's description of the van used in the commission of the Medina burglary. He describes the van as an older white van with three windows and a tan stripe on the side, approximately a foot wide. The woman Harshman sees has dark hair and is wearing black pants and a red shirt (perhaps a jacket?). The man he sees with the pregnant woman is a white male, in his forties, and is wearing a ball cap. After driving past this scene, Harshman is so upset that he turns around and goes back to the spot, hoping to find the van still there and hoping to get more information about the license plate number, but the van is gone.

The most important thing, I think, of that, that I really want to make clear to you is, you did not hear a single witness who said they saw Laci Peterson walking in the neighborhood, or on Covena, or in the park on December 24th. You did not hear from this stand a single witness who said that. You heard officers testify that people reported to that. You can't consider that for the truth, not a single bit of it. You know what's an interesting point, Detective Brocchini was on the stand. He was asked about Chris Van Zandt, a man who had called in and reported that he saw Laci Peterson down in the park on the December 24th, and it came in as hearsay. Not offered for the truth, so you can't consider it for that. And that was the testimony. That was it. Yeah, this guy said he saw her, called in. Okay. Well, remember we brought in Chris Van Zandt, the actual witness. We brought him in and put him on the stand. Okay, fine. Let's hear what he has to say. Remember what he told you? He said, I know for sure I didn't see Laci Peterson on the 24th in the park that day. So the only witness who, the only person who called in to the police and said they saw Laci Peterson that came in and testified, told you without any doubt in his mind it wasn't Laci Peterson that he saw that day. That's the only evidence you can consider for its truth. None of these other ones. Remember the defense even put an exhibit in. I might have it over there. That's all right. I'll move on. The defense put an exhibit in. I wrote it in my notes here. D7Q. It was a map of these alleged witness sightings. And I think it included Tony Freitas, and Grace Wolf, and Homer Maldonado. I'm pretty sure those were the people. If I'm wrong, just look at the testimony, look at the map itself. Not a single one came in to testify. Why do you think that was? This is a very experienced defense team. They are very good lawyers. They obviously know how to prove facts if they want to. Why do you think they didn't bring in a single witness to testify that they saw Laci Peterson walking that day? Remember, you heard a bunch of evidence about Tom Harshman. Remember that whole thing with the fence, and the woman urinating, and the van, and all that crazy story? How come Tom Harshman didn't get up here on the stand? Let's hear what he has to say if that's true. None of those people came in and testified. You know why? You can assume because that what they were going to say was not credible, that's why. Remember Investigator Bertalotto was asked about a guy named Chris Clark. Remember Chris Clark? He didn't contact the police until April, 2004. He didn't know Laci Peterson. He never spoke to her. He said he saw her while he was working in the neighborhood. He said he knew this from his time in treatment for substance abuse. His problems obviously continued, because in 2004 he was under house arrest for his third DUI. I'm not beating up on anybody with a substance abuse problem. Far from it. But it's not right to ask about hearsay evidence in this trial and not put this witness on the stand. How come this witness wasn't called to the stand? The investigator testified just back in April he went out to his house and talked to him. He is certainly available. Why didn't we hear from him? We didn't hear from him because obviously his story was not credible, that's why.
I personally think that a lot of the witnesses who saw Laci that day and did call in, decided to change their stories based on the medias portrayal of the case. Scott was convicted long before he had his day in court. I’m not saying he’s innocent, but I believe the police dept and detectives made a narrative and ran with it.
First of all. You don't understand the definition of hearsay. Second thing. Almost all of the witnesses were ignored by the MPD. They only called back. I'm just going to paste what it says on the pwc site because I'm a tired of explaining it to you, Sophie. Pwc site "the area within a 1 mile radius of Laci’s house there were 26 sightings. Within a 3 mile radius, there were an additional 7. This is a total of 33. What possible excuse did MPD have for not investigating each and every one of these sightings to determine exactly what was seen by each of the witnesses? Grogan excuses the MPD failure to follow up on tips by citing Karen Servas’ 10:18 timeline for finding McK. Even if Karen Servas’ timeline were accurate, which it is not, MPD did not have information about her reinvented timeline until January 3. The detectives did nothing to confirm that her time source was valid. Grogan also says tips were not followed up because phone records indicate that Scott was still in his neighborhood at 10:08. This theory did not take shape until shortly before trial. Two prosecution witnesses stated that cell phone records were not designed to be used to identify location. Grogan also uses the excuse that tips were not investigated because witnesses reported Laci wearing black pants and her body was found wearing tan pants. MPD did not have this information until mid-April when Laci’s body was found. Then Grogan indicates that sightings outside of the park were discounted because Laci was planning to walk in the park. This is blatantly false and Grogan knew it. Grogan had been present on December 26 when Chris Boyer interviewed Scott Peterson at his home. Scott clearly stated that Laci sometimes walked in the neighborhood. He told Boyer, in Grogan’s presence that Laci had walked on Sunday, December 22, in the neighborhood."
Chris Clark. Working for a family living on Encina, the man saw Laci walking McKenzie on Encina at least 5 times after October 15. He also saw the two of them in the park, and said one of the family members would talk to Laci when she waked McKenzie. He last saw Laci and McKenzie walking two weeks before Christmas. He said he knew it was Laci he had seen because on the night of the 24th he and the family he worked for on Encina brought coffee to the Peterson house.

