The authenticity/licensing technically would only affect JM's judgement if the defendant got rid of it, forcing her to assess how much it was worth. With the LV, she passed off the fake bag to the authorities to handle but in this case, the jersey was already handled and returned. It's why she asked why he didn't refuse to take it back. If he hadn't accepted it back, it would've been tossed or destroyed and he wouldn't have to return it but because he got it back, it showed that the cops weren't interested enough to keep for investigation or prosecution. She's right; there's nothing she could do because if the cops don't want it, then it has to go back regardless of if it's altered or forged.
