Uber Driver Arrested for Impersonating a Police Officer

  • ORLANDO, FLORIDA - From the report of Officer Stephen Erickson, lightly edited for clarity and brevity:
    On 10/15/2019, at approximately 2120 hours, Officer John Edwards and I were on proactive patrol in the area of N Mills Avenue and E Colonial Drive. While traveling southbound on N Mills Avenue, I observed a black 2016 Acura four door sedan traveling slowly in the left thru lane of E Colonial Drive. As I glanced to my right, I observed flashing blue and red lights coming from the dash area of this vehicle. Another vehicle in front of the Acura appeared to be pulling to the right and the Acura was following it. As I entered the intersection, it appeared the driver noticed my marked police vehicle and deactivated his red and blue lights.
    I turned around to get behind the vehicle as it continued to travel eastbound on E Colonial Drive. It appeared the driver knew I was behind him and he accelerated, weaving between vehicles in an erratic manner. I initiated a traffic stop and made contact with the driver, Josue Santiago. As soon as I approached the driver side window, Santiago had his wallet in his hand and was displaying a gold five-point star badge. The badge had the seal of Florida and the lettering “DEPUTY SHERIFF CHARLOTTE COUNTY FLORIDA” imprinted on the front. To my knowledge, this appeared to be a real Florida sheriff's deputy badge. I asked him if he was a law enforcement officer and he replied that he was not, but that his cousin was. He stated his cousin’s name was "John Nunez," who was a "state trooper." I asked why he had the police badge in his possession, and he explained that he had bought it on eBay.
    Before any further questioning, I read Santiago his Miranda warnings. He agreed to speak with me. I explained to him that I saw his lights activated on E Colonial Drive and he replied that a truck had "crossed him" and he flashed the lights to get the truck out of his way. I asked why he had a red and blue light on the front of his vehicle and Santiago explained that he was an Uber driver, and that he often used it while picking up passengers from the airport. He explained that the parking attendants at the airport require him to move, so he activates the red and blue lights, so he can wait on passengers. I again asked Santiago about the badge in his possession and he again stated he bought it on eBay. I advised him that it was illegal to possess a law enforcement officer's badge [which, it should be noted, is not quite true] and he stated that I could take it.
    Santiago’s vehicle was black in color and had a “Police Athletic League” license plate with a “thin blue line” license plate cover. On the front bumper, he had a thin blue line license plate with the imprint of a five-point star and the words “UNITED STATES OF AMERICA LAW ENFORCEMENT POLICE OFFICER." Inside of his vehicle was a blue and red flashing light attached to the windshield, a can of OC spray in a police-style pouch in the left door, and a police-style flashlight in the center console. Santiago repeatedly told me about his extensive volunteer work with law enforcement agencies and how he did not think that improperly using a red and blue light to gain certain traffic privileges would get him arrested.
    Santiago was charged with falsely personating a law enforcement officer, prohibited use of certain lights, and unlawful use of police insignia / badge. Santiago pleaded no contest to the charges and adjudication was withheld. He was sentenced to two days in jail with credit for two days served and placed on probation for three years, during which time he must undergo a mental health examination and any treatment deemed necessary. Santiago was ordered to pay a variety of fines and fees totaling roughly $800, and the court ordered his lights and badge forfeited to Orlando Police Department.
    Notably, Santiago has a bit of a record, having been convicted of theft, resisting with violence, battery, evidence tampering, possession of cocaine, paraphernalia, and possession of cocaine with intent to sell/deliver.

      @@BlendedFamilyMan thankfully on that occasion the second officer to arrive recognized me from a couple investigations I help her with and she and I had a nice chat and no ticket was issued either. They were just out looking for drunks I think. Driving uber from 12 am - 4 am I was pulled over often in areas with lots of bars. They usually would be like "oh he is just an uber driver".

    These guys are dangerous.
    Many years ago, I was pulled over on the freeway. I didn't get a real good look at the car, but it had red and blue lights.
    I had my dog with me. The "officer" walked up on the passenger side of my car. As soon as my dog went off, this "cop" turned and walked away, getting back into his car and left.
    I went to the nearest police station but they didn't care.
    Why do these cop wannabes argue? Are they so far into their delusion that they believe they are really a LEO?
    This is scary. Watch the one about the guy who says he is with the national weather service. He has red and blue lights, spot light, and sheriff badges and bullet proof vest, and a pepper ball gun that looks like a glock. Yes, you never know when you might need to protect yourself from an attacking rain cloud.

      Absolutely terrifying. Thank God you had your dog with you! No legit cop making a stop would be deterred by a dog in the car. They would make sure it was restrained from getting out or biting, but they would never walk back to the car and leave.

      actually, in my younger years I was driving with a suspended license, after getting off work I got stopped by a cop for speeding (10 over).. I was like dammit! anyway as soon as the cop pulled to my window, the first thing I said to him after he asked me for my license was " sir I believe I'm driving under a suspended license" but I live 25 miles from work and taking 4 buses to and from work would take me 6 hours, so I apologize in advanced" after 20 minutes in his patrol car he came back and said " Ok here is the deal" I'm going to give you 3 citations, no seat belt, no DL and speeding for being honest with me I wont arrest you and impound your car. I actually drove off and started taking the bus the next day.

      I've been pulled over by a Mercedes by a plain clothes state trooper in NJ. Dunno if it was his personal car or an inherited impound or whatever, but he promised a failure to signal ticket in the mail and I got it. Talked to a lawyer and found out the truth about unmarked cars and traffic stops. They can be anything and stop you for any traffic violation.. in NJ at least.

    Over the years, I have seen a few different methods of mirandizing. The worst is when it's rattled off half-assed and fast. I think the way this officer read it is the best method. I feel like it's exactly the way it should be in law enforcement, across the board. Read a statement, ask if they understood the statement, repeat.

      What pisses me off though is officer's that think they have to embellish everything in their reports. "he had a pepper spray in a Police type holster" and "he had a Police type flashlight!" Give me a freaking break. You already have him admitting to using the lights and he flashed the badge as soon as you approached the vehicle, as would most law enforcement on a traffic stop. Why try to make a simple flashlight into a "police type of flashlight!" What in hell makes a holster or flashlight a police type? My favorite flashlight that I carry everyday is the SureFire G2X "LE", which is the "Law Enforcement" version, which only means that on first push it's very bright and a second press is for low power mode. SureFire makes the best flashlights in my opinion and I just so happened to like the "LE" model that is sold everywhere including Amazon and Walmart, etc. I constantly see Police reports like this one, they constantly have to add in unnecessary or impossible to prove aspects. Such as "he was breathing hard, sweating, he stuttered, he said no when I asked if I could search the car", etc, etc. Read almost any police report and you find these types of embellishing statements or statements which are impossible to measure or prove. This is America and we have a 2nd Amendment and ability to defend ourselves, if I own a certain flashlight or gun or OC spray, that a lot of law enforcement happens to own, is that a crime or intent, or just complete bullshit? Is owning a Glock 17 a "Police type" of firearm?

      @@patricksmith2553 Police officers need to demonstrate as MUCH probable cause for the arrest as possible to prevent District Attorneys from dropping charges. That's why they phrase it that way. You need to demonstrate all the intent he had to impersonate an officer or else the DA won't bother with it.

I feel like he was probably bullied in high-school and never got any respect from anyone. So the "cop" persona he tried to use made him feel like he was being respected and people liked him. Plus the little bit of power he had over someone who believed he was a legit cop probably gave him a rush. He just couldn't stop himself. That's why he couldn't get out of his own way and kept making HORRIBLE decisions like wiretapping and all the other highly illegal stuff he did.