Now, is it a fair statement that this gentleman called after reading this story in the Modesto Bee that prosecutors intended to present evidence Laci was not walking her dog during the two months preceding her going missing? BERTALOTTO: Yes. . . . BERTALOTTO: I think he called the DA's office and he was forwarded to my desk and I got a voice mail, returned his call, and he had mentioned he had seen Laci walking in the neighborhood. And I says Well, why don't we schedule an interview, and I went to his house. GERAGOS: Okay. And the reason that he called is because he said he read an article that MPD was intending to present evidence that Laci wasn't walking, right? DISTASO: Objection, your Honor. It's not relevant. JUDGE: I don't know why he called. I don't know how he can tell why this person called. GERAGOS: Because he told him. JUDGE: Well, that's different. GERAGOS: Isn't that what Clark told you? DISTASO: It's still, it's not relevant. I mean, GERAGOS: It's clearly DISTASO: I don't have a problem with the information. Get it out JUDGE: It's relevant to the extent if this is what started this call. There's calls, you said you had 10,000 tips, so you don't know who motivates people to call, but this person read about it in the newspaper, apparently, and he decided to call. GERAGOS: Is that, is that a fair statement that I just asked you? That he said - Well, n he said that he had read in the Modesto Bee the prosecutors intended to present evidence that Laci Peterson was not walking her dog within the two minutes, two months that preceded her going missing, correct? BERTALOTTO: That’s correct. GERAGOS: He also said that he worked, worked in the neighborhood and showed up at His boss's house in the morning where they loaded up supplies to go to work, correct? GERAGOS: You wanted to follow-up on this because obviously this was something that had not been followed up on, at least by Modesto PD, correct? BERTALOTTO: Well, this was the first time he had ever made contact with anybody, so I doubt anybody had contacted him about this. GERAGOS: Okay. Well, it was also the first time that he was aware that somebody was going along with this theory that Laci had not walked in the last two months, right? DISTASO: Objection, your Honor. BERTALOTTO: Right. JUDGE: Sustained. DISTASO: No, it's argumentative and calling for facts JUDGE: I sustained the objection. GERAGOS: Just keep arguing. He said that, that when you went out to meet him, he said starting on October 15th he had seen Laci walking her dog approximately five times, right? BERTALOTTO: That’s correct. GERAGOS: And he said he would go outside the Williams's residence preparing to go to work sometime between 8:00 and 8:30 a.m. and she would be walking her dog, right? BERTALOTTO: Generally? Police ignored Harshman's tip. Tom Harshman, who lived in Modesto, saw something that really concerned him near the corner of Scenic Drive and Claus Road as he was driving with Elizabeth Harshman between 2 and 4 p.m. on the afternoon of December 24. He saw a young pregnant woman being forced into a van. After driving past this scene, Harshman was so upset that he turned around and went back to the spot hoping to find the van still there and hoping to get more information about the license plate number. Then approximately two months later a New York City police detective says, I have talked to, presumably, Harshman's wife who may have witnessed the incident, correct? GROGAN: Yes. He got the information from a friend of Miss Harshman's, Mr. Harshman's wife, I believe. GERAGOS: Okay. And specifically you contacted him on May 18th, 2004, correct? GROGAN: Yes. GERAGOS: And he, when you contacted him, he told you that the same day he called into the police department. You put it down at 12:28, right? GROGAN: Yes, based on that tip. GERAGOS: I don't think you ever saw this. I'm just going to show this to you. When I went through the tip lines, at 14789, it looks like somebody called in, but the name that was written down was Thomas Harsh. Do you see that? GROGAN: I see it. GERAGOS: Okay. Caller given to Detective Holmes. You were not aware that Harsh had indicated that it was three or four days prior to the 28th when he had actually phoned in; isn't that correct? This is the first time that you have seen that, because when the caller, whoever took down the information, they just wrote Harsh as opposed to Harshman, correct? GROGAN: Correct. GERAGOS: Okay. And he said that he, specifically, on the same day that he had called in, he had seen a van parked on the south side of Scenic, west of Claus, which he described as a 70s, American-made model, beige in color, correct? GROGAN: Is that the tip that you are reading from top? GERAGOS: No. I'm at 4527. GROGAN: Yes.

