      of course he probably already sold it by now , this case was probably around a decade ago . and who knows if the defendant was gonna try to sell it himself at a later date because he did not give the jersey back without being sued for it .

    It would have been sweet justice if the Judge had said that the jersey could only go back to John Turneau (sp?) or only John could sue for the return, since that's who the defendant conducted the transaction with.

    Googled the dudes name and one of the top results was that game used forum that was evidence and they're openly hating this dude. They're keeping track of every username he uses. Looks like there's also been multiple lawsuits before and after this episode!

      Yep. It's actually really sad. I've seen thousands of Facebook groups dedicated to taking down people that have scammed so many people. They reach out to file reports and give the evidence and half the time, nothing is done about it. People have to do their research BEFORE buying items. Usually, they don't learn about it until after. With COVID people took advantage with the online buying. Making false claims and sending empty packages. It's sad.

      I'm guessing based on all the different complaints, the investigation extends beyond this one jersey. He's selling fraudulent items across state lines for thousands of dollars, I'd bet there's a federal case out there.

    There's a local DJ who says he's responsible for about 25% of the Paul McCarney autographs out there. He said at KROC in LA in the 70s, they would sit in the break room signing Beatle albums for contest giveaways. He did thousands of them. It's kind of funny how apathetic he is about doing it.

    Plaintiff's dishonesty was apparent from the beginning when he talks about this John guy who lists things for him (why?) but apparently couldn't come to court as a witness. But JM is right that if the defendant got his money back, he has to give the jersey back. A real shame how people like the plaintiff rip off sports fans by making them think they can have a piece of their favorite team.

    I think the judge got it wrong. The key point is the jersey is a licenced product. The authentication company showed it was altered. I believe that would violate the license, just like a fake l.v. she spoke of.

      I disagree... remember who was being sued and why. The defendant was being sued because he got $3500 refunded but wouldn't return the jersey. The authenticity/licensing technically would only affect JM's judgement if the defendant got rid of it, forcing her to assess how much it was worth.
      Whether it was authentic or not, the defendant wasnt entitled to keep the product and the money

      With the LV, she passed off the fake bag to the authorities to handle but in this case, the jersey was already handled and returned. It's why she asked why he didn't refuse to take it back. If he hadn't accepted it back, it would've been tossed or destroyed and he wouldn't have to return it but because he got it back, it showed that the cops weren't interested enough to keep for investigation or prosecution. She's right; there's nothing she could do because if the cops don't want it, then it has to go back regardless of if it's altered or forged.

      @johnpeters9793 first, excellent question. I did a horrible job in my comment at explaining my position.
      I agree with the verdict. My disagreement comes from the point she made about how she handles fake merch by ordering their surrender. My point was the jersey was altered according to the authentication company. If the jerseys weren't available to the public (I believe the judge said that) it would mean either the jersey is a fake or it's a licenced product that was altered. Either way to my way of thinking it's a fraud.
      Sorry for the rant, it's just so infrequently I disagree with judge m.
