I used to live in Pondoland for many years. Tribal justice (from the incidents I witnessed there) was extremely effective. No prison, just punishment. Real punishment. To be banned from a village and area after punishment is a huge shame and the punishment was public, with all kids and elders there to witness. From what I could see, this was very effective. As for gender based violence, a man could lose the cows already paid for his wife, if she chooses to return to her family because of abuse. I'm just an uninformed white man who loves the people of Pondoland so please don't judge me too harshly for misunderstanding some of the things I witnessed there. My heart still lives in those hills and with the people and when I go back, I shall make sure to have learnt their language properly as to understand better.
Anyone who has a notion that customary law has a place in today's society wants to take us back to those draconian laws which still impact the Black woman, especially, negatively. We do not want to be taken back to being minors and have our lives under the total control of men after we have proved we can hold our own financially and intellectually. Women should be wary of anyone who is touting for customary laws especially where it pertains to property ownership, marriage, custody of children and other human rights which we have gained over the last 50 years. Whatever these people are proposing will not change the trajectory of our country. It is also not fair that these laws only apply to Black people in a multiracial country like ours. As it is our government is labouring under the yoke of having to dole out child support grants and NSFAS for children whose fathers have gone MIA. This form of negligence is not only limited to city dwellers but is also rife in the rural areas. Increased crime rates, GBV and the gradual decay of societies are also happening in areas with traditional leadership in place. Land is lying fallow with no productivity whatsoever under traditional leadership watch. Our mainstream laws did not remove that responsibility from traditional leadership. Most people, I am certain, would like to know why rural areas resemble townships with no development at all which has led to the influx to the cities due to lack of sustainance in the rural areas and abandonment of homes and tillable lands. Before complaining about the ills of our laws how about fulfilling their current roles first that of looking after the welfare of their people within their current scope seeing that the government has been so generous and respectful in recognition of their status.