Detective Brocchini was told about an eye witness who confirmed seeing Laci at the warehouse (where the boat was stored). When he heard about this witness in August of 2003, he purposely left it out of his police report. While under oath during the trial, he admitted to excising the information from his police report and acknowledged that he did not think it had been reported by any other officer. This woman later confirmed that Laci was at the warehouse on December 20, 2002. This situation confirmed that Scott was once again being truthful. It was Detective Brocchini who had been deceptive. Guy Miligi told police on January 4, 2003 that he and Scott had discussed purchasing a ski boat together prior to December. Jodi Miligi told police that Scott discussing a boat one to three weeks prior to Thanksgiving. Brian Ulrich told detectives on January 4, 2003 that Scott had been discussing buying a boat for over three months. Scott withdrew the $1400 from his joint checking account with Laci. Also, Scott did not try to hide his identity from Bruce or the DMV. Scott gave accurate information to Bruce including his home address. This information was filed with the DMV on 12-9-02. Another boat Scott looked at on December 8th was not registered with the DMV, so Scott decided not to purchase it. It was also the sellers request that Scott pay cash. Who specifically looks for and buys a registered boat to keep a boat a secret? BOAT REGISTRATION GERAGOS: But he also told you, I don't know, was it in that conversation or another one, that specifically it had been registered for a long time? Grogan excuses the MPD failure to follow up on tips by citing Karen Servas’ 10:18 timeline for finding McK. Even if Karen Servas’ timeline were accurate, which it is not, MPD did not have information about her reinvented timeline until January 3. The detectives did nothing to confirm that her time source was valid. Grogan also says tips were not followed up because phone records indicate that Scott was still in his neighborhood at 10:08. This theory did not take shape until shortly before trial. Two prosecution witnesses stated that cell phone records were not designed to be used to identify location. Grogan also uses the excuse that tips were not investigated because witnesses reported Laci wearing black pants and her body was found wearing tan pants. MPD did not have this information until mid-April when Laci’s body was found. Then Grogan indicates that sightings outside of the park were discounted because Laci was planning to walk in the park. This is blatantly false and Grogan knew it. Grogan had been present on December 26 when Chris Boyer interviewed Scott Peterson at his home. Scott clearly stated that Laci sometimes walked in the neighborhood. He told Boyer, in Grogan’s presence that Laci had walked on Sunday, December 22, in the neighborhood.

She often walked her dog in the neighborhood and at La Loma Park around that time but does not think she went on a walk on Dec. 24. *********** During his cross-examinations, Geragos pointed out that the women were hardly carbon copies of Laci in either habits or appearance. He noted that Lear's dog was a small Australian Shepherd with a black-and-white coat drastically different from Mackenzie's blond coat. I want to say from personal experience. I used to be very shy never wanted to be on TV or anything like that. But when I was fighting my case, and the press came and wanted an interview, and to talk about my case, I didnt want to speak to anyone, I didnt trust them. Then an authority figure told me, if I want people to listen to my case then I better swallow whatever anxiety I had about talking with the press. She said just be honest, and brave and talk about your case, and its OK to be emotional, because I was afraid of crying in front of people. I changed my whole life that day. If going on camara and talking about my case, could save my loved one, then who cares about my problems! with anxiety or whatever. I did the interview. Was honest, and emotional and intelligent. That press release wound up helping my case a lot because people could see how genuine I was and people called their representatives to do something about it, and I won the case in the end. Now I'm not shy anymore, and I would go to the press for help, its an important process of solving a case.

At the time these sightings were coming in, MPD still believed that Scott had left home around 9:30 a.m. and that Karen Servas had found McK around 10:30 a.m. Each and every one of these sightings should have been investigated thoroughly. MPD’s failure to do so is inexcusable.

The police didn’t even investigate any witness statements or even take them seriously. The only thing they investigated was Scott even before amber frey came into the story.
How would you know anything about the investigation and how it was handled? There were over 90 LE agencies that participated in this investigation including the FBI and the DOJ.

The burglars across the street said “We didn’t have anything to do with killing that pregnant lady.” there were a dozen other pregnant women That had been killed in the area. Laci was saying by multiple people walking her dog after the time investigators say she was killed. When forensics tested Connor’s bones using the correct method, The time of death was January 2. They did not check the mattress and the burned out van a couple of blocks away. Scott was charged with murder because he tried to stay away from the media harassing him, that’s also why he died his hair and carried cash and that he was a scumbag with the a side girl. Telling his girlfriend that he “lost his wife” is something a lot of married men probably tell other girls when they’re trying to pick them up in secret. It’s possible that he did it. It’s also very possible that he didn’t. The investigators didn’t look at concrete evidence.

