In regards to the potential "hearing" that Judge Chutkin could hold concerning the Official vs Private (campaign) activities. Andrew Weissmann made an interesting point on the Lawrence O'Donnell program last night, that a hearing wouldn't be just any old hearing that normally lasts a day or two. This hearing could actually last several weeks (just like a trial) with a number of witnesses testifying and most of the same evidence that would have been entered into evidence at a regular trial, would be submitted as evidence in this "hearing".
Weissmann implied that this hearing would essentially be a "bench trial" with Chutkin making the final verdict (No Immunity/Guilty!), as opposed to a jury trial (that would be subject to a hung jury). This would still allow the American voters to see the same evidence/testimony that would have been presented at a formal trial, and allow the voters to become a "Jury of 1", where they could arrive at their own "verdict" . . . and vote accordingly. Another big benefit of a hearing over a formal trial, according to Weissmann, is that the hearing could be held much sooner than the trial, as the defense wouldn't be given all that extra time (81 days . . . almost three months) to prepare for a "hearing".
His take was very interesting and will probably be talked about more, should the SCOTUS remand the case back to Chutkin to decide the Official activities vs Campaign activities question.

I am a European and I am very sorry to see America drowning in this way every day. Your only hope for saving your democracy is next November. Also, I suggest you think carefully about depoliticizing the presidential nomination of the SCOUTS. Instead of making presidential appointments, make it an automatic career progression, based on the merit and impartiality proven by the candidates' judicial career and life. Judges linked to or affiliated to political parties should be automatically disqualified from appointment. Good luck next November.

How is a president supposed to do his job if there's always the threat of someone deciding he should be prosecuted for a critical decision he had to make? A president has to have some degree of immunity. This has never been an issue till now and has opened up a whole new can of worms.

Presidential immunity applies to actions performed in the role of President. This hearing is to determine whether Trump's actions in trying to overturn the election were as President or as a Presidential candidate. As numerous people have said, he's not saying he's innocent; he's claiming that he should be allowed to commit crimes without the possibility of punishment.