America's Most wanted tip. Caller said he had a conversation with two men who were bragging about Laci’s murder. The first man was named. The second man was unnamed, but the tipster gave a description and knew where the second individual lived. It was reported “when they did it they thought it was going to be just another murder case . . . now it’s a big case all over TV and news . . . and they are blaming the husband and they are not getting any attention.” Caller went on to say that he knew John Doe lived with his mother; his mother has the same last name. The last name is worth mentioning because four days earlier, the Modesto Police had encountered Mother Doe. She was present at her neighbor’s home when police came looking for the Medina’s stolen property. There was a strong connection between the Doe family and burglar Steven Todd. Certainly, this would merit follow-up, especially since the AMW operator stated this caller was 100% sure. Unfortunately, the extent of their follow up was this: This tip was given to a Modesto police officer - the same officer that encountered Mother Doe four days earlier. This officer drove to John Doe’s house - which was one block away from where he had encountered Mother Doe four days earlier. John Doe was standing outside. The officer confirmed his identity and asked where he was on December 24th. John Doe said he was “locked up.” The officer called the jail and a deputy confirmed that John Doe had been in jail on the 24th, so the officer did not ask any other questions. Not one. But notice the tip did not say John Doe had murdered Laci, the tip just said “they did it.” It is not clear at all who “they” are. However, the officer asked no more questions of John Doe. The officer never asked John Doe why it would be reported that he was bragging about the murder of Laci Peterson; whether he knew anything about Laci’s whereabouts; or about his mother’s connection to the Medina burglary. It was later found that HE WAS NOT IN JAIL during December of 2002.

I remember when this was all that was in the news and they were still searching for her and had not yet arrested Scott , and I still don’t understand why this was as big of a story as it was and to a degree it still is . Sadly this type of crime happens from coast to coast and they don’t have near the coverage on those cases as they still cover in this case. Please don’t misunderstand what happened to Laci and her unborn child was unbelievably horrific and it still hurts to see these videos from back then but I’m just trying to understand what made this story so big ? The only thing I can think of is because it was Christmas Eve and everyone was gathered around the tv anyway.
I couldn't figure out is that why Scotts' brother was not with his wife backing up his own brother, but Scotts' sister-in-law is really determined to believe Scott is innocent. She's determined to get him released from prison, believing he's innocent but his brother is not seen on camera proving his brothers innocence. I find that to be very strange, cause you see a lot of her and not him. I wonder if he was involved or knows more what his brother did and is keeping his mouth shut also out of sight, out of mind. If he does know or is involved he's just as guilty as his brother Scott. Anne M lying about the Harshman tip. Tom Harshman, who lived in Modesto, was driving with Elizabeth Harshman between 2 and 4 p.m. on the afternoon of December 24. He saw a young pregnant woman being forced into a van. He turned around and went back to the spot hoping to find the van still there and hoping to get more information about the license plate number. But they were gone. 1) He called police (911 MPD) that same day. 2) Tried again December 28. 3) December 28, he also called the Laci tip line twice. His first call on this date was listed incorrectly under the name Harsh and was given Bates Stamp number 14789. The call was given to Detective Holmes. Harsh(man) said that he had called 3 or 4 days earlier on the day that he had seen a pregnant young woman being pushed into a van. There had been a man standing over her as she squatted to urinate with her back up against a chain-link fence. The man was described as 30’s, tall, thin, with ponytail, dirty blonde to gray hair, scrubby looking. When she finished, the woman was shepherded back to the driver’s door of the car, where another man’s arm was seen pulling her into the car. He said the young woman was wearing black pants and a red shirt. He said she had a scared look on her face." 4) Jan 3rd, he went to the Command Post in the park and relayed this to the officer on duty. Over 40,000 pages in the discovery and nothing about this report was in it. 5) February 2003, Harshman’s wife spoke to a relative of hers who lived in New York about the sighting of Laci Peterson near the corner of Scenic and Claus. Mrs. Harshman’s relative shared this story with an NYPD detective. This NYPD detective was so concerned that he contacted the MPD and spoke personally to Detective Grogan on February 14, 2003. What did Grogan do with the information? Nothing at all. 6) pre-trial hearings in May of 2004, DA Investigator Kevin Bertalotto noticed the Harshman tip and insisted that Grogan call Tom Harshman and speak to him personally. Grogan did this on May 18, 2004. An audiotape and a transcription of his conversation with Harshman to the defense on May 20, 11 days before the beginning of the trial.
I fail to see what's obvious. Her body was found nearly 4 months later. His alibi was public and there isn't a shred of evidence proving he put her where she was found. And he also said that, in his opinion, thirty pound of weights would not likely be enough to cause a female of that weight, especially wrapped in plastic causing additional buoyancy in the plastic to immediately go to the bottom, correct? GROGAN: Yes, that's one of the things he said. GERAGOS: And he said victim would likely have traveled with the currents for a considerable distance before any exposed weights could catch something on the bottom, or the current would allow the object to stay in one place long enough for the weights to begin to sink in the mud. On April 8, 2003, Jackie went to Bank of America to withdraw $10,000 from an old account she rarely used. She did not know her account number, so she gave them her social security number to look it up. Unbeknownst to Jackie, she was listed on Scott and Laci's checking account as well. (Jackie had opened that account with Scott in 1991. Scott added Laci when they were married and never removed his mother.) The bank gave Jackie $10,000 from Scott's checking account. The withdrawal receipt was entered as Exhibit D8Y1.
Jackie paid Scott $8000 cash for his equity in the Dodge pick up. She paid him cash so he could better negotiate while shopping for a car.
On April 12, 2003, Scott purchased a Mercedes from Michael Griffin. He paid him with 36 $100 bills. Scott had $4400 left of the $8000 his mother had given him.
Scott discovers the $10,000 withdrawal from his bank account. He sees the withdrawal ticket signed by his mom and calls her.
Jackie then goes to Washington Mutual on April 17th and withdraws $10,000 cash out of her account. She gives the money to Scott that day to replace the money she took out of his account. She paid him in cash so that the bank would not put a hold on the funds. Scott now has roughly $14,400 in cash.
Scott is arrested the morning of April 18th . He had yet to deposit the money his mother had given him the day before.
Scott also had some "foreign currency" with him when he was arrested. The 2 bills were photographed with other items and entered as People's Exhibit 293-29. One bill is worth 50 pesos and the other is worth 20 pesos. This is roughly worth $6.40 US. This is not an unreasonable amount of pocket change for someone who had recently returned from Mexico.

Furthermore, Dr Charles March testified there is no way that Scott and Laci Peterson's unborn baby could have died any earlier than Dec. 29, 2002. Dr Allison Galloway determined the baby could have even been alive as far along as Jan 14th.
-Conner was found above the high tide line and water break.
-The baby's left ear was permanently flattened against the head and a rectangular piece of material was over his ear.
-Plastic wrap knotted around his neck that had to be cut off, not far from a plastic bag which was never tested.

Scott tells Amber he lost his wife a couple of weeks before she went missing, and this would be his first Christmas without her.
On the day he said that to Amber he bought a secret boat no one knew about.
He also made five anchors, four of which were never recovered. The one that they did have, didn't match the cement in the driveway, which is where Scott said he'd used the rest of the missing cement, proven in court.
Laci didn't know about, nor had she ever been in the boat, yet, a couple of Lacis hairs were found, wound tightly in some pliers.
Agreed to take a lie detector test, but backed out after his father advised him not to.
Upon returning home, he immediately washed his clothes, ate, and took shower. After getting out of shower, instead of just calling Lacis cell phone one more time, he calls her mom and tells her Laci is missing.
He told, at least, three people he'd been playing golf, before finally sticking to the fishing story.
Speaking of fishing, Scott told the detectives that going fishing that morning had been a last minute decision. But, this was an obvious lie because he'd purchased a two-day fishing license dated for the 23rd & 24th, a few days before. Or, maybe he's just psychic, and predicted he'd be making that "last minute" decision!
When he took the detectives to his warehouse, he led them to believe the power was out, when the truth was, only his office in the warehouse had lighting, but the warehouse, itself, was only lit by a sky light during the day.
On the night of Dec 24th, the day Laci went missing, Scott was already inquiring about grief counceling for Lacis family. Really??? She's not even yet gone a full 24hrs! I've never heard of anyone doing that over someone being missing for only a few hours! It just seems like Scott knew she wasn't coming home.
The next day, Scott called the detectives asking them if they'd be bringing in and using cadaver dogs. She hadn't even been gone a full 24hours, and, he is inquiring about cadaver dogs! This was a huge red flag to the detectives working the case!
He sold Lacis car while still missing, before her body was found. And, inquired about selling their home before she was ever found too! He even wanted to sell it with all their furniture! Supposedly, he doesn't know if Laci is dead or alive, but has no problem selling her car and their home, with all their stuff in it?

When the due date, of the birth of his missing baby came around, he didn't have a gathering of friends & family to remember Laci & Conner. No, he didn't do anything at all to remember them. And, that would've been fine, if he chose to do nothing, no problem. But, he DID choose to do something. Since that day was also Ambers Bday, Scott chose to celebrate it, by hiding a bag of jewelry and a CD, etc for Amber to pick up. It seems it was Amber he wanted to remember & honor, not his missing wife & baby.
When a body of a baby washed ashore, and then a body of a woman who had been pregnant washed ashore shortly after, within just a couple of miles from where he says he was 'fishing', he never even called anyone about it to see if it was Laci.
About a week or so later, he was caught trying to flee with just about everything he owned, BUT his golf clubs and golf shoes. I add that he didn't have his clubs & shoes because Scott tried telling the cops that he was just going to play golf, not flee! However, the list of things he had with him is just as long, if not longer than my list here of the evidence!

Tom Harshman, a former reserve police offer who lives in Modesto, sees something that really concerns him near the corner of Scenic Drive and Claus Road as he is driving with his wife between 2:00 and 4:00 p.m. on December 24.
He sees a young pregnant woman who closely resembles Laci squatting by a fence, urinating, with a tall white man hovering over her. Harshman sees the woman’s face when she is up against the fence -- that’s what he is concentrating on -- and he sees a scared look on her face. The man then forces the woman into a tan van, and someone else is inside the vehicle.
Harshman's description of the van is similar to Jackson's description of the van used in the commission of the Medina burglary. He describes the van as an older white van with three windows and a tan stripe on the side, approximately a foot wide.
The woman Harshman sees has dark hair and is wearing black pants and a red shirt (perhaps a jacket?). The man he sees with the pregnant woman is a white male, in his forties, and is wearing a ball cap.
After driving past this scene, Harshman is so upset that he turns around and goes back to the spot, hoping to find the van still there and hoping to get more information about the license plate number, but the van is gone.

The most important thing, I think, of that, that I really want to make clear to you is, you did not hear a single witness who said they saw Laci Peterson walking in the neighborhood, or on Covena, or in the park on December 24th. You did not hear from this stand a single witness who said that. You heard officers testify that people reported to that. You can't consider that for the truth, not a single bit of it.
You know what's an interesting point, Detective Brocchini was on the stand. He was asked about Chris Van Zandt, a man who had called in and reported that he saw Laci Peterson down in the park on the December 24th, and it came in as hearsay. Not offered for the truth, so you can't consider it for that. And that was the testimony. That was it. Yeah, this guy said he saw her, called in. Okay.
Well, remember we brought in Chris Van Zandt, the actual witness. We brought him in and put him on the stand.
Okay, fine. Let's hear what he has to say. Remember what he told you? He said, I know for sure I didn't see Laci Peterson on the 24th in the park that day. So the only witness who, the only person who called in to the police and said they saw Laci Peterson that came in and testified, told you without any doubt in his mind it wasn't Laci Peterson that he saw that day. That's the only evidence you can consider for its truth. None of these other ones.
Remember the defense even put an exhibit in. I might have it over there.

Not a single one came in to testify. Why do you think that was? This is a very experienced defense team. They are very good lawyers. They obviously know how to prove facts if they want to. Why do you think they didn't bring in a single witness to testify that they saw Laci Peterson walking that day? Remember, you heard a bunch of evidence about Tom Harshman. Remember that whole thing with the fence, and the woman urinating, and the van, and all that crazy story? How come Tom Harshman didn't get up here on the stand? Let's hear what he has to say if that's true. None of those people came in and testified. You know why?
You can assume because that what they were going to say was not credible, that's why.
Remember Investigator Bertalotto was asked about a guy named Chris Clark.
Remember Chris Clark? He didn't contact the police until April, 2004. He didn't know Laci Peterson. He never spoke to her. He said he saw her while he was working in the neighborhood. He said he knew this from his time in treatment for substance abuse. His problems obviously continued, because in 2004 he was under house arrest for his third DUI.
I'm not beating up on anybody with a substance abuse problem. Far from it. But it's not right to ask about hearsay evidence in this trial and not put this witness on the stand. How come this witness wasn't called to the stand? The investigator testified just back in April he went out to his house and talked to him. He is certainly available. Why didn't we hear from him? We didn't hear from him because obviously his story was not credible, that's why.
I personally think that a lot of the witnesses who saw Laci that day and did call in, decided to change their stories based on the medias portrayal of the case. Scott was convicted long before he had his day in court. I’m not saying he’s innocent, but I believe the police dept and detectives made a narrative and ran with it.

Grogan excuses the MPD failure to follow up on tips by citing Karen Servas’ 10:18 timeline for finding McK. Even if Karen Servas’ timeline were accurate, which it is not, MPD did not have information about her reinvented timeline until January 3. The detectives did nothing to confirm that her time source was valid.
Grogan also says tips were not followed up because phone records indicate that Scott was still in his neighborhood at 10:08. This theory did not take shape until shortly before trial. Two prosecution witnesses stated that cell phone records were not designed to be used to identify location.
Grogan also uses the excuse that tips were not investigated because witnesses reported Laci wearing black pants and her body was found wearing tan pants. MPD did not have this information until mid-April when Laci’s body was found.
Then Grogan indicates that sightings outside of the park were discounted because Laci was planning to walk in the park. This is blatantly false and Grogan knew it. Grogan had been present on December 26 when Chris Boyer interviewed Scott Peterson at his home. Scott clearly stated that Laci sometimes walked in the neighborhood. He told Boyer, in Grogan’s presence that Laci had walked on Sunday, December 22, in the neighborhood."

Working for a family living on Encina, the man saw Laci walking McKenzie on Encina at least 5 times after October 15. He also saw the two of them in the park, and said one of the family members would talk to Laci when she waked McKenzie. He last saw Laci and McKenzie walking two weeks before Christmas. He said he knew it was Laci he had seen because on the night of the 24th he and the family he worked for on Encina brought coffee to the Peterson house.
GERAGOS: Now, specifically the, you received, or you did an interview with somebody by the name of Chris Clark?
BERTALOTTO: Yes, I did.
GERAGOS: And you did that recently, I take it?
BERTALOTTO: I think it was in June.
GERAGOS: I'll do it either way you want. Want me to show you mine? Or just use yours? You got it. And when did you do this interview with Chris Clark?
BERTALOTTO: On the 23rd of April, 04. It was a face-to-face interview. I had done a short phone interview prior to that.
GERAGOS: Okay. Now, is it a fair statement that this gentleman called after reading this story in the Modesto Bee that prosecutors intended to present evidence Laci was not walking her dog during the two months preceding her going missing?

Police ignored Harshman's tip.
Tom Harshman, who lived in Modesto, saw something that really concerned him near the corner of Scenic Drive and Claus Road as he was driving with Elizabeth Harshman between 2 and 4 p.m. on the afternoon of December 24. He saw a young pregnant woman being forced into a van. After driving past this scene, Harshman was so upset that he turned around and went back to the spot hoping to find the van still there and hoping to get more information about the license plate number.

Then approximately two months later a New York City police detective says, I have talked to, presumably, Harshman's wife who may have witnessed the incident, correct?
GROGAN: Yes. He got the information from a friend of Miss Harshman's, Mr. Harshman's wife, I believe.
GERAGOS: Okay. And specifically you contacted him on May 18th, 2004, correct?
GROGAN: Yes.
GERAGOS: And he, when you contacted him, he told you that the same day he called into the police department. You put it down at 12:28, right?
GROGAN: Yes, based on that tip.
GERAGOS: I don't think you ever saw this. I'm just going to show this to you. When I went through the tip lines, at 14789, it looks like somebody called in, but the name that was written down was Thomas Harsh. Do you see that?

GERAGOS: Okay. This is the first time that you have seen that, because when the caller, whoever took down the information, they just wrote Harsh as opposed to Harshman, correct?

GERAGOS: Okay. And he said that he, specifically, on the same day that he had called in, he had seen a van parked on the south side of Scenic, west of Claus, which he described as a 70s, American-made model, beige in color, correct?
GROGAN: Is that the tip that you are reading from top?

While under oath during the trial, he admitted to excising the information from his police report and acknowledged that he did not think it had been reported by any other officer. This woman later confirmed that Laci was at the warehouse on December 20, 2002. This situation confirmed that Scott was once again being truthful. It was Detective Brocchini who had been deceptive.
Guy Miligi told police on January 4, 2003 that he and Scott had discussed purchasing a ski boat together prior to December.
Jodi Miligi told police that Scott discussing a boat one to three weeks prior to Thanksgiving.
Brian Ulrich told detectives on January 4, 2003 that Scott had been discussing buying a boat for over three months.
Scott withdrew the $1400 from his joint checking account with Laci. Also, Scott did not try to hide his identity from Bruce or the DMV. Scott gave accurate information to Bruce including his home address. This information was filed with the DMV on 12-9-02. Another boat Scott looked at on December 8th was not registered with the DMV, so Scott decided not to purchase it. It was also the sellers request that Scott pay cash.

Grogan excuses the MPD failure to follow up on tips by citing Karen Servas’ 10:18 timeline for finding McK. Even if Karen Servas’ timeline were accurate, which it is not, MPD did not have information about her reinvented timeline until January 3. The detectives did nothing to confirm that her time source was valid.
Grogan also says tips were not followed up because phone records indicate that Scott was still in his neighborhood at 10:08. This theory did not take shape until shortly before trial. Two prosecution witnesses stated that cell phone records were not designed to be used to identify location.
Grogan also uses the excuse that tips were not investigated because witnesses reported Laci wearing black pants and her body was found wearing tan pants. MPD did not have this information until mid-April when Laci’s body was found.
Then Grogan indicates that sightings outside of the park were discounted because Laci was planning to walk in the park. This is blatantly false and Grogan knew it. Grogan had been present on December 26 when Chris Boyer interviewed Scott Peterson at his home. Scott clearly stated that Laci sometimes walked in the neighborhood. He told Boyer, in Grogan’s presence that Laci had walked on Sunday, December 22, in the neighborhood.

Furthermore, Dr Charles March testified there is no way that Scott and Laci Peterson's unborn baby could have died any earlier than Dec. 29, 2002. Dr Allison Galloway determined the baby could have even been alive as far along as Jan 14th.

I want to say from personal experience. I used to be very shy never wanted to be on TV or anything like that. But when I was fighting my case, and the press came and wanted an interview, and to talk about my case, I didnt want to speak to anyone, I didnt trust them. Then an authority figure told me, if I want people to listen to my case then I better swallow whatever anxiety I had about talking with the press. She said just be honest, and brave and talk about your case, and its OK to be emotional, because I was afraid of crying in front of people. I changed my whole life that day. If going on camara and talking about my case, could save my loved one, then who cares about my problems! with anxiety or whatever. I did the interview. Was honest, and emotional and intelligent. That press release wound up helping my case a lot because people could see how genuine I was and people called their representatives to do something about it, and I won the case in the end. Now I'm not shy anymore, and I would go to the press for help, its an important process of solving a case.

Two prosecution witnesses stated that cell phone records were not designed to be used to identify location.
Grogan also uses the excuse that tips were not investigated because witnesses reported Laci wearing black pants and her body was found wearing tan pants. MPD did not have this information until mid-April when Laci’s body was found.
Then Grogan indicates that sightings outside of the park were discounted because Laci was planning to walk in the park. This is blatantly false and Grogan knew it. Grogan had been present on December 26 when Chris Boyer interviewed Scott Peterson at his home. Scott clearly stated that Laci sometimes walked in the neighborhood. He told Boyer, in Grogan’s presence that Laci had walked on Sunday, December 22, in the neighborhood.
At the time these sightings were coming in, MPD still believed that Scott had left home around 9:30 a.m. and that Karen Servas had found McK around 10:30 a.m. Each and every one of these sightings should have been investigated thoroughly. MPD’s failure to do so is inexcusable.

Caller said he had a conversation with two men who were bragging about Laci’s murder.
The first man was named. The second man was unnamed, but the tipster gave a description and knew where the second individual lived.
It was reported “when they did it they thought it was going to be just another murder case . . . now it’s a big case all over TV and news . . . and they are blaming the husband and they are not getting any attention.”
Caller went on to say that he knew John Doe lived with his mother; his mother has the same last name. The last name is worth mentioning because four days earlier, the Modesto Police had encountered Mother Doe. She was present at her neighbor’s home when police came looking for the Medina’s stolen property. There was a strong connection between the Doe family and burglar Steven Todd. Certainly, this would merit follow-up, especially since the AMW operator stated this caller was 100% sure.
Unfortunately, the extent of their follow up was this:
This tip was given to a Modesto police officer - the same officer that encountered Mother Doe four days earlier. This officer drove to John Doe’s house - which was one block away from where he had encountered Mother Doe four days earlier. John Doe was standing outside. The officer confirmed his identity and asked where he was on December 24th.
John Doe said he was “locked up.” The officer called the jail and a deputy confirmed that John Doe had been in jail on the 24th, so the officer did not ask any other questions. Not one.
But notice the tip did not say John Doe had murdered Laci, the tip just said “they did it.” It is not clear at all who “they” are. However, the officer asked no more questions of John Doe. The officer never asked John Doe why it would be reported that he was bragging about the murder of Laci Peterson; whether he knew anything about Laci’s whereabouts; or about his mother’s connection to the Medina burglary. It was later found that HE WAS NOT IN JAIL during December of 2002.

Tom Harshman, who lived in Modesto, was driving with Elizabeth Harshman between 2 and 4 p.m. on the afternoon of December 24. He saw a young pregnant woman being forced into a van. He turned around and went back to the spot hoping to find the van still there and hoping to get more information about the license plate number. But they were gone.
1) He called police (911 MPD) that same day.
2) Tried again December 28.
3) December 28, he also called the Laci tip line twice. His first call on this date was listed incorrectly under the name Harsh and was given Bates Stamp number 14789. The call was given to Detective Holmes. Harsh(man) said that he had called 3 or 4 days earlier on the day that he had seen a pregnant young woman being pushed into a van. There had been a man standing over her as she squatted to urinate with her back up against a chain-link fence. The man was described as 30’s, tall, thin, with ponytail, dirty blonde to gray hair, scrubby looking. When she finished, the woman was shepherded back to the driver’s door of the car, where another man’s arm was seen pulling her into the car. He said the young woman was wearing black pants and a red shirt. He said she had a scared look on her face."
4) Jan 3rd, he went to the Command Post in the park and relayed this to the officer on duty. Over
40,000 pages in the discovery and nothing about this report was in it.
5) February 2003, Harshman’s wife spoke to a relative of hers who lived in New York about the sighting of Laci Peterson near the corner of Scenic and Claus. Mrs. Harshman’s relative shared this story with an NYPD detective. This NYPD detective was so concerned that he contacted the MPD and spoke personally to Detective Grogan on February 14, 2003. What did Grogan do with the information? Nothing at all.
6) pre-trial hearings in May of 2004, DA Investigator Kevin Bertalotto noticed the Harshman tip and insisted that Grogan call Tom Harshman and speak to him personally. Grogan did this on May 18, 2004.
An audiotape and a transcription of his conversation with Harshman to the defense on May 20, 11 days before the beginning of the trial.
